Zum Erfordernis eines Teilurteils trotz "Außerstreitstellung" des Mietzinsrückstandes

Bei Verbindung von Mietzins- und R?umungsbegehren ist ein Teilurteil auch dann zwingend zu erlassen, wenn zwar die H?he des qualifizierten Mietzinsrückstandes im darauf gestützten R?umungsprozess nicht strittig ist, aber der Mieter behauptet, er sei nach § 1096 ABGB von der Mietzinszahlung ganz oder teilweise befreit; dies gilt auch bei Au?erstreitstellung des Rückstandes der H?he nach. Das Teilurteil geht bei der Kombination von Mietzinsund R?umungsklage dem Rückstandsbeschluss zwingend vor.

对我国经济转轨过程中产权体制改革的研究

产权制度是经济体制的“硬核”,国家经济转轨面临的根本任务在于如何尽快建起市场经济的体制“硬核”——多主体产权制度。市场经济体制的“硬核”——多主体产权制度建设的滞后带来的局部产权制度真空,造成的社会产权普遍残缺是我国产权制度的基本现状。这种产权普遍残缺对社会、经济带来了严重损害。我国应通过加快政治体制改革和健全完善法制来建立社会主义市场经济的多主体产权制度,顺利完成我国经济的转轨过程。     

Histological examination of carotid artery tissue in cases of ligature strangulation and hanging

Violence against the neck can result in a range of macromorphological and micromorphological findings. However, the forensic relevance of the carotid sinus in cases of violence against the neck remains controversial. In this follow-up study of 22 cases of suicidal and accidental strangulations, carotid bifurcations were examined histologically for morphological changes implying direct trauma, including haemorrhage and immunohistochemical expression of heat-shock proteins 27, 60, and 70 and aquaporin-3. These cases were compared with a control group (82 cases) without neck compression or head trauma and with variable causes of death. No relevant histopathological findings implying direct trauma of the carotid bifurcation were found. No cases showed positive aquaporin-3 staining and only five cases showed positive heat-shock protein-27 staining, all of which were hangings. Without massive trauma of the carotid bifurcation, histological alterations cannot be expected. Without signs of rapid death, findings of acute circulatory failure, macromorphological and micromorphological findings of neck compression, and reliable markers indicating relevant impact on the carotid bifurcation the diagnosis of a lethal reflex cannot be verified.

Key points

• Among 22 cases of strangulation causing death, there were 16 cases of hanging and 6 cases of ligature strangulation
• Few cases showed small haemorrhages located predominantly in the surrounding fat and connective tissues; however, the haemorrhages did not have any effects on the tissues
• Neck compression had minimal effects on heat shock protein 27 expression in carotid artery tissue
• Aquaporin-3 staining suggested it is not a useful marker for relevant neck pressure, or that there had not been any relevant neck impact
• Our findings suggested no direct evidence for reflex cardiac death resulting from a brief force against the neck

     

采用123D Catch建立中药材的3D模型

目的 基于真实照片建立中药材的3D模型。方法 利用123D Catch 3D合成软件,对三七 Panax notoginseng(Burkill) F. H. Chen ex C. H. Chow、竹黄Shiraia bambusicola Henn、杭白芷Angelica dahurica ‘Hangbaizhi’ Yuan et Shan、川木香Dolomiaea souliel (Franch.) C. Shih进行多视角拍摄和3D建模。结果 123D Catch可以快速地将多角度拍摄的二维药材照片转变为3D模型,4种中药材的3D模型可以清晰完整地展示其性状及鉴别特点。结论 3D建模技术可以完整地展示中药材的性状,在中药性状鉴定研究与教学研究方面具有良好的应用前景。     

公诉案件被害人当事人制度研究——以德国附带诉讼制度为参考

我国《刑事诉讼法》将被害人确立为公诉案件当事人,被害人与人民检察院作为“共同原告”履行控诉职能,这在理论和实践中都暴露出许多问题。德国附带诉讼制度允许被害人作为附带诉讼的原告人而非公诉案件本身的当事人参加公诉,具有合理性。借鉴德国的做法,我国应增设刑事第三人制度,让被害人作为刑事第三人参加诉讼,并赋予其相应的诉讼权利,从而有效解决被害人在公诉案件中参诉问题。     

Portable high‐resolution automated 3D imaging for footwear and tire impression capture

The forensic science community raised the need for improved evidence recognition, collection, and visualization analytical instrumentation for field and laboratory use. While the 3D optical techniques for imaging static objects have been extensively studied, there is still a major gap between current knowledge and collecting high‐quality footwear and tire impression evidence. Among optical means for 3D imaging, digital fringe projection (DFP) techniques reconstruct 3D shape from phase information, achieving camera‐pixel spatial resolution. This paper presents a high‐resolution 3D imaging technology using DFP techniques dedicated to footwear and tire impression capture. We developed fully automated software algorithms and a graphical user interface (GUI) that allow anyone without training to operate for high‐quality 3D data capture. We performed accuracy evaluations and comparisons comparing with the commercial high‐end 3D scanner and carried out qualitative tests for various impressions comparing with the current practices. Overall, our technology achieves similar levels of accuracy and resolution with a high‐end commercially available 3D scanner, while having the merits of being (1) more affordable; (2) much easier to operate; and (3) more robust. Compared with the current practice of casting, our technology demonstrates its superiority because it (1) is non‐destructive; (2) collects more evidence detail than casts, especially when an impression is fragile; (3) requires less time and money to collect each piece of evidence; and (4) results in a digital file that can easily be shared with other examiners.

习近平总书记在福建工作期间形成了极为宝贵的创新理念和重大实践。这些理念和实践具有前瞻性、开创性、战略性,其中“坚持以人民为中心”的理念和实践对民办高校思想政治教育队伍的建设有重要的指导意义。目前,民办高校思想政治教育队伍存在理论学习不深入、学生思想动态调研不充足、专业技能学习不及时、融入学生群体不顺畅、思想政治辅导员队伍不稳定、辅导员与思想政治理论课教师之间的思想政治教育不融合等薄弱点。针对这些问题,应将“坚持以人民为中心”作为民办高校思想政治教育工作的理念和实践,将一切工作的初衷紧紧围绕着学生这个群体,促进思想政治教育队伍的建设。     

Entre la pampa del lenguaje y el alambrado de la escritura: la mancha roja como síntoma de la ambigüedad de lo real en La ocasión de Juan José Saer

La presencia recurrente del color rojo en La ocasión de Saer desempeña una función desestabilizadora en relación a la representación figurativa. En el artículo se establecen analogías entre esta función y el elemento voluble, no mimético de la pintura que el pensador e historiador de arte, Georges Didi-Huberman, denomina como “pan” en contraste con el detalle, categoría asociada con el carácter icónico de la pintura. Al igual que el “pan”, las manchas rojas en la novela apuntan a la dimensión de lo real que se resiste a la legibilidad y señala los límites de la narrativa realista. Saer se vale de contrastes cromáticos para aludir a tensiones políticas y epistemólogicas y a las paradojas de escribir una novela situada en el siglo diecinueve pero incorporando la experiencia literaria del siglo veinte.
