Australia and the Baltic States, 1919–1945

Praised by international organizations, Estonia and Slovenia have long been considered among the most successful post-communist states. Estonia quickly transformed itself into one of the most liberal economies in the world, whereas Slovenia opted for a social justice-oriented market economy. Still, the roots of their success coincide in that consensus played a crucial role. We argue that the public sphere was never as repressed in Estonia and Slovenia during the communist period as it was elsewhere. Distinct national identities continued to be formed and re-formed by intellectuals during the decades of communist rule, who assumed roles as political leaders when the transition started. Consensus based on these national identities legitimized reform policies for the entire decade of the 1990s.

Text Matters: Some Reflections on the Forging of a New Constitutional Jurisprudence in South Africa

The South African Constitution establishes a constitutional democracy with a strong form of constitutional review. The Constitutional Court is required to declare invalid any legislation or conduct of the President which is inconsistent with the Constitution. The author, a former judge of the Constitutional Court, argues that the text of the Constitution has been an important determinant of the Court's jurisprudence, both in relation to the Court's jurisprudence concerning the institutional structures established by the Constitution and its Bill of Rights jurisprudence.     

香港特区基本法第23条的法理分析

香港基本法第23条未使用“授权”的语词,但属于授权条款,特别授权香港特区自行制定维护国家安全的法律,香港特区第23条立法属于特别授权立法,中央监督特区立法的过程及其实施,香港特区第23条立法应以维护国家安全为核心原则,明晰特区居民的权利界限,香港特区行政长官对第23条立法负责,应主导第23条立法。     

政治问题理论的衰落与重构

政治问题作为可推翻的"自然推定",属于可诉性理论的阻却事由要件。其理论发轫于联邦党人对宪法"特定条款"的阐述。为了应对将政治问题理论区分为经典形式与审慎形式所带来的司法操作性难题,布伦南大法官通过描述政治问题的六个特征,构建了政治问题的确认标准。然而,法院在适用政治问题确认标准的过程中所形成的政治问题理论的循环悖论,以及学界对政治问题理论存在合理性的质疑使得其经典形式出现变异、审慎形式日渐消亡。在激励相容理论基础上重构政治问题理论,可以尝试化解学界对政治问题免于司法审查理论基础的种种非议。     

论船舶不当滞留在港口国的救济程序

由于各国标准的参差不齐及港口国官员的个人偏见,在港口国监控程序中难免出现船舶的不当滞留。通过对美国、加拿大、澳大利亚三国港口国救济程序案例的分析,指出现有港口国的救济程序中的缺陷,并讨论在船舶不当滞留时,船方如何通过港口国国内途径申诉,有哪些法律问题需要注意,如何更好地实现权利救济。     

西南少数民族地区县域经济发展实证研究——以四川省阿坝藏族羌族自治州为例

发展和壮大县域经济是边远少数民族地区摆脱贫困、促进就业、化解"三农"问题、民族团结、巩固基层政权的重要举措。在此,以四川省阿坝藏族羌族自治州为例,通过引入城镇化水平、第二产业、第三产业增加值等影响经济发展的重要变量,建立线性回归模型。根据模型的分析结果,提出了促进阿坝经济发展的一些政策及路径的选择。

本文对不同理论流派的企业权力观点进行批判性回顾,进而阐述被传统理论及其现代发展所忽略的关于企业权力分析的某些重要方面,并出于“问题意识”,提出了建立企业的权力分析范式的思路。     

Fighting terrorism in Africa by proxy: the USA and the European Union in Somalia and Mali

The French intervention in Mali in early 2013 emphasizes that the decision-makers in Paris, Brussels, and Washington considered the establishment of the radical Islamist regime in Northern Mali a threat to their security interests. The widespread instability including the rise of radical Islamist groups in Somalia was perceived as a threat to western interests. It is the core argument of the paper if western powers decide to provide security in Africa, they will be inclined to use proxy instead of deploying own troops. Security provision by proxy in African means that African troops are doing the actual fighting and peacekeeping on the ground while western powers basically pay the costs, the logistics, and the training of local African troops. The paper concludes that the African Union Mission in Somalia (AMISOM) in Somalia and The African-led International Support Mission to Mali (AFISMA) in Mali are proxies for the USA and the European Union.
