一种双重面向的权利——论福利权的法律性质

尽管,福利权为美国学者所采取的主要用语,但在其他不采用该用语的国家,福利权的类似争论也在进行.其中,主要涉及到福利权是消极权利还是积极权利、福利权是道德权利抑或法律权利以及其是否需要宪法规定.而事实上,福利权可能更是一种带有混合性质的权利,在不同的面向上需要不同的保障方式.     

法律如何在"社会情境"下存在——读昂格尔的《批判法学运动》

在对自由主义法学传统中的形式主义和客观主义批判的基础上,昂格尔提出"偏差原则"与重塑民主和市场制度形式的主张.这其中,以对法律与社会的适当关系的认知为理论支撑点,以权利体系的重新规定为主要内容之一.认为制度设计和"社会情境"的相互彰显是昂格尔思想中的核心之一,故以其为切入点,围绕法律如何在"社会情境"下存在这一问题,分析昂格尔意义下的"社会情境"的理论内涵和这一场景下昂格尔对法律中权利体系的方案设计,并对其理论构想的成立与否做出评价.     

论"非羁押式强制措施"的刑期折抵——以权利保障为视角

我国的刑事法律仅规定"羁押"的日期应当在被告人被判处的自由刑中予以折抵,而将取保候审、监视居住这样的"非羁押式强制措施"限制人身自由的日期排除于折抵刑期之外.从刑事司法公正、被追诉人的权利保障及权利与义务的对等性三方面论述"非羁押式强制措施"应予折抵刑期的合理性和正当性,并提出具体的立法建议.     

On our terms! How domestic elites localised the International Commission Against Impunity in Guatemala

Abstract

In summer 2004, an UN-sponsored international rule of law commission based on an initiative of the Guatemalan human rights community was rejected by Guatemalan political elites. In 2007, a new version, the International Commission against Impunity (CICIG), was approved by the Guatemalan Congress and has since been active in the country, supporting the modernisation of the Guatemalan judicial system and the investigation and prosecution of criminal networks. The CICIG has been hailed as part of a new generation of rule of law promotion that addresses the problems of post-conflict states. How did this change in elite support come about? Neither increased pressure from the international community nor changes in the elite groups in power can fully explain this shift. Rather, Guatemalan elites actively reshaped the commission; in addition, the human rights community reframed it to better fit the risk perceptions of the general public.     

Telling the stories of others: claims of authenticity in human rights reporting and comics journalism

ABSTRACT

There are various intermediaries bearing witness to distant conflicts and atrocities. They travel to distant parts of the world to collect different kinds of evidence and stories, motivated by the assumption that knowledge can evoke change. This article asks how authenticity is claimed in this context of humanitarian witnessing. It focuses on two, at first sight quite different, practices of representation: NGO human rights reporting and comics journalism, also known as graphic reporting. It argues that representations of first-hand access to sites and people involved in abuses, or of ‘having been there’, figure centrally in establishing authenticity and thereby truth. The article discusses two techniques through which first-hand truth claims are performed: representations of field research methodologies, and personifications of truth in the figure of the witness. The intermediaries chosen for an in-depth study are the human rights NGO Human Rights Watch and the US comics journalist Joe Sacco.     

试论我国体育冠名权及其法律规制

2008年北京奥运成功举办,国内体育热潮空前高涨;赛后“鸟巢”推出PPP融资模式（Private-Public Partnership）转让冠名权,学界再度关注体育冠名权之法律规制。在体育法学中,冠名权、体育冠名权是一个层级清晰的属种概念链条。而从整个法律体系或权利体系的维度来看,体育冠名权仍是一个较新型的权利。在实践中,权利定性的模糊亦成为体育产业开发和应用的瓶颈,并导致近年来我国体育市场大量冠名纠纷因缺乏充分的法律依据而无法得到有效调整。     

沉默权：一个无法沉默的话题——从我国刑诉法“应当如实回答”谈起

我国刑诉法规定了犯罪嫌疑人面对审讯人员的审讯：“应当如实回答”的义务,使其在刑事诉讼中处于不利的地位。是否赋予犯罪嫌疑人沉默权,由“口供本位”转向“物证本位”,彻底改变目前的侦查模式,是我国刑事诉讼法修改的一个不容忽视的重要问题。     

探索征地制度改革 确保农民合法权益

征地工作事关国家经济建设和农民切身利益。随着工业化和城市化进程的加快,大量土地被征用。目前土地还是农民生存保障之本,征地过程中如何确保农民合法权益已成为迫在眉睫的问题题。该文通过分析中国征地制度存住的问题,从保护失地农民权益的角度,提出了要严格规范土地征用、完善补偿机制及规范土地交易市场等建议。     

(Re)centering street harassment – an appraisal of safe cities global initiative in Delhi,India

Abstract

In 2012, New Delhi (India) was catapulted into the global limelight for the brutal gang rape of a 23-year old woman travelling in a bus. This wasn’t the first time that sexual violence had been perpetrated on the streets of Delhi and nor would it be the last. Yet this universal fact of everyday violence in public spaces particularly streets, though acknowledged by activists and feminists, has been examined minimally in academic scholarship. Further, even though the United Nations has been instrumental in foregrounding gender-based violence as a critical human rights issue, it has only recently turned its attention to street harassment through its ‘Safe Cities Global Initiative’. Therefore, in this paper, we trace how a routine but understudied form of violence becomes central to United Nations’ agenda to eliminate violence against women. By specifically, analysing the Delhi Safe Cities programme as a case study, our second contribution lies in examining the adequacy of the contemporary Safe Cities framework as a model for addressing sexual violence in public space. We conclude the paper by offering critical conceptual and methodological recommendations to further strengthen the framework.     

‘Living Rights’, rights claims,performative citizenship and young people – the right to vote in the Scottish independence referendum

This paper examines the rights claims-making that young people engaged in during the 2014 Scottish independence referendum when the right to vote was extended to 16- and 17-year-olds for the first time in the UK. Understanding citizenship and rights claims-making as performative, we draw on the novel idea of ‘living rights’ to explore how young people ‘shape what these rights are – and become – in the social world’. They are co-existent and situated within the everyday lives of young people, and transcend the traditional idea that rights are merely those that are enshrined in domestic and/or international law. We explore the complex and contested nature of rights claims that were made by young people as ‘active citizens’ in the lead up to the referendum to illustrate how the rights claims-making by young people is bound up with the performativity of citizenship that entails identity construction, political subjectivity (that challenges adult-centric approaches) and social justice.
