《婚姻法》第 17 条第 4 项立法之商榷———兼论婚后继承或受赠财产的权利属性

《婚姻法》第 17 条第 4 项关于婚后继承或受赠财产原则上为夫妻共同财产的规定，引发了立法、司法和社会生活中的诸多问题。从共同财产认定的法理基础、该条与《婚姻法》第 18 条第 3 项之间的法律困惑、法律在本土化过程中出现的错误、该条存在的法律漏洞以及与相关法律的冲突等角度进行分析，提出废除该条款的立法建议。

历次四级考试成绩分析结果表明,完形填空的得分普遍较低。许多学生反映,完形填空部分是他们在CET一4中感到最棘手的一项。因此,研究完形填空的出题角度及题型特点,指导学生掌握一定的解题技巧及应试策略,对于提高四级考试整体成绩具有重要的现实意义。     

Governance Arrangements for Transboundary Issues: Lessons from the Food Waste Programs of Italian Regions

Focusing on transboundary issues contributes to highlighting how new governance modes can emerge from increasing interdependence and complexity in public policies. This article analyzes food waste as a transboundary issue that cuts across different policy subsystems (PSs), intersects multiple levels of government, and calls into question consolidated policy making for new modes of governance. The analytical framework provides a multidimensional approach and a new typology of governance arrangements to be used in empirical research. Evidence from an Italian case study and an empirical investigation of 20 regional food waste programs shows that regions can adopt different driving ideas and can activate a variety of governance arrangements and differentiated, as well as viable, modes of integration between consolidated PSs. The article argues that different tool mixes combined with different levels of governance complexity may lead to a variety of governance arrangements and a differentiated likelihood of policy integration.     

Integrating Concerns with Climate Change into Local Development Planning in Cambodia

Integration of climate change adaptation with development planning at multiple scales is widely seen as preferable to reactive, fragmented, or highly centralized responses. At the same time, there are growing concerns on when intervention is most appropriate, the transaction costs of coordination, and the adequacy of institutional capacity at local levels, especially in developing countries. This article examines entry points and mechanisms for integrating concerns with climate change into local development planning in Cambodia. An institutional ethnography of the planning process indicates that subnational planning is participatory and flexible; and thus, provides plausible entry points to integrate climate change concerns. Case study methods applied to two externally supported, climate‐resilient development projects identify promising mechanisms and strategies, as well as obstacles to integration. A vulnerability reduction assessment tool and top‐up grant scheme both included promising deliberative and participatory elements from which lessons for future and elsewhere can be drawn. At the same time, key stakeholders concede that local integration more widely is hampered by multiple obstacles, including weak institutional capacity, low community participation, and lack of resources and incentives. Addressing these challenges requires political commitments for good governance, capacity development, and additional resources.

随着"十二·五"规划的逐步实施和电子商务的不断发展,跨企业之间的信息应用日益复杂,单个Web服务的实现已经无法满足复杂业务的需求,如何实现Web服务的动态自动组合就成为一个亟待解决的课题.文章分析了基于WSRF的网格资源描述模型,并进行本体语义扩展,提出基于语义的网格服务资源模型,从而使网格服务的动态组合成为可能.     

Economic analysis of the removal of illegal gains

The purpose of the present paper is to explore both the motivation for confiscating illegal gain and also to look at some of its legal aspects and economic effects. It is argued that the removal of illegal gain may be able to play a significant complementary role, if only by closing the gap between the maximum punishment the law will allow and fines sufficient to represent a credible deterrent. The paper develops a deterrence model and applies it to confiscation powers introduced to help combat drug trafficking.     

Die Genossenschaftswohnung in der Exekution

Nachdem der OGH bereits in zwei Entscheidungen die Verwertung eines Kleingartenhauses und einer Genossenschaftswohnung im Konkurs trotz § 5 Abs 4 KO gebilligt hatte, hat er nunmehr in einer neuen Entscheidung die Verwertung einer Genossenschaftswohnung im Exekutionsverfahren – wenn auch mit Einschr?nkungen – für zul?ssig erkl?rt. Der vorliegende Beitrag stellt die Entscheidung vor und untersucht einige sich hier stellende Folgeprobleme.     

Anfechtung eines Umlaufbeschlusses nach § 24 Abs 6 und § 29 Abs 1 WEG 2002 bei "Seitenwechsel" der Verfahrenspartei oder durch "Beitritt" des AG als ASt?

Im wohnrechtlichen Au?erstreitverfahren ist die Berichtigung der Parteienbezeichnung analog zu § 235 Abs 5 ZPO gro?zügig handzuhaben; aus dem Antragsinhalt muss sich nur zweifelsfrei ergeben, gegen wen sich der Antrag richtet. Da die Beschlussanfechtung nach § 24 Abs 6 WEG 2002 gegen "die übrigen Wohnungseigentümer" zu richten ist, sind AG s?mtliche nicht antragstellenden Wohnungseigentümer. Ein Wohnungseigentümer kann einen Mehrheitsbeschluss auch dann anfechten, wenn er diesem zun?chst zugestimmt hat und nunmehr behauptet, es sei ihm bei der Stimmabgabe ein Irrtum unterlaufen. Ein überstimmter Wohnungseigentümer (= AG) kann im Beschlussanfechtungsverfahren innerhalb der Anfechtungsfrist die "Seite wechseln", indem er dem Verfahren als ASt beitritt.
