超期羁押问题的再思考

羁押是拘留、逮捕强制措施的载体,对侦查破案起着重要作用。超期羁押是侵害犯罪嫌疑人的正当权益的行为,同时也使公安机关面临着巨大压力与困扰。解决超期羁押问题,不能只停留在从法律层面上去指责公安机关的阶段;不能单方面地呼吁对犯罪嫌疑人的司法救济,而不考虑我国现阶段犯罪特点和公安工作的实际困难。解决超期羁押的顽症必须进行全方位的思考。
