本文回顾前苏联状态立法的历史发展过程,分析了俄罗斯联邦紧急状态的立法动因,总结了2001年《俄罗斯联邦紧急状态法》出台以后俄罗斯现有的紧急状态立法的法律体系和特点.供我国目前紧急状态立法参考.

中韩人力资本投资比较研究

近年来,中韩两国的人力资本水平和人力资本投资水平都有很大程度的提高,但二者却存在较大差距。中国居民受教育水平、公共教育经费支出和人均教育经费远低于韩国;与韩国"金字塔"式的教育投资相反,中国高等教育入学率低于韩国,高等教育投资比重却高于韩国;中韩两国女性教育水平均呈提高趋势,两国的性别教育均不平衡,韩国女性的受教育程度普遍高于中国;韩国拥有的医疗卫生资源和居民卫生费用支出也都高于中国平均水平,但两国差距在缩小。消除消费价格指数影响后,两国在人力资本投资水平上的差距有所缩小,北京和上海等城市的水平与韩国更接近。     

So-called Spontaneous Human Combustion

A well-documented case of so-called Spontaneous Human Combustion is reported. Review of the literature shows that these strange observations have been reported since the 17th century, even in famous novels. There are several main features that may lead to help the diagnosis: the vicinity of the body is intact or nearly intact, some parts of the body are turned into ashes (usually the middle third of the body), whereas other parts are intact or nearly intact, burning of the body usually occurs postmortem, the cause of death is usually natural, there is often (but not always) high concentrations of blood alcohol, there is a source of heat near the body. It is indispensable to rule out a homicide by the examination of the body in situ, the autopsy, the toxicological and histopathological samples, the arson assessment, and a thorough police inquiry.     

Are Children's Best Interests Really Best? ZH (Tanzania) (FC) v Secretary of State for the Home Department

Although the Supreme Court's decision in ZH (Tanzania) is an important one, as this note explains, it is less novel than many suppose – and is in some ways disappointing. By stressing the importance of immigrant children's best interests, it fails to use this opportunity to promote their Convention rights effectively.     

The impact of CCTV on fundamental rights and crime prevention strategies: The case of the Catalan Control Commission of Video surveillance Devices

Many authors have written about issues related to privacy, legitimacy and efficiency in relation to CCTV systems in public space as a crime prevention strategy. Some have approached them separately; others have tried to come up with more comprehensive approaches. Few, however, have dealt with how such concerns have been put into practice by those who have to decide on the uptake of CCTV. This article considers some reflections on efficacy, legitimacy and privacy in relation to CCTV, as an introduction to the case of how the members of the Control Commission of Video surveillance Devices in Catalonia took these issues into consideration and interpreted the Law when deciding whether to approve a petition submitted by the City Council to install three cameras in Barcelona’s public space in 2003. It concludes by drawing some conclusions from the process, as a way to highlight the complexity of the policy process around surveillance in open, public spaces.     

Webcasters’ protection under copyright – A comparative study

This paper studies the fourth generation ‘peer-2-peer’ (P2P) file sharing technology which is also known as streaming technology from the technology point of view. It critically analyses the nature of streaming technology and assesses similarities to broadcasting for the purpose of copyright protection in the name of webcasting. In addition, it considers the possibility of protecting webcasting within the framework of broadcasting under copyright and the extent of broadcasters’ rights applicable to webcasters. Based on the conclusions derived from the discussion of UK, New Zealand, Italian and US law on streaming, WIPO Standing Committee on Copyright and Related Rights (SCCR) draft documents will be critically analyzed. The Last part of this work will offer suggestions as to how to protect webcasting (streaming technology) under the umbrella of copyright.     

物权的经济分析

物权状态二元结构理论可挑战甚至取代所有权权能结构分析。一些长期争议和令人困惑的以权利、权力及其关系为内容的理论问题,运用物权二元结构理论＂公式＂求解,则可以发现入口和找到出口,且能定纷止争。权利的绝对性与相对性的对立统一性,是权利自由和受约束的方法及依据;收入分配改革的关键是限制、解放和扩展权力,即权力的合理配置;市场与政府职能分工,主要是明确公权力与市场权利的边界,公权力管制的领域限于动态权利的行使;国有物权的流失和浪费,主要是因为主体代表权没有限定权利边界而可以轻易地滥用公权力。
