论物权法调整空域使用权的合理性

我国《物权法》没有明确规定空域所有权,但是应当解释为承认了空域所有权的存在。现行法律没有认可空域使用权的物权属性,只能认为空域使用权是行政许可利益。但行政许可机制的运行与效率价值旨趣相悖,其产生的产权不确定性不利于空域高效利用。市场机制和私权制度的引入是改革的重要方向。国家所有权具有私权属性,空域所有权也不例外,而空域使用权是空域所有权基于权能分离产生的权利,只能具有私权属性。这种定性在价值上也具有合理性,这主要是基于市场机制对空域利用效率的保障作用以及私权属性对市场机制顺畅运作的支撑地位。在私权体系中,将空域使用权规定为物权最为妥当。     

Employee Satisfaction With Work‐life Balance Policies And Organizational Commitment: A Philippine Study

This study investigates the relationship between public employees' satisfaction with work‐life balance policies (WLBPs) and organizational commitment in the relatively unexplored Philippine context. Our findings show that (i) employees' overall satisfaction with WLBPs is positively related to organizational commitment, (ii) when specific WLBPs are examined, only satisfaction with health and wellness programs are positively associated with organizational commitment, and (iii) when accounting for employees' preferences for WLBPs, compensatory time‐off, childcare policy, health insurance benefits, and paid sick leave are positively related to organizational commitment. The findings indicate that understanding which WLBPs employees prefer is important before implementing WLBPs. The article discusses the theoretical and practical implications of this study in the developing country context. Copyright © 2017 John Wiley & Sons, Ltd.     

How Do Developers Respond to Land Use Regulations? An Analysis of New Housing in Los Angeles

There is strong evidence that land use regulations constrain housing production. We know less about how real estate developers respond to specific zoning provisions. I compare the characteristics of new multifamily housing with baseline land use regulations in two sets of rail station areas in Los Angeles. I supplement this building-scale analysis with expert interviews. I find that developers were most sensitive to density restrictions and parking requirements. The average development in the Vermont/Western area had 112% of the maximum allowable residential density and 94% of the minimum required parking. Koreatown’s average development had 99% of the maximum density and 88% of the required parking. But, there was variation by area and whether a building was affordable or market rate, apartment or condominium, and by development size. Additionally, regulatory implementation can matter as much as the written regulations themselves. I recommend that cities take an evidence-based approach to reforming regulations and implementation processes.

自2016年3月5日李克强总理作政府工作报告时首次正式提出"工匠精神"以来,党和国家领导人为振兴实体经济多次提出要发扬"工匠精神"。发扬"工匠精神"对于振兴实体经济有着重大的现实意义。我国实体经济在经济社会转型期表现出的发展缓慢问题,在国际市场上表现竞争力不强问题,根本原因之一就在于我国企业缺乏更多拥有"工匠精神"的高素质职工队伍。培育、关心尤其要大幅提高拥有"工匠精神"品牌职工的待遇和地位,是打造更多享誉世界的"中国品牌"的前提和基础。以弘扬"工匠精神"为目标的职工文化是振兴我国实体经济的有力抓手。     

The Impact of the Unemployment Rate on Unemployment Benefits in Barbados: An Impulse Response Approach

The purpose of this article is to determine how the rate of unemployment will impact on unemployment benefits in Barbados using annual data from 1982 to 2009 with the use of an impulse response function. The results show that when a shock is applied to the rate of unemployment, which causes it to rise, unemployment benefits will contract marginally and this reaction will not stabilize until the 14th period when a new equilibrium will be attained. Since this new equilibrium will lie below the original equilibrium, rising unemployment will impact negatively on unemployment benefits although this decline will only be marginal.     

In pursuit of happiness: Life satisfaction drives political support

It is argued in this article that citizens in democracies use their subjective well-being (SWB) as an evaluative criterion when deciding how willing they are to support and comply with government dictates (political system support). When life is satisfactory, government authorities are rewarded with support, when it is not, citizens punish authorities by withholding their support. To make sense of the relationship, it is suggested that citizens act as if they have signed a happiness contract with ‘those in power’. In support of this argument, comparative survey data shows that SWB predicts attitudes on political system support across country contexts and under strong control conditions. Establishing that the relationship is causal, panel data documents that attitudes on political system support can be undermined following the termination of a close personal relationship, and that the causal effect is mediated via changes in SWB. Finally, as predicted, the happiness-support relationship is weaker among individuals who are high on spirituality/religiousness and attribute blame for external events to both worldly and non-worldly powers.     

预告登记权利人“排除异议”的判定——以《异议复议规定》第30条为中心

《异议复议规定》第30条作为预告登记权利人提出案外人异议的审查依据,因其中"排除异议"及"符合物权登记条件"在解释上易生歧义,致实务适用意见不一。依执行理论,除所有权外,何种权利始可排除强制执行,应依实体法之性质、效力及执行目的或方法确定。经预告登记之权利并非实体权利,其性质应为兼具物权性、债权性及从属性的请求权。目前,我国预告登记在强制执行中的效力,立法未臻明确,但结合我国预告登记实体法之"再处分禁止效力"及"不动产登记簿冻结效力",藉由目的解释,应将《物权法》第20条第1款之"处分"进行扩张,使其效力覆盖强制拍卖、变卖等"处分"性执行措施。而案外人据以《异议复议规定》第30条提出异议的,法院不应适用于商品房预售合同备案登记、网签及受让物权预告登记以外的其他预告登记之情形,其"符合物权登记条件"之确认,应参照预告登记转本登记之理论,采实务通说之标准,具化为满足合法有效的商品房买卖合同,已办理预告登记及支付全部价款或依约定支付价款之要件。
