对于暗中帮助他人实行犯罪行为的认定,历来就有片面共犯说与间接二犯说之争,它们要么将此行为一律视为片面共犯,要么全部认定为间接二犯,笔者认为,二说均有以偏概全之嫌,所以试图经过对此行为的分析论证得出认定的界分点,并认为在一般情况下,该行为成立片面共犯.但在暗中帮助者具有与被帮助者不同的目的时,该行为应当而且接间接二犯处理,从而对片面共犯说与间接正犯说进行了扬弃.  相似文献

劳动教育是中国特色社会主义教育制度的重要内容,新时代加强劳动教育具有重大的时代价值和战略意义。本研究运用修正的“渐进—多源流理论”分析了新时代劳动教育政策的制定过程。研究发现:劳动教育的不良指标、负面的政策反馈、焦点问题和事件构成问题源流;执政理念和价值选择、民意表达构成了政治源流;领导核心的推动作用、专家学者的政策建议、地方探索和经验、网络媒体的助推形成政策源流;习近平总书记在2018年全国教育大会上关于加强劳动教育的讲话打开了政策之窗。研究认为,在有限理性视野中,新时代劳动教育政策的制定是一个渐进调适的过程,中国语境下本土化因素对各源流产生重要影响,各源流渐进性明显,要关注网络对各源流带来的变化和影响,强化政策执行、协同推进。  相似文献

劳动幸福是一种客观状态,对劳动幸福观测维度的测量有助于有针对性地提高劳动幸福程度。劳动幸福可以从四个观测维度进行测量,分别是劳动发展维度、劳动解放维度、劳动尊严维度以及劳动基础条件维度。这四个维度相互联系、互为因果,共同促进劳动幸福程度的提高。根据这样的理论建构,研究设计了"劳动幸福问卷”,对来自全国的样本进行了网络在线调查。分析结果显示,劳动幸福四维度之间具有正相关关系,符合本研究的理论建构。这说明“劳动幸福问卷”在总体上是可用的,是一个可靠和可信的研究工具。  相似文献

ABSTRACT

In the late Soviet Union, large-scale projects such as the Toktogul Dam in the Kyrgyz Soviet Republic were promoted as emblems of the Soviet model of development in Asia. While Central Asian politicians and intellectuals usually tuned in to the enthusiasm, the construction also revealed different opinions about the precise direction and goals of Soviet development. Large-scale investments became focal points of political and intellectual debates; they not only helped bind the periphery closer to the Soviet centre, but also revealed the different economic, political and cultural priorities of the regional, republican and union-wide actors. The construction of dams and reservoirs eventually triggered conflicts between the republics and laid the foundation for an anti-colonial critique of the late Soviet state.  相似文献

In the present longitudinal 3-wave study of 1274 adolescents and young adults, aged 12–24 at the 1st wave, it is examined whether youngsters from intact versus postdivorce families show long-term differences in internalizing and externalizing problems. Furthermore, possible differences in the development of this problem behavior between offspring from intact and postdivorce families are examined, i.e., possible differences in growth curves of internalizing and externalizing problems are investigated. Longitudinal multilevel analyses reveal long-term differences in internalizing and externalizing problems according to family structure. Adolescents and young adults growing up in postdivorce families display more internalizing and externalizing problem behavior than youngsters of intact families. The development of these 2 types of problem behavior does not differ by gender or family structure. That is, the shape of the growth curves of internalizing and externalizing problem behavior is similar for boys and girls and also for youngsters from intact and postdivorce families. His major research interests are occupational and relational life courses of youngsters. Cora Maas is an Assistent Professor at Utrecht University, Department of Methodology and Statistics. She received her PH.D. in 1992 in Utrecht from Utrecht University. Her major interests are: multilevel analysis (theory and applications). Wim Meeus is full Professor of Adolescent Development at Utrecht University. He received his Ph.D. in 1984 from Utrecht University. In this article, we test: (a) the relation between school-based extracurricular participation and indicators of positive and negative development across a range of activity contexts, and (b) a mediation model linking activity participation, prosocial peers, and development. Extensive survey information was collected from a predominately White sample of middle class adolescents in 9th, 10th, and 12th grades. Extracurricular participation was related to more favorable academic, psychological, and behavioral adjustment; the pattern of findings differed by activity and outcome. In addition, we documented some support for the hypothesis that the link between extracurricular participation and positive adjustment is partly a function of associating with a prosocial peer group. Implications of these findings and suggestions for future research are presented. Assistant Professor of Human Development, Connecticut College.
