日本福岛核危机再次表明,核污染一旦发生就危害巨大,因此,核安全保障体系必须奠基于“防患于未然”理念之上。由此观之,我国《刑法》在核污染的应对上尚存诸多缺陷：从形式角度来看,未能与《放射性污染防治法》有效衔接;从实质角度来看,未能突破末端应对中心主义的思维惯性;此外,对于证明行为人主观意图方面的困难也未能有效解决。作为因应,设立核污染源头控制环节的抽象危险犯和过失犯实属必要。

Political Sociology of International Interventions: Peacebuilders and the Ground

ABSTRACT

This special issue, instead of questioning what effect peacebuilding interventions have on post-conflict societies, analyses what the ground of intervention does to peacebuilders. It demonstrates that everyday interactions on the ground shape the interveners and even the scope of their missions. We delineate how a political sociology approach might break away from binaries (‘internationals/locals’) and, instead, illuminate processes (of internationalization and localization). We intend to offer a political sociology of the ‘intervention encounter’, that is, to scrutinize the everyday interactions among peacebuilders and between peacebuilders and domestic actors, and to investigate effects of the ground on peacebuilding organizations, doctrines and decision-making processes, as well as on peacebuilders’ trajectories, positions, professional practices and representations. In fine, we explore how peacebuilders’ relations to the ground structure the socio-professional field of peacebuilding.     

The Unity of Knowing and Doing: The Course of Social Work Action Research

By reviewing the history of social work, it shows a clear picture that both clinical social work and community work are "made out of" doing. This article, based on this essential attribute of social work, proposes that the cycle of action research as the course of combining theory and practice of social work by three reasons. First of all, the ethos of community practice is not only the starting point of social work practice and the action research, but also the drive for continue doing professional practice and action research. Secondly, sociological imagination is the ability produced in practice through rationality, including activities to change the reality. Thirdly, the unity knowledge of knowing and doing is not a single cycle from sense to sensibility, but an endless cycle of both. After more than 10 years of practicing in rural development and anti-poverty social work practices, the author argues that the concept of sociological imagination proposed by C. Wright Mills is not only a critical perspective about how personal life in relation to the society we live in, but also a possible solution for our daily life.     

论从源头上治理监狱民警职务犯罪

职务犯罪的本质是权力的滥用或不正确使用,其源头是异化的公权力运行。监狱民警职务犯罪是监狱中行政管理权、执法权行使过程中的异化。根据公权力运行规律,只有在"治理"理念的指导下,采取一系列措施,建立开放、科学的决策机制,消除异化权力的非正当性目的,引进多主体参与行权,打破异化权力得以实现的自满足结构,建立监狱工作与多方社会组织的流畅交流,打破监狱系统封闭的行权环境,才能从源头上治理监狱民警职务犯罪。     

巨额财产来源不明罪的地位与作用的反思——一种刑事政策学意义上的观察

在我国反腐制度体系中,巨额财产来源不明罪是由刑法规定的、相对于其他反腐罪名处于附属、补漏性地位的一项制度安排。其具体政策作用在于防止放纵一定犯罪（主要是国家工作人员贪腐行为）,解决一些关联犯罪可能的证明难题,防止案件拖延。作用有限已难以满足目前反腐斗争需求,在实务中还产生不少负面影响。财产申报制度的创设能够使该罪获得相对独立地位,充分释放其反腐能力,并消除其负面影响。在我国财产申报制度注定出台的情况下,应考虑重构巨额财产来源不明罪或其替代性罪名（包括其地位和作用）。     

权力再诠释：基于西方社会学理论范式的嵌入研究

权力是社会科学领域颇受争议的重要论题,从社会学理论视角分析权力对梳整这一论题具有一定的理论及现实意义。基于此,笔者从社会学理论范式出发,通过嵌入性分析四大范式中的权力,发现社会学领域内权力研究遵循三大基本发展逻辑,而潜在且难以意识到的权力运作是研究的核心,福柯的规训权力只是权力研究拓展后的新起点。     

英国外警培训工作的特点及启示

英国外警培训工作在培训模式、课程设置、培训管理、师资来源、质量保障体系建设等方面特色鲜明,是影响国际警察培训发展的一支重要力量。结合我国外警培训工作发展现状,应该在培训理念、授课方式、课程内容、师资队伍、后勤服务等方面加大改革力度,以实现我国外警培训工作由规模数量型向规模质量型转变。

在当代西方法学界,自然法学派、分析法学派和社会法学派呈现出三足鼎立的态势.三大法学派彼此之间存在着激烈的学术争论,但同时也存在着相互渗透、相互融合的趋势.在此基础上,法学一体化运动应运而生.这场运动的主旨是努力促进三大法学派之间的理论融合,从而建立一个统一法学.法学一体化运动取得了一定的学术成果,但也面临着严峻的挑战.

The study examines Pat Robertson's use of The 700 Club television program to establish and sustain celebrity status and in turn to promote partisan politics through seemingly objective news accounts. The findings indicate that The 700 Club news segments consistently rely on narrative techniques that mask Robertson's intensely partisan content and provide what Kenneth Burke terms symbolic medicine for his particular audience.
