本文试图以实践美学的情本体理论分析以《红楼梦》为代表的中国艺术的“情本体”精神。《红楼梦》明确地把“情”为人生的本体,并使之具有了形而上的品格,成为一种既植根于现世、又具有超越性的精神。“情”在《红楼梦》里不仅是一种狭义的男女之间两心相悦之情爱,而且是一种广义上热爱人生、热爱生命、热爱世界的“爱”,更是一种超越现实世界的“悟”,一种形而上之“体”,一种既入世又出世之“玄”,也是人生存于世的“本体”。这种本体之“情”,在中国传统美学中源远流长,传承悠久。它与儒家的社会本体论、道家的自然本体论互为补充,同时也互相批评,构成中国传统人生本体论的立体交叉网络。情本体美学的理论表述可以明李贽的“童心说”和汤显祖的“唯情说”为代表,屈原的忠君爱国精神为其人格象征,《红楼梦》则是其作品的代表。  相似文献

作为一部中国封建社会末世的百科全书,<红楼梦>鲜明的社会性、现实性、批判性时至今日仍具有深刻的认识意义和借鉴价值.文章以书中"葫芦僧判断葫芦案"、"王熙凤弄权铁槛寺"等章回所描述的几桩糊涂官司为例,分析这些案件审理和判决过程中所呈现的"势力--人情--糊涂了(了结)"的规律,以期揭示当时社会的吏治黑暗与司法腐败,表达对当代社会廉政与司法公正的期望和信心.  相似文献

刑事诉讼管辖权异议,是在刑事诉讼中,被告人一方在司法机关违背管辖规定,管辖了其无权管辖的案件或者认为其他司法机关更适合管辖的情况下,在法定期限内向有审查权的法院提出要求该司法机关将案件移送有管辖权或更适合管辖的司法机关管辖的主张。但长久以来,我国刑事诉讼中一直缺失管辖权异议的制度。以香港刑事诉讼管辖权异议制度为参照系,汲取其中的精华元素,建立起一套较为完整的我国刑事诉讼管辖权异议制度,是一种尝试。  相似文献

Two hundred and fifty-nine gifted adolescents were assessed on their emotional intelligence and social coping strategies using the Emotional Intelligence Scale (N. S. Schutte et al., Personality and Individual Differences, 25, 167–177, 1998) and the Social Coping Questionnaire (M. A. Swiatek, Gifted Child Quaterly, 39, 154–161, 1995). An item factor analysis yielded four dimensions of emotional intelligence, leading to the construction of 4 empirical scales of emotional intelligence. Students scored most highly on Social Skills and Self-Management of Emotions, followed by Empathy, and Utilization of Emotions. In coping with their being gifted, students endorsed to different degrees their use of 6 coping strategies, which were Valuing Peer Acceptance, Involvement in Activities, Attempting Avoidance, Denying Giftedness, Prizing Conformity, and Discounting Popularity. Social Skills emerged as the most important component of emotional intelligence predicting the use of strategies of Valuing Peer Acceptance and Involvement in Activities. Implications of the findings for enhancing emotional intelligence of adolescents in coping with problems arising from their being gifted and the need for further studies using longitudinal data are discussed.  相似文献

受贿罪是一种危害性严重的腐败犯罪。中国大陆刑法典和香港特别行政区刑法中都规定了受贿罪。但两地刑法中对犯罪的构成要件和处罚都是有区别的 ,表现在犯罪主体方面的区别、犯罪客观方面的区别、受贿标的的区别以及刑罚的区别。通过比较研究 ,可以借鉴吸收香港刑法中的有益做法 ,以完善大陆刑法。  相似文献

Has the mandated reporting of key performance indicators (KPIs) by public agencies to public accountability or reporting authorities in Taiwan, Hong Kong and Singapore helped these authorities in their task to hold the agencies to account? This article argues that the sheer existence of KPIs in public agencies' annual reports and budget papers does not automatically lead to their effective use by the authorities for making decisions about the agencies' performance achievements. The utilization of KPIs for making decisions by the participating authorities in these countries could be best described as careful and cautious because of their perceptions that the KPIs have failed to meet their performance information needs. Since the implementation of a performance measurement and reporting system has been linked to both instrumental and symbolic benefits, perhaps the main value of the current systems lies less with their ability to bring about instrumental benefits to reporting authorities and other stakeholders. Instead, their primary strength may be skewed towards their capacity to accrue symbolic benefits for the government. Copyright © 2007 John Wiley & Sons, Ltd.  相似文献

香港基本法的解释对于保证基本法的正确平稳实施具有重要作用,而关于基本法解释权的问题在最近的三次案例中都引起了颇多争议。本文先对有关的法律条文进行演绎分析,从而论证基本法的解释权归于全国人大常委会,香港法院可以解释基本法是缘于授权,对于自治范围外的条款需要提请常委会解释。再通过对比内地的法律解释体系和欧盟的先行裁决制度,并借助“法克坦姆案”来说明这样的制度设计无损于香港的司法独立。  相似文献

This study explored the relationships among IQ, perceptions of giftedness, and self-concepts in a sample of 116 Chinese junior secondary school students in Hong Kong. These students, nominated by their schools to join the university gifted programs, were assessed on their IQ, global and domain-specific self-concepts, as well as their perceptions of their own giftedness in terms of their concern for feeling different, their critical attitude in evaluating their own performance, and their experience of high expectation to achieve from their parents. The findings indicated that in general the ways students perceived their giftedness affected differentially global self-worth and specific self-concept domains. While difference concern and critical evaluation affected students' specific self-concepts adversely, high parental expectation had a more positive influence. Self-concept domains related to social acceptance and friendship issues were most strongly and adversely affected. Implications of the findings for interventions to enhance the self-esteem of gifted students through restructuring their perceptions of giftedness are discussed.  相似文献
