对确立单位累犯的若干问题的思考

我国目前并无单位累犯的立法,需要确立单位累犯制度,为此,必须着重对单位累犯的刑罚条件、时间条件和单位变更后的累犯认定问题进行探讨。     

死后不同时间的组织细胞DNA含量分析

本文应用流式细胞仪对大鼠死亡后不同时间的心、肝、肾组织细胞DNA含量进行了分析。结果显示:与死后0点细胞DNA含量值相比,6小时细胞DNA含量下降到99.5％,12小时为91.3％,18小时为87.1％,24小时为81.3％,30小时为76.7％,36小时为74.3％,48小时为72.3％。上述规律性变化,将可能对早期死亡时间的推断提供客观可靠的依据。

网络虚拟财产又称网财 ,是指游戏中的帐号、货号、装备、级别、段位、宠物等网上物资的总称。网络虚拟财产属于无形财产 ,是具有价值和使用价值的商品。伴随网财交易市场的日渐形成 ,网络虚拟财产犯罪的打击和监管已成为必要。网络虚拟财产犯罪主体的高发群体是青年 ,客观方面表现为隐蔽性和智能性 ,客体方面表现为多样性。处理网络虚拟财产犯罪的基本原则是拓展现行刑法关于妨害社会管理秩序罪及财产犯罪的适用范围 ,在刑法不能涵盖的地方作出补充和修改。     

劳动争议诉讼三题

受我国传统诉讼文化的影响,我国劳动争议适用法律及法律程序设计等方面,都没有能够充分体现出程序正义和程序效益,法律对弱者所给予的救助和支持存在不同程度的弱化。建立社会主义市场经济体制和加入WTO,呼唤尽快完善我国的劳动法制,劳动争议诉讼制度必须从诉讼时效、诉讼证据和诉讼程序方面进行探讨和改革,以更好地维护劳动者的合法权益。     

中日两国新警任职教育比较研究

在比较中日两国新警任职教育的定位、目标和内容等的基础上,提出了新警的任职教育过程应是一个"从不会到会"的过程;在教学内容基本相同的条件下,新警任职教育改革创新的着力点必然集中向教官、教法、教材(专用)和教具(设备设施)等方面;建议参考日本"新警返校复训制度";建议借鉴日本新警任职教育中每天"仪式"的做法,把现在的升国旗仪式与入警宣誓仪式合二为一,变成每天必行的一个"固定式"等个人观点。

Naqshbandi Sufis and their conception of place,time and fear on the Turkish-Syrian border and borderland

The employment of diverse forms of security and control on territorial borders have led to the production of numerous events of border crossings, smuggling, banditry and death along with stories of separation, loss, mourning, pain, and yearning in the everyday life of border people. The Naqshbandi Khaznavi order has an expansive interpersonal social network across the political borders of Turkish and Syrian nation-states. This work analyzes the ways in which Sufis dealt with diverse aspects of the Turkish-Syrian border by unbinding shackles and orders of political system that were fabricated constantly from the 1920s to the early 1980s. The life stories and narratives of the Sufis document the existence of a religious-cultural landscape, diversifying the perception of place, time and fear which have transcended political borders for decades, contradicting official cartographic imagination and the modern-secular understanding of place and time. Besides, in addition to analyses of religious orders as social, economic and political entities, this work aims to elucidate emotional aspects of relations and faith that coexist between Sufis and their Sheikh in the context of spatial distance, political border and fear of death.     

Power Politics or Public Pandering? An Empirical Investigation of Economic Sanctions and Presidential Approval

How do economic sanctions affect presidential approval? Competing claims have been made about the domestic political consequences of economic sanctions. One claim is that sanctions are unpopular because they have negative economic consequences; another claim is that sanctions are popular because they project an image of strength; and another claim is that sanctions are neither popular nor unpopular because the public is uninformed about international affairs. These arguments imply competing identification restrictions. I test these competing models using a Bayesian Structural Vector Autoregression (B-SVAR) model. The results show that sanctions have a moderate negative effect on presidential approval. I use these findings as a basis for a broader set of auxiliary analyses. Despite received wisdom, sanctions imposed for different reasons against different target states do not produce disparate effects on public opinion. These analyses resolve an important empirical dilemma that weighs on a range of theoretical perspectives in the sanctions literature and highlights fruitful avenues for future research.     

Differentiation: old controversies,new insights

There is a long-standing debate about the nature, impact and significance of processes of differentiation in driving agricultural development. This contribution discusses three ways in which such processes have been conceptualized: modernization theories that put markets centre stage, Marxist theories that focus on class, and Chayanovian approaches that highlight the dynamics within farming families. The empirical evidence for testing these concepts is normally derived from agricultural censuses. This paper uses a different database that covers all Dutch farms between 1980 and 2006 and enables us to follow the changes on individual farms. Examination of this data reveals that the actual processes of differentiation that have occurred in this 25-year period differ greatly from the classic conceptualizations. It also challenges the conventional wisdom that agricultural development is mostly driven by larger farms.
