投资争端解决机制是《海峡两岸投资保障和促进协议》(简称《两岸投资协议》)中体现两岸特色的重要制度创新之一。相较于传统双边投资协议中的投资争端解决机制而言,两岸投资争端解决机制除了引入两岸私人投资争端解决方式,还规定了投资者与投资所在地一方投资争端的协调、协处和调解等多元化机制,实现了单方规定的协议化和国际实践的两岸化,从而有效降低了两岸投资争端的“泛政治化”风险。未来,应进一步完善两岸投资补偿争端的调解程序,确保调解协议的法律约束力和执行力。 相似文献

美国对台湾“政治安排”的政策对“合情合理安排两岸政治关系”有重要影响。美国对台湾政治定位的政策是“认知到台湾是中国的一部分”,不支持“台独”或“两个中国”,但同时又“对台湾地位不持立场”。在两岸关系的解决方式方面,美国对台湾的前途持开放立场,但认为应透过对话和平解决,且要尊重两岸民众的意愿。美国这一政策增加了对统一前两岸政治关系做出“合情合理安排”的难度,但在某些方面与大陆对台政策也有一致性。目前,两岸应充分利用这些相契合的政策,推进两岸政治关系做出“合情合理”安排。 相似文献

Current suicide prevention strategies often include suicide education based on the premise that education can lead to recognition of those at risk of suicide and others who are prepared can respond and potentially save lives. As suicide is a leading cause of death for young people, it is relevant to explore how suicide education is made available to those who serve this population. In a comprehensive review of the existing literature, the presence of suicide content along the path through pre-service programs is examined. While education may be a central part of youth suicide prevention efforts, this review of the literature suggests the following needs: (a) a need for more overt inclusion of suicide content, (b) future examination of suicide content within pre-service programs not yet considered, and (c) appraisal and innovation in suicide pedagogical approaches to determine how preparedness may be enhanced and linked to subsequent practical action. 相似文献

In order to promote developmental outcomes with children and young people and to nurture their positive health and well-being in foster care, social workers and case managers are required to direct professional attention toward both the child or young person and her/his daily living environment(s)—at home, at school, and in the local neighborhoods in which they live. When viewed from an ecological perspective, foster care environments are represented conceptually as a nested cluster of settings ranging from immediate life spaces and networks of relationships in a foster home, at school, and in a neighborhood, to organizational contexts holding a statutory duty of care for children and young people assigned looked after status, along with national policies and statutes which frame foster-care environments. Many adolescents living in contexts characterized by adversity achieve positive outcomes. We adopt a protection–risk conceptual framework to examine resilience (academic achievement, civic participation, and avoidance of risk behaviors) among 1,722 never-married 12–19 year olds living in two Kenyan urban slums. We find stronger associations between explanatory factors and resilience among older (15–19 years) than younger (12–14 years) adolescents. Models for prosocial behavior and models for antisocial behavior emerge as key predictors of resilience. Further accumulation of evidence on risk and protective factors is needed to inform interventions to promote positive outcomes among youth situated in an ecology of adversity. 相似文献

Used in the education of counselors, nurses, occupational therapists and social workers, “use of self” is a way of understanding how practitioners bring about human change. In this article, the author discusses how use of self can be applied to youth work and is related to “developmentally responsive practice” thereby providing a deep theoretical construct for understanding youth work as relational. This article presents some of the key findings from a comparative, qualitative research study carried out in the United Kingdom, Greece, and Cyprus. The main goal of the study was to investigate single-parent children's experiences and understandings of poverty and social exclusion in their everyday lives and to make relevant policy recommendations. This essay examines the competing readings of food refusal that emerged from a student hunger strike held at Columbia University in fall 2007. The invisibility of the act of food refusal forces hunger strikers to adopt performance strategies that make their (non)action visible as protest. To make the politics of their food refusal legible, advocates for the hunger strike promoted their actions as part of a 40 year tradition of student protest. However, that same invisibility allowed the protest's detractors to deride the hunger strikers as anorexic. At the center of the protest and the commentary about it was a wasting female body that confused for spectators the line between the political and the pathological. Attention to this body raises questions of how community is created and disciplined through performative acts, how easily female protest is evacuated of political meaning and the uneasy role of whiteness in popular attention to anorexia. 相似文献
