从裁判依据的类型分析,公众意见只能作为一种事实依据,参与个案裁判。在常规案件中,公众意见作为一种准用的辅助性依据,可以通过弱的裁量成为合理化判决结论的说明性事实。在遇有法律漏洞的疑难案件中,与社会性主张相一致的公众意见,如果耦合法律体系中的法律原则或基本权利规范,可以籍由强的裁量充当个案推理的运作性依据,成为非常情形中正当化个案规则创制的立法性事实。在日趋多元化和复杂化的转型中国,法律系统必须在稳定性和灵活性、普遍正义和个案正义之间寻求一种平衡;判断公众意见的个案裁判地位,同样需在辅助性依据或运作性依据、说明性事实或立法性事实之间寻求一种平衡。  相似文献

目的建立血液中白藜芦醇的固相萃取/LC-MS/MS方法。方法自制固相萃取柱,在长约13cm的酸性滴定管中,底部填入约0.02g玻璃棉,依次加入柱填料PSA 0.15g,Florisil 0.3g,Silica 0.45g。对样本进行固相萃取,采用LC-MS/MS方法进行检测,运用保留时间和多反应监测(MRM)方式对血液中白藜芦醇进行定性定量分析。结果回收率为95.66%~98.58%,最低检测限(LOD)为1.79μg/mL,线性范围2.5~20μg/mL;相关系数为0.9997。结论本文所建方法,适用于血液中白藜芦醇的检测。  相似文献

目的建立微波消解ICP/AES标准加入法测定尿液中As、Ba、Pb、Cd、Cr、Zn、Sb金属毒物。方法取1.0mL尿样,加入3mL浓硝酸和0.5mL双氧水,进行微波消解。冷却后,用2%的硝酸定容至10.0mL。采用标准加入ICP/AES法进行定量分析,并优选实验条件及考察方法可靠性。结果尿液中As、Ba、Pb、Cd、Cr、Zn、Sb回收率在98.6%~104%之间;检出限在2.0~5.1ng/mL之间;线性范围Zn为5.0~200.0μg/mL,其余元素为0.5~20.0μg/mL。采用本文方法测定与国家标准物质人发和牛肝数据测定值基本一致。结论该方法回收率高、检测限低、能多元素同时测定,可以用于尿液中金属元素的检测。  相似文献

Part I of this article in [2012] 28 CLSR 3-13 analysed the views of learned commentators on what constitutes the ‘independence’ of data protection authorities (DPAs). It concluded that a more satisfactory answer needed to be found in the international instruments on data privacy and on human rights bodies, their implementation and judicial interpretation, and in the standards that have been proposed and implemented by DPAs themselves. It found that only the OECD and APEC privacy agreements did not require a DPA (and therefore had no standards for its independence). Thirteen factors were identified as elements of ‘independence’ across these instruments and standards, five of which were more commonly found than others.  相似文献

The proposal for a fundamental reform of the European data protection law, published by the EU Commission on 25 January 2012 is composed of two elements. Apart from a General Data Protection Regulation, the Commission proposes a second regulatory instrument, namely a Directive with regard to data processing by police and criminal justice authorities that shall supersede the Council Framework Decision 2008/977/JHA. This paper seeks to analyse the draft Directive in the context of the entire reform approach and scrutinizes a number of specific issues in regard to the scope, the requirements of data processing, notification duties and data transfer to third countries.  相似文献

This paper comments on UK government's Open Standards Consultation which opened on 7 February 2012. It questions the UK government's mandating of open standards defined as standards which include patents licensed on a royalty free basis. The paper suggests that instead of promoting a level playing field, the government's policy will actually restrict competition and hinder interoperability. This policy is contrary to EU policy in a number of different fields which have all accepted, despite significant in-depth debate on this issue, that the best way to ensure the most effective competition, innovation and interoperability is to allow both royalty free patents and royalty bearing patents to compete provided the latter are licensed on FRAND terms. Lastly the paper suggests that the public procurement rules are not the place to apply industrial policy, instead a full market analysis should be conducted involving other government departments such as BIS and the IPO.  相似文献

Illegal homemade ammunition is commonly used by criminals to commit crimes in Taiwan. Two unusual types of homemade ammunition that most closely resembling genuine ammunition are studied here. Their genuine counterparts are studied as the control samples for the purpose of comparison. Unfired ammunition is disassembled, and the morphological, dimensional, and compositional features of the bullet and cartridge case are examined. Statistical tests are employed to distinguish the dimensional differences between homemade and genuine ammunitions. Manufacturing marks on head stamps of the cartridge case are carefully examined. Compositional features of propellant powders, primer mixtures, and gunshot residues are also analyzed. The results reveal that the morphological, dimensional, and compositional features of major parts of the ammunition can be employed to differentiate homemade cartridges from genuine ones. Among these features, tool marks on the head stamps left by the bunter can be used to trace the origin of ammunition.  相似文献

随着人口增长和消费行为的变化,公众成为环境影响的重要主题。同时,全球环境治理也逐步从管制-命令向公众参与转变,公众成为环境政策过程的重要参与者。借助"世界价值观调查"2007年的数据,研究中国公民的环境税费支付意愿,从而揭示出影响环境政策工具民意基础的重要因素。逻辑斯蒂模型的分析结果表明,环保意识、发展观和政治信任是左右人们支持政府环境经济政策的重要因素,并且三者相互联系,在政府与公众的互动当中不断变化。  相似文献
