“I Fought. I Screamed. I Bit”: The Assertion of Rights Within Historic Abuse Inquiry Transcripts

ABSTRACT

This article examines how treating historic abuse inquiry testimonies as retrospective assertions of rights can help to shed light on how this abuse was able to occur and how memories are recalled in an inquiry environment. It presents its approach as a possible framework for other historians seeking to analyse testimonies with sensitivity. It uses, as an example, a case study from the Australian Royal Commission into Institutional Responses to Child Sexual Abuse concerning two interrelated “homes” for girls, showing the ways in which abuse survivors can use their testimonies to assert rights denied them in the past and further the goals of public inquiries.     

云南新型毒品滥用危害评估探析

通过对168份新型毒品滥用问卷的实证分析,认为新型毒品滥用的主要危害主要表现在两个方面:一是对滥用者身体能力、生产能力的危害;二是对滥用者心理能力的危害。因此,在对其进行预防教育或进行帮教时,我们不能因为滥用新型毒品者有偷盗、抢劫、故意伤害等行为,就认为其法律意识不强,而应从他们的身体能力和心理能力的调整与恢复上进行帮教。     

African American Women’s Readiness to Change Abusive Relationships

This study explores 178 low-income, abused African American women’s readiness to change abusive relationships and achieve safety. We explore stages of change using Prochaska and DiClemente’s transtheoretical model (TM; Precontemplation, Contemplation, Action, Preparation, and Maintenance). Results reveal that: for abused women, the stages fall along a continuum (versus discreet and linear stages); abused women are primarily in the Contemplation stage; and multiple factors (perception of current abuse, number of children in her home, symptoms of general anxiety and posttraumatic stress disorder [PTSD], substance use, spiritual well-being, self-esteem, and social support) affect women’s total readiness to change intimate partner violence (IPV). Current IPV, anxiety, PTSD, substance abuse, and spirituality were positively correlated with readiness to change, and children in the home and self-esteem were negatively correlated with readiness to change. Multiple regression analysis revealed that PTSD and spiritual well-being are positive predictors of readiness to change. Findings contribute to the growing body of literature supporting the TM as applied to IPV. Results are discussed in terms of applicability to interventionists, policy makers, and community leaders as they consider the plight of abused women and their efforts towards violence-free relationships.     

美沙酮替代疗法的犯罪学思考

面对严峻的吸毒贩毒形势,我国政府采取了理性客观务实的态度,采取美沙酮替代疗法(试点),致力于有效治理吸毒成瘾者,控制艾滋病的传播和预防减少犯罪,在实际操作中收到了良好的效果。然而,吸毒现象有其产生的历史和现实的原因,要迅速而彻底禁绝吸毒是不现实的;面对吸毒与艾滋病要防治结合、多管齐下,有效预防才能减少犯罪,美沙酮替代疗法的实施,体现了人性关怀的策略。     

WTO框架下完善我国知识产权滥用规制制度的若干思考

防止滥用知识产权是WTO框架下的TRIPs协议确立的一项基本原则。我国对于知识产权滥用的规制既要充分利用TRIPs给予成员的立法空间,又要符合TRIPs协议的要求。我们应该就TRIPs协议中已经规定的对限制竞争行为的禁止、专利强制许可、滥用知识产权执法程序等几个方面来建立和完善规制知识产权滥用的制度,以全面履行TRIPs协议。     

浅析摇头丸滥用的历史沿革及其危害

吸食、滥用摇头丸,不仅给个人造成巨大的经济损失和人体的危害,而且带来一系列社会问题,已经成为影响经济社会协调发展、构建和谐社会的一大隐患。要让人们更多地了解摇头丸的有关知识,以此增强自觉抵御摇头丸的能力,从而遏制摇头丸在我国的滥用和蔓延。     

美国成年监护制度改革之动因及对我国的启示

进入新世纪,人口老龄化已经是一个全球性的问题。中国作为占世界人口五分之一的人口大国,老龄化来势迅猛,通过法律手段建立完善成年监护制度就极为必要。但是我国目前保障欠缺行为能力人合法权益的立法仍不够完善。而大陆法系以及英美法系各国接收吸纳国际化新理念,对其成年监护制度进行大刀阔斧的改革,以顺应国际潮流并切实保障欠缺行为能力成年人的合法权益。这对我国有非常重大的借鉴意义。     

Crossover Cases of High‐Conflict Families Involving Child Protection Services: Ontario Research Findings and Suggestions for Good Practices

Child protection services (CPS) are increasingly becoming involved in high‐conflict separations and the related custody and access proceedings. CPS involvement is often necessary to respond to abuse or neglect allegations or protect children from emotional harm. However, these crossover cases are very challenging for family justice professionals. This article reports on research on crossover cases in Ontario, including an analysis of reported court decisions, a survey of CPS staff, and interviews with family justice professionals. We suggest clearer CPS policies; improved understanding of respective professional roles; CPS summary reports for family courts; increased interagency coordination, communication, and training; and use of judicial case management.
