Over the past 15 years petitions systems have become embedded in the Scottish Parliament and the National Assembly for Wales, and more recently the House of Commons. This article uses the concept of procedural justice, with its emphasis on the fairness of the process by which decisions are made, as an analytical tool to explore four case studies of petitions systems in British legislatures, considering, in particular, the extent to which they enable voice, decision-making and transparency. It illustrates that the application of ideas of procedural justice not only provides us with a useful tool for analysing petitions systems in representative political institutions, but also potentially provides a framework of ideas from which petitions systems, and perhaps other participatory initiatives, may learn.  相似文献

Since the 1960s, there have been calls for forensic voice comparison to be empirically validated under casework conditions. Since around 2000, there have been an increasing number of researchers and practitioners who conduct forensic-voice-comparison research and casework within the likelihood-ratio framework. In recent years, this community of researchers and practitioners has made substantial progress toward validation under casework conditions becoming a standard part of practice: Procedures for conducting validation have been developed, along with graphics and metrics for representing the results, and an increasing number of papers are being published that include empirical validation of forensic-voice-comparison systems under conditions reflecting casework conditions. An outstanding question, however, is: In the context of a case, given the results of an empirical validation of a forensic-voice-comparison system, how can one decide whether the system is good enough for its output to be used in court? This paper provides a statement of consensus developed in response to this question. Contributors included individuals who had knowledge and experience of validating forensic-voice-comparison systems in research and/or casework contexts, and individuals who had actually presented validation results to courts. They also included individuals who could bring a legal perspective on these matters, and individuals with knowledge and experience of validation in forensic science more broadly. We provide recommendations on what practitioners should do when conducting evaluations and validations, and what they should present to the court. Although our focus is explicitly on forensic voice comparison, we hope that this contribution will be of interest to an audience concerned with validation in forensic science more broadly. Although not written specifically for a legal audience, we hope that this contribution will still be of interest to lawyers.  相似文献

The purpose of this study was to evaluate a commonly used voice stress analyzer, the National Institute of Truth Verification's (NITV) Computer Voice Stress Analyzer (CVSA), using a speech database containing materials recorded (i) in the laboratory, while highly controlled deceptive and shock-induced stress levels were systematically varied, and (ii) during a field procedure. Subjects were 24 each males/females (age range 18-63 years) drawn from a representative population. All held strong views on an issue and were required to make sharply derogatory statements about it. The CVSA system was then evaluated in a double-blind study using three sets of examiners: (i) two UF scientists trained/certified by NITV in CVSA operation, (ii) three experienced NITV operators provided by the manufacturer and (iii) five experimental phoneticians. The results showed that the "true positive" (or hit) rates for all examiners ranged from chance to somewhat higher levels (c. 50-65%) for all conditions and types of materials (e.g., stress vs. unstressed, truth vs. deception). However, the false-positive rate was just as high - often higher. Sensitivity statistics demonstrated that the CVSA system operated at about chance level.  相似文献

The research protocol involved the use of a speech database containing materials recorded while highly controlled deception and stress levels were systematically varied. Subjects were 24 each males/females (age range 18–63 years) drawn from a diverse population. All held strong views about some issue; they were required to make intense contradictory statements while believing that they would be heard/seen by peers. The LVA system was then evaluated by means of a double blind study using two types of examiners: a pair of scientists trained and certified by the manufacturer in the proper use of the system and two highly experienced LVA instructors provided by this same firm. The results showed that the “true positive” (or hit) rates for all examiners averaged near chance (42–56%) for all conditions, types of materials (e.g., stress vs. unstressed, truth vs. deception), and examiners (scientists vs. manufacturers). Most importantly, the false positive rate was very high, ranging from 40% to 65%. Sensitivity statistics confirmed that the LVA system operated at about chance levels in the detection of truth, deception, and the presence of high and low vocal stress states.  相似文献

This paper is concerned with faces. It is concerned with the face of a sexually abused seven years old child -- with my face -- and with the marginalisation and violation of children’s own subjective experiences of abuse by the law. Drawing upon my own subjective experience of sexual abuse as a young child, silenced for twenty-five years, I interpret my own sexual abuse as a profound experience of ‘homelessness’. To be homeless is to lack a primal place in the world, to be in a permanent state of disorientation, to be displaced. To be homeless is not necessarily to be emotionally insecure, but to be voiceless. Accordingly, the subject of sexual abuse is an emotionally dislocated subject and I interpret my own abuse in terms of an enduring experience of the violation of place. In other words, I would argue that the physical act of sexual abuse is less important than the site or place of abuse. The significance of sexual abuse is that it reveals the homelessness of our own sojourn and the poverty of our own subjectivity. Given this interpretation, I find the 1989 UN Convention on the Rights of the Child problematic and I attempt to think child sexual abuse in ethical terms. Following Emmanuel Levinas, I present sexual abuse in terms of the ethical significance of the face-to-face relationship and I argue that rights-based advocacy must listen to what children say. It must think through what listening to that voice entails in ethical terms. This revised version was published online in July 2006 with corrections to the Cover Date.  相似文献

The term youth voice has been identified as a mechanism that helps youth who are participating in out-of-school time programs (e.g., 4-H, Boys & Girls Club, Big Brother/Big Sister) achieve successful outcomes such as improved academic and social functioning. Youth voice promotion is commonly enacted in out-of-school time programs when youth workers extend opportunities to youth to provide feedback and make key program decisions. To date, scant research has focused on organizational factors that contribute to program staff (e.g., youth workers) willingness to promote youth voice. A structural equation model using person-environment fit theory within a Positive Youth Development theory framework was constructed to test organizational factors that contribute to youth voice promotion among youth workers. Data from 569 frontline youth workers within out-of-school time programs across the United States indicated that youth workers' abilities to form positive relationships with youth, professional efficacy, and ability to make decisions in their own jobs directly predicted youth workers' endorsement of youth voice. In addition, positive relationships partially mediated the effects of professional efficacy on youth voice promotion. Implications for theory and practice are discussed.  相似文献

In this article, we present the results from a youth-led project on the voices and participation of children in state care in Ontario, Canada. The purpose of this project was for youth to share their voice about what they wish child protection workers and agencies could do to improve their experiences within the child protection system. Many youth in care in Canada and internationally report that their voices are not heard and that they are not involved in decisions involving their care. Seven themes were extracted from this voices of youth project asking child welfare workers and agencies to listen to [them] and believe [them], keep [them] informed and be honest, involve [them] in decisions, support [them], keep [them] connected,; ignite [their] passions, and don't give up on [them]. Suggestions from the youth involved in this project are offered on ways to create true and meaningful change in child welfare.  相似文献
