The role of respect in interactions with police among substance-using African refugee young people in Melbourne,Australia

Racialized policing and substance use are major issues faced by African young people in Australia. In-depth interviews with 18 refugee young people who use alcohol and/or drugs examined interactions with police. Status respect and human respect played important roles in interactions with police. Participants felt unfairly targeted by police and reported that they were disrespected by police through the use of discriminatory language, failing to differentiate between individuals leading to a sense of loss of self-identity, and stereotyping. Development and implementation of programs focusing on building mutual understanding and respect is needed to improve relations between refugee-background youth and police.     

CURRENT TRENDS IN THE DEVELOPMENT OF THE CHINESE SOCIAL SECURITY SYSTEM FOR PEOPLE WITH DISABILITIES

The Law on the Protection of Disabled Persons is the first social security legislation in China, with more than 50 laws directly related to the legal protection of the rights of persons with disabilities and career development for people with disabilities. In terms of employment protections for people with disabilities, it is important to focus on effective legal implementation, utilizing legal rulings to limit employment discrimination against people with disabilities. Educational protections are an important precondition for enabling people with disabilities to live with dignity; it should be guaranteed that people with disabilities are provided “reasonable accommodation” in educational conditions. A barrier-free environment is a necessary condition for social integration of people with disabilities. At the same time, it also benefits other members of the society such as the elderly. Through rehabilitation and exercise, most people with disabilities can return to the society to a significant degree. China should gradually expand the legislative scope of rehabilitation service fee reductions and legal categories of auxiliary appliances, issuing guiding documents that provide specifications for the relevant “dormant” legal provisions.     

罪刑法定与刑法机能之关系

社会保护机能与人权保障机能的统一是刑法的整体价值目标,而不是刑法某一个构成要素的价值目标。认为相对罪刑法定原则具有人权保障和社会保护双重机能的观点,实际上是混淆了刑法的机能与罪刑法定原则的机能,错把刑法的整体机能当成了其构成要素的机能。罪刑法定原则虽然应当服务于刑法的整体价值目标,但是,它却不应该、也不可能直接承载社会保护的价值内容。我国《刑法》第3条从正反两个方面规定罪刑法定原则,将社会保护的内容附加给罪刑法定原则,在一定程度上消解了这一原则的社会法律意义,不利于现代刑法观念的培植。     

论民事再审之诉的客体

民事再审制度改革是当前民事诉讼制度改革的一个重点。建立民事再审之诉,作为民事再审制度改革的基本内容,得到了理论界和实务界的广泛认同。但是,对于如何构建民事再审之诉,尚有诸多问题值得研究和探讨,哪些生效裁判可以提起再审之诉就是其中一个非常重要的问题。     

论我国警察征用

2004年宪法修正案的征收、征用补偿条款,规定了对公民的私有财产实行征收或者征用要给予补偿,这将对保护公民的财产权产生重要影响。虽然现行法律中没有明确的警察征收、征用制度,但我国警察征用一直是个客观存在的社会实践,因此,在完善宪法对私有财产权保护的法律体系时,研究警察行政法中的警察征用法律制度有着独立的重要意义。

试论工会在以人为本师德建设中的作用

师德具有民族历史性,总是与不同国家、不同历史阶段的教育发展水平相适应。"以人为本"是现代社会对教育所提出的一种新的要求。以人为本的师德建设,就是本着"以人为本"的宗旨,尊重教师自身的价值,充分调动教师的能动性,最大限度地发挥教师的潜能,把教师的工具价值减少到最低的限度,让教师有自主发展的余地。工会组织作为党联系教职工群众的桥梁与纽带,应为教师的发展服务,把师德建设落到实处;通过各种途径,提高教师的主体意识,使教师感到被尊重、被重视、被信任,使师德建设真正发挥实效。     

海权争霸与俄苏的兴衰及其历史反思

从海权的角度分析俄苏的兴衰是一个尚未有人进行充分探讨的问题。在数百年的争夺中 ,海权的扩张固然构成了俄苏崛起的一个因素 ,但从长远的角度看 ,对海权的过度追求又构成了俄苏走向衰落的根源之一。具体说来 ,从俄苏海权扩张西进、南下和东进 3条线路中 ,西进战略较为成功 ,并促进了俄苏的崛起 ;南下和东进战略虽有所收获 ,但都遭遇挫折 ,尤其是南下的世界扩张战略直接导致了苏联的衰落。从本质上来说 ,地缘政治条件的制约、俄苏海权过渡扩张所导致的一系列矛盾构成了俄苏海权战略失败并导致国力衰微的根源之一。
