船舶物权变动登记效力的理论解析——兼论我国《物权法》关于物权变动登记效力立法模式的选择

物权变动登记的效力存在对抗要件主义和生效要件主义之别。在分析两种立法例的基础上,本文指出了我国物权变动应采取与船舶物权变动相同的立法模式,即应采取对抗要件主义立法,并对我国《物权法》提出了修改意见。

论大学生校外兼职的劳动权益

大学生兼职过程中享有劳动者应有的合法权益。用人单位不得要求大学生提供担保,也不得扣押劳动者的居民身份证或者其他证件;用人单位应该按照同工同酬的原则向大学生提供报酬,并不得低于最低工资标准;大学生有权拒绝执行用人单位管理人员违章指挥、强令冒险作业的行为并不构成违反劳动合同的行为。     

Roadside corpses in Nigeria: social anonymity,public morality,and (in)dignity of the human body

In Nigeria, it is quite common to see human corpses decomposing by the roadside. Existing scholarly comments have emphasised the aspect of state failure implicated in the phenomenon. However, based on observation, analysis of media reports, and informal discussions, this paper identifies some of the cultural factors that deny roadside corpses the basic honour of burial. Firstly, corpses that decay by the roadside are usually disconnected from the network of kin relations, thereby provoking meaning about space and social signification of the human body. Secondly, the low social status often ascribed to these corpses points towards an idea of the human body as a possible site for enactment of social inequality. Thirdly, public indifference to roadside corpses is explained in terms of contrasting public moralities, neoliberal ideals of self-contained individual, a resentment of the police intertwined with a complicated criminal justice system, and a cultural attitude towards strange entities.     

Counter-trafficking governance in South Africa: an analysis of the role of the KwaZulu-Natal human trafficking,prostitution, pornography and brothels task team

Determining the efficacy of available counter-trafficking strategies is just as important as understanding the phenomenon of human trafficking itself. This is so if anti-trafficking practitioners wish to make in-roads in preventing and combating human trafficking in South Africa. At the heart of the matter are the ways in which counter-trafficking governance is structured in the South African context. In this article we use the KwaZulu-Natal intersectoral task team, an un-resourced agency of provincial government mandated to prevent and combat human trafficking, as a case study to analyse the ‘4P model’ of counter-trafficking favoured in South Africa. We find that while such an integrated model has great potential, issues of institutional cooperation and coordination, pervasive public official corruption and budgetary constraints hamper its current impact and efficacy. We conclude that these issues must be addressed by South African policy-makers once legislation has been promulgated.
