神判起源考略

神判是一种古老的、世界性的法人类学现象,神判的诸种形式反映了神判和早期法律的一些特点。神判中的血迹判、铁火判、宣誓判起源于原始巫术形式,而神判中的捞沸判则可能起源于早期人类生活实践。此外,通过对捞沸判的分析还可以看到《秦律》中"三环"之说实为公拒绝私之义,由此把"三环"理解为国家司法机关对自诉案件的三种拒绝受理的理由,应当是一种较合理的解释。     

论刑事领域中的严格责任

刑法中的严格责任是指在处理某些特殊的侵害行为时 ,忽略罪过的形式和有无 ,而以行为的社会危害性为唯一的着眼点对行为人追究刑事责任的刑法制度。严格责任在我国刑事法律领域 ,既有现实需要 ,又是客观存在的 ,在刑法总则上仿照《民法通则》的做法 ,加入“没有罪过或罪过形式不明确 ,但法律规定要承担刑事责任的 ,应当承担刑事责任”的总摄规定 ,在刑法分则或单行刑事法规中将适用严格责任的范围加以明确 ,使我国刑事领域有关严格责任的理论和立法自成体系。     

Economic Reform and Social Change in China: Past, Present, and Future of the Economic State

China's socioeconomic crisis before 1978 and its success over the past two decades can be viewed as a zigzag process of politicization and depoliticization of the economic state. By summarizing the Chinese experience, this article shows the importance of a specific pattern of general public policy (GPP) in determining the nature of a policy system. China's economic and serialized reforms since 1978 are reviewed in order to illuminate the current situation and future direction of the nation. The changes have undermined the economic state by creating a trend of de-economicization in the Chinese government. If economic reform and social change are to continue smoothly, another transfer of state emphasis to more balanced development is required.     

Social Support: A Mediator between Child Maltreatment and Developmental Outcomes

The purpose of the current study was to investigate the relationship between child maltreatment, social support, and developmental outcomes in first-year college students. Participants were 202 undergraduate students (137 female, 65 male) who completed surveys at two time points: once before entering college and once during their first year of college. It was hypothesized that child maltreatment would predict poorer developmental outcomes in adolescence and early adulthood, but that social support would mediate this relationship. Results indicated that child maltreatment related negatively to developmental outcomes and to perceived social support; adolescent and young adult development related positively to perceived social support. In addition, a mediational model in which social support mediates child maltreatment and developmental outcomes was supported.

From the Cycle of Deprivation to Social Exclusion: Five Continues

One important aspect of Tony Blair's speech on social exclusion, given to the Joseph Rowntree Foundation in York on 5 September 2006, has been ignored-that its content was prefigured by Sir Keith Joseph, in his famous 'cycle of deprivation' speech, on 29 June 1972. This article seeks to explore these continuities over the past thirty-four years, tracing similarities and differences between the two speeches. Moreover, it also reflects on the earlier Joseph speech and subsequent Research Programme, to see where government policies on social exclusion might lead. The article argues that while earlier writers have acknowledged the intellectual debt that New Labour owes to Joseph, and noted similarities between current policy approaches to child poverty and earlier debates about transmitted deprivation, recent moves on social exclusion mean that these continuities are now more striking than ever before.
