The U.S. President's Commission on Law Enforcement and Administration of Justice added a Task Force on Science and Technology as somewhat of an afterthought because there had then been very little interaction between science and technology and the criminal justice system (CJS). The task force focused on the CJS as a whole and interactions among its parts, with an important emphasis on analysis of the operating systems and on the important potential role of information systems as the technology advanced. The potential applications of contemporary information and electronic technologies is considerable, especially for assessing risk and needs of identified offenders and for providing relevant information wherever needed. There is urgent need for scientific evaluation of many of the positive and negative aspects of the operation of the CJS and of the potential for new technologies. 相似文献

“Fraud Loan” is a new criminal phenomenon that started to appear recently. Its basic form is fraud, but more than ten types of crimes such as provocation, forced trading, extortion, robbery or kidnapping may be committed just because of the diversity of ways of obtaining property. To identify the number of crimes convicted by “Fraud Loan”, three principles should be adhered to. Firstly, all acts of the perpetrators should be evaluated comprehensively so as to maximize the protection of legal interests. Secondly, it is necessary to prohibit repeated evaluation to protect the human rights of the accused. Thirdly, we should make an overall evaluation to conform to the cognitive regulation. When the act of purpose and means of the perpetrators violate different crimes respectively, the heavier one should be chosen. Those who directly “claim debt” through violence, coercion, kidnapping, etc., are escalated into serious crimes such as robbery and kidnapping. If perpetrators violate other legal interests of the victim in addition to the crime of property, they will also be punished for multiple crimes. 相似文献

Malik Bendjelloul’s music documentary, Searching for Sugar Man (2012), uses the narrative of its central figure, American rock “n” roll musician Sixto Rodriguez, to allegorize South Africa’s emergence from censorship and isolationism to a post-apartheid and increasingly transnational dispensation. I look at the cultural politics of apartheid-era censorship in attempt to account for Rodriguez’s cult appeal in South Africa, despite his artistic shortcomings and his obscurity in the USA. I then focus on the film’s final concert sequence, featuring Rodriguez’s first South African performance, which Bendjelloul subtly positions as a moment of celebration over the new possibilities enabled by the demise of apartheid and the rise of an increasingly integrated global culture. 相似文献

对于死亡赔偿中消极损害的内容,我国学界一般认为有扶养丧失说与继承丧失说两种不同的模式,并且这两种模式相互排斥,不能并存。这一看似合理、并有各国立法例支持的认识实际上存在很大问题。事实上,兼采扶养丧失说与继承丧失说并没有不可逾越的理论障碍。立法例上所谓的大多国家/地区均采扶养丧失说也只是学说上的一种概括,具体到各个国家/地区,均有所不同,没有必然的参考意义。相反,在我国,继承利益历来受到重视,因而将其与扶养利益分开,同时设立扶养利益与继承利益两个赔偿项目,具有重要意义。因此在我国,兼采扶养丧失说与继承丧失说更为合适。 相似文献

How do “classical” big art institutions (museums, the ballet, the opera, symphony orchestras) react to phenomena of globalization such as migration flows, the “denationalization” of artistic movements, the enormous growth of the number of artists, the trend of a global cultural branding of cities, etc.? And which cultural policies do governments develop to interfere in the relationship between those art institutions and their changing environments? Those were the central questions I asked while doing research about the position of art institutions in society today. The research concentrated on a very diverse sample of big art institutions in Europe. The research begins with the insights of Actor Network Theory and the political philosophy of Antonio Negri and Michael Hardt and leads to an ideal typical two-dimensional model to classify the possible strategies that such institutions and their responsible governments can use on the local, national and international level. 相似文献
