论丢失枪支不报罪之限制处罚范围要素

丢失枪支不报罪的危害行为是过失导致枪支丢失,而不是丢失枪支后不及时报告;不及时报告与严重后果之间并不具有刑法上的因果关系,它既不是危害行为也不是危害结果,而只是一种限制处罚范围之要素;判断是否“及时报告”应着眼于客观上是否在危害后果发生之前的合理时间内报告,而与行为人何时明知或应知枪支丢失没有关系。     

空间形式:现代小说的叙事结构

长期以来,叙事学理论对时间问题关注较多,对空间问题着力甚少。在关于现代小说叙事结构“空间形式”的探讨中,其“空间”非指日常生活经验中具体的物件或场所,而是一种抽象空间、知觉空间、“虚幻空间”。只有在完全弄清楚了小说的时间线索,并对整部小说的结构有了整体的把握之后,这种“空间”才能在读者的意识中呈现出来。构成现代小说空间形式的要件是时间,或者说时间系列。小说的空间形式必须建立在时间逻辑的基础上,才能建立起叙事的秩序;只有“时间性”与“空间性”的创造性结合,才是创作伟大小说的条件,也是未来小说发展的趋势所在。     

对“韬光养晦”的哲学审视

摘要：本文简析了“韬光养晦”外交战略的历史与现实,并结合《孙子兵法》的相关论述,指出中国必须全面审视、理解和坚持“韬光养晦”策略,并要正确认识到“韬光养晦”相较于一种手段更是一种价值。该文认为,破除激进主义的简单思维,破除盛世的迷梦,冷静地正视,有效地反击,运用东方文明的智慧,从而最大限度地突破围堵,为国家的和平发展营造最佳的战略环境,才是当前中国外交战略的根本所在。     

社会治安防控体系的基本内涵与运行模式

良好的社会治安是维护社会秩序稳定的保障。为了严密防控违法犯罪活动,有效应对并解决各种社会治安问题,必须充分整合各种社会防控力量,构建一套以违法犯罪为对象的防控体系。为确保这一体系的有效运行,其运行模式必须由多元主体来开展社会治安防控,做到长远目标与现实目标的有机结合,并采用各种行之有效的防控措施。     

犯罪均值频率——一种犯罪时间分布的测度指标

犯罪在时间分布方面有其特定规律,常规的犯罪总数或平均数等统计量存在不稳定性、偏差性和数据保密性等问题,不利于犯罪时间分布特征的客观对比分析。犯罪均值频率指标克服了传统时间分布统计量存在的问题,可以用来分析犯罪是否偏好发生于特定的时间内,满足了犯罪时间分布规律分析需求。运用该指标对某市5年内的入室盗窃犯罪在星期日别、月份上的时间分布规律进行了实证研究,结果表明,入室盗窃在该市3月份和9-12月份表现为高发期,而在周末则表现为犯罪低谷期。     

Comparative Analysis of the Chemical Profiles of 3,4-Methylenedioxymethamphetamine Based on Comprehensive Two-Dimensional Gas Chromatography-Time-of-Flight Mass Spectrometry (GC × GC-TOFMS)*

Abstract: The chemical profiling of illicit drugs is an important analytical tool to support the work of investigating and law enforcement authorities. In our work, comprehensive two‐dimensional gas chromatography–time‐of‐flight mass spectrometry (GC × GC‐TOFMS) combined with nontargeted, pixel‐based data analysis was adapted for the chemical profiling of 3,4‐methylenedioxymethamphetamine (MDMA). The validity and benefit of this approach was evaluated by analyzing a well‐investigated set of MDMA samples. Samples were prepared according to a harmonized extraction protocol to ensure the comparability of the chemical signatures. The nontargeted approach comprises preprocessing followed by analysis of variances as a fast filter algorithm for selection of a variable subset followed by partial least squares discriminant analysis for reduction to promising marker compounds for discrimination of the samples according to their chemical profile. Forty‐seven potential marker compounds were determined, covering most of the target impurities known from the harmonized one‐dimensional profiling as well as other compounds not previously elucidated.     

故意伤害罪新论

由于我国刑法只规定一个伤害故意,因此,当行为人出于轻伤的故意导致他人重伤结果,应当怎样处罚,不仅在刑法理论中没有一个统一的基准,在司法实践中也是见仁见智。实施暴力行为,导致被害人重伤或死亡的,应当属于故意伤害罪的结果加重形态。在故意伤害的情况下,即便有被害者的承诺,由于作为伤害的社会意义并没有变更,因此,不能阻却构成要件的符合性。但是,基于被害者承诺的违法性的阻却,在某种情况下可以成立。阻却违法性的判断,应当根据被害者处分自己身体的安全这一法益,是否具有社会相当性而进行。针对同时伤害的情况,不应认定为共同伤害。     

Comparison of two methods for isolating DNA from human skeletal remains for STR analysis

Abstract: The quality and efficiency of a standard organic DNA isolation method and a silica‐based method using the QIAGEN Blood Maxi Kit were compared to obtain human DNA and short tandem repeats (STRs) profiles from 39 exhumed bone samples for paternity testing. DNA samples were quantified by real‐time PCR, and STR profiles were obtained using the AmpFlSTR^® Identifiler^® PCR amplification kit. Overall, the silica‐based method recovered less DNA ranging from 0 to 147.7 ng/g (average 7.57 ng/g, median = 1.3 ng/g) than did the organic method ranging from 0 to 605 ng/g (average 44.27 ng/g, median = 5.8 ng/g). Complete profiles (16/16 loci tested) were obtained from 37/39 samples (95%) using the organic method and from 9/39 samples (23%) with the silica‐based method. Compared with a standard organic DNA isolation method, our results indicate that the published silica‐based method does not improve neither the quality nor the quantity of DNA for STR profiling.     

Watch for those fragments of evidence: the use of an automatic timepiece to help correlate a helicopter crash site from the Vietnam War

This case study illustrates the use of the date function on an automatic wristwatch to help identify a Vietnam War helicopter crash site. The location of a crash incident can sometimes be uncertain because of inadequate or inaccurate wartime records and the passage of time. Artifacts recovered from a prospective crash scene are regularly used to correlate the loss incident. In this case study, a recovered automatic watch displayed a date 2 days later than the reported loss incident. Although the date conflicts with the aircraft crash incident report, it is observed that a fully wound automatic watch continues to work for c. 2 days after movement of the watch ceases. Thus, the watch's date in fact correlates with the aircraft crash incident report. It is noted that automatic watches may also be used to date scenes of crime.     

Decaying Mouse Volatiles Perceived by Calliphora vicina Rob.‐Desv.

Volatiles emitted by decaying human remains are in the focus of recent research. The identification of core volatiles in this field is of high importance, because cadaveric volatiles generally show high variation. In this study, the volatile profiles of five mice (Myodes glareolus) were sampled with charcoal filter tubes from their time of death until advanced decay. Eleven compounds were quantitated by means of gas chromatography–mass spectrometry. Electroantennographic experiments with female Calliphora vicina antennae led to the identification of dimethyl trisulfide, dimethyl disulfide, nonanal, hexan‐1‐ol, 1‐octen‐3‐ol, 3‐methylbutan‐1‐ol, and heptanal as electrophysiologically active compounds. When these were compared, dimethyl trisulfide (17 ng/μL) and dimethyl disulfide (11 ng/μL) were found to be emitted in higher concentrations. The roles of these compounds and nonanal as core volatiles for cadaver detection or postmortem time determination and their correlation to the stages of decay and the accumulated degree days are discussed.
