COMMUNITY ACCOUNTABILITY,MINORITY THREAT,AND POLICE BRUTALITY: AN EXAMINATION OF CIVIL RIGHTS CRIMINAL COMPLAINTS*

A growing body of evidence shows that minorities are disproportionately the targets of police brutality, but important theoretical questions about the causes of that inequity remain unanswered. One promising line of research involves structural‐level analyses of the incidence of police brutality complaints; however, existing studies do not incorporate variables from alternative theoretical explanations. Drawing on the community accountability hypothesis and the threat hypothesis, we tested the predictions of two prominent structural‐level explanations of police brutality in a study of civil rights criminal complaints. The study included cities of 150,000+ population (n = 114). The findings reveal that two community accountability variables—ratio percent Hispanic citizens to percent Hispanic police officers and the presence of citizen review—were related positively to police brutality complaints, partially supporting that perspective. Two threat hypothesis measures of threatening people—percent black and percent Hispanic (in the Southwest)—were related positively to complaints, as predicted. The relative degree of support for the two hypotheses is assessed.

论我国农村基层民主法制建设

建设社会主义新农村,民主法制建设不可少,从民主法制的理论基础出发,总结农村基层民主法制建设的现状与成就,分析农村基层民主建设中存在的主要问题,初步提出加强农村民主法制建设的对策。     

面对国家的个人与面对个人的国家——全球化背景下国际法发展的元动力问题

传统上,国家间的互动关系被认为是国际法规则创制与实施的基本动力,但全球化,尤其是经济全球化使得国际法日益攸关个人的利益,个人与国家间的互动关系已然成为国际法发展的元动力。国际法只有以此为基点,才能更好地规范全球化,尤其是经济全球化的进程,使各国及其国民能够公平地享受全球化带来的好处。     

Rural land ownership reform in China’s property law

With regard to rural land ownership, there exist many problems, such as absence of the subject of right, ambiguity of the definition of right quality, and imperfection of the taking system. To perfect the rural land ownership system in China, we should continuously take villagers’ groups and villages as the subject of collective ownership and affirm the right of the members of collective organizations. In order to promote the development of the rural economy and realize the value of land, the contractual management right should be deemed as a property right and allowed to be transferred. The transferability of collective land ownership should be gradually established and the process of taking should be further normalized. Meanwhile, the farmers must receive sufficient compensation. The house site usage right is a special form of right of usufruct. To follow the principle that property should be made best use of, the house site usage right should also be transferable.

东盟自由贸易区建设使东盟合作机制具有了越来越多的正式色彩.这种变化并不是事先刻意而为的,而是为解决协议不执行问题、通过讨价还价逐渐演化而成的.东盟国家之所以没有一味地固守其传统的合作特性,而是有所变化,主要是因为作为一种经济合作安排,东盟自由贸易区不仅关系到东盟国家的经济增长和政治安全,也关系到东盟作为整体在国际上的信誉.

Remortgaging Women's Lives: The World Bank'sLand Agenda in Africa

In recent months, the World Bank has issued a series of draft policy reports on land relations. This is the first time in over two decades that the Bank has sought to review its policy on lending in the land sector. Access to the draft reports and participation in the consultation process has, however, been severely limited. Nonetheless, the World Bank expects to issue the final Report by the end of this year. This paper presents a gender analysis of the two draft documents that have been made available to date. It assesses their implications for gender relations in Africa. It explores the World Bank's promotion of formal rural credit and challenges the assumption of the availability of women's unpaid agricultural labour. The paper argues that, far from being over, the struggle over land relations which has characterised the last decade in Africa, must continue. 试论政治合法性与中国共产党组织基础的扩展

现代化的进程,就是对社会力量不断进行整合的过程。从历史—现实的维度与合法性的视角看,中国共产党组织基础是一个不断扩展的过程,也是中国共产党政治合法性基础不断增强的过程。尤其是当今市场经济的发展,中国原有的力量分布格局发生了变化,社会阶层进一步分化,这对中国共产党的组织发展提出了新的要求。以江泽民为代表的中国共产党人,审时度势,大胆进行理论创新,提出新的政治思路,基本解决了这个新问题,因而扩大了中国共产党的组织基础,增强了中国共产党执政合法性基础。
