泰安“1·4”袭警案对强化民警执法安全意识的思考

山东省泰安市"1·4"袭警案存在的问题是信息匮乏,研判不足,警惕性不强,战术不当,缺乏合理的处置预案;实施车辆拦截的措施不当,缺乏必备的处置装备和专业处置警力反应迟缓。要培养民警执法行动的安全意识,应该强化安全来源于对执法行动的正确的思想认识,安全来自于携带装备的行动习惯,安全来源于警务实战行动的程序规范。     

Verlängerung einer EV zum Schutz vor Gewalt in der Familie

Eine zun?chst auf drei Monate befristete einstweilige Verfügung (§ 382b Abs 4 EO), mit der einem Lebensgef?hrten das Betreten der Wohnung und die Rückkehr in die Wohnung verboten wurde, kann auch nach Einbringung einer R?umungsklage durch den Gegner der gef?hrdeten Partei bis zur Rechtskraft des R?umungsstreits verl?ngert werden. Die Verl?ngerung setzt nicht voraus, dass die Sicherungswerberin selbst das Verfahren zur Kl?rung der Benützungsberechtigung an der Wohnung mit Klage eingeleitet hat.     

Untermietzins: Wahrung der Präklusivfrist bei Vermieterwechsel

Wurde im Fall des Vermieterwechsels das Begehren auf Feststellung der Teilnichtigkeit der (Unter)Mietzinsvereinbarung nur gegenüber dem früheren (Unter)Vermieter innerhalb der Pr?klusivfrist des § 26 Abs 4 MRG erhoben, so ist zu prüfen, ob diesem gegenüber ein Rechtschutzbedürfnis an der Geltendmachung der Teilnichtigkeit besteht. Es reicht hingegen nicht aus, wenn ein solches Rechtschutzbedürfnis nur gegen den nach Ablauf der Pr?klusivfrist belangten aktuellen (Unter)Vermieter (Einzelrechtsnachfolge) vorliegt. Die Pr?klusivfrist des § 26 Abs 4 MRG ist nur dann gewahrt, wenn nicht nur die Aktivlegitimation, sondern auch die Passivlegitimation des Antragsgegners materiellrechtlich begründet ist.     

Weitergabe des Mietgegenstandes – Eventualmaxime im Kündigungsverfahren

Die durch § 33 Abs 1 zweiter Satz MRG normierte Eventualmaxime für die gerichtliche Aufkündigung bedeutet, dass der geltend gemachte Kündigungsgrund bereits in der Kündigung individualisiert werden muss, wozu die Angabe einer bestimmten Gesetzesstelle nur dann genügt, wenn diese nur einen Tatbestand enth?lt. Die Entgeltlichkeit der Weitergabe ist nur für den zweiten Tatbestand des § 30 Abs 2 Z 4 MRG wesentlich.

Internal Validation of the AmpFlSTR Yfiler™ Amplification Kit for Use in Forensic Casework

Abstract:  Y-chromosomal short-tandem repeat (Y-STR) amplification has been used in forensic casework at the Bureau of Criminal Apprehension (BCA) Forensic Science Laboratory since 2003. At that time, two separate amplifications were required to type the SWGDAM recommended loci (DYS19, DYS385a/b, DYS389I, DYS389II, DYS390, DYS391, DYS392, DYS393, DYS438, and DYS439). The Yfiler™ kit coamplifies these loci as well as DYS437, DYS448, DYS456, DYS458, DYS635, and Y GATA H4. The Yfiler™ kit was validated following the internal validations outlined in the SWGDAM revised validation guidelines. Our studies show that 0.125 ng of male DNA will generate a complete 17 locus profile and that as little as 0.06 ng of male DNA yields an average of nine loci. In the male–male mixtures, a complete profile from the minor component was detected up to 1:5 ratio; most of the alleles of the minor component were detected at a 1:10 ratio and more than half the alleles of the minor component were detected at a 1:20 ratio. Complete YSTR profiles were obtained when 500 pg male DNA was mixed with female DNA at ratios up to 1:1000. At ratios of 1:5000 and 1:10,000 (male DNA to female DNA) inhibition of the YSTR amplification was evident. The YSTR results obtained for the adjudicated case samples gave significantly more probative information than the autosomal results. Our studies demonstrate that the Yfiler™ kit is extremely sensitive, does not exhibit cross-reactivity with female DNA, successfully types male DNA in the presence of overwhelming amounts of female DNA and is successful in typing actual forensic samples from adjudicated cases.     

传统物流企业需要树立现代营销观念

推销只是4P营销策略中促销策略(Promotion)其中之一,是整个营销活动中很小的一项活动.在一些企业,推销甚至是可以忽略的活动.从对营销与推销的概念理解看,我国相当部分物流企业就是把推销和营销当作一回事来看的.企业赢利首先取决于投资了正确的行业,然后是市场营销,之后才是管理.因此,一旦行业竞争加剧,业内企业面临重新洗牌时,市场营销的极其重要性一定会显现出来.我国的物流行业近几年完全有可能进行大规模的重组,传统物流企业需要尽快从推销时代走向营销的时代.     

冠状动脉急性病变斑块内Toll样受体-4表达的研究

目的探讨Toll样受体4（TLR4）与冠状动脉粥样硬化（AS）斑块急性病变的关系。方法从本教研室2004～2007年尸检档案中挑选24例病例及其心脏标本。分为实验组（有冠脉急性病变的SCD者）、对照组Ⅰ（无冠脉急性病变的SCD者）和对照组Ⅱ（冠脉无严重AS的暴力死者）等3组，每组8例。用免疫组化SABC法和图像分析技术定量检测TLR4在各组冠状动脉AS斑块内表达的平均光密度值（OD），所得数据用SPSS14．0统计学软件进行分析处理并比较各组间的差异。结果实验组冠状动脉AS斑块中TLR4表达呈强阳性，对照组Ⅰ呈相对较弱的阳性表达，而对照组Ⅱ冠状动脉壁及轻度增厚的内膜处均未见阳性表达，其OD值（0．4662±0．0190）与两个对照组（分别为0．3361±0．0165，0．2463±0．0190）相比，对照组Ⅰ与对照组Ⅱ相比，其差异均具有统计学意义（P〈0．01）。结论冠状动脉AS斑块中TLR4的表达情况可视作为冠状动脉AS斑块发生急性病变的一个病理诊断指标，也是诊断冠心病猝死的重要依据之一。     

Forensic applications of stable isotope analysis: Case studies of the origins of water in mislabeled beer and contaminated diesel fuel

This paper describes the use of oxygen (¹⁸O) isotope analysis of water contained in two different materials — beer and diesel fuel — involved in the resolution of two separate cases. In the first case study, it was possible to demonstrate that a sample of beer labelled as premium brand in fact belonged to a cheap brand. The second case related to the contamination of diesel fuel from a service station. The diesel fuel contained visible amounts of water, which caused vehicles that had been filled up with it to become defective. For insurance purposes, it was necessary to determine the source of water. The δ¹⁸O values for the water of nearly all samples of diesel was close to the δ¹⁸O of local tap water at the filling station.     

Case of Fatal Starvation: Can Stable Isotope Analysis Serve to Support Morphological Diagnosis and Approximate the Length of Starvation?

The diagnosis of death as a result of starvation is established on anthropological measurements, visual appearance of the deceased on external and internal examination, microscopic analysis, laboratory testing, and exclusion of other causes of death. Herein, we present our findings on a case of 95‐year‐old man who died of starvation. After the diagnosis of starvation was established by traditional forensic medicine methods, we have conducted retrospective segmental analysis of stable carbon (δ¹³C) and nitrogen (δ¹⁵N) isotope ratios in hair sample. This method reveals periods of starvation through decrease in δ¹³C and increase in δ¹⁵N along the strand of hair. Our analysis revealed the decrease of 0.6 ‰ in δ¹³C during the last 10–12 weeks prior to death, similar as reported in other investigations. Also, a decrease of 0.7 ‰ in δ¹⁵N during the last 8–10 weeks prior to death was determined that was different than observed in previous studies.
