社会资本视角下的中国农民增收

从社会资本的视角出发,可以发现,农民的人际关系资源短缺、特殊主义的信任观以及合作意识的匮乏等消极性社会资本阻碍了农民收入的增长。因此促进农民增收,既需要提升农民的物质资本与人力资本的存量,也需要通过改变农民的关系网络结构、增强农民的组织能力与组织化程度、树立现代性信任观等来提高农民的社会资本存量。

Trusting in Trust(s): TheFamily Home and Human Rights

In July 2002, the U.K. Law Commission published its Discussion Paper No.287 on home-sharing. The conclusion drawn by the Law Commission was that it would not be possible to devise a statutory scheme for the resolution of family property disputes which is both workable and flexible enough to deal with the wide range of personal relationships that exist. It further took the view that, with appropriate changes to the way in which trusts principles are currently interpreted and applied by the courts, these trusts principles are sufficiently flexible and coherent to deal with the question of ascertaining and quantifying property rights over the family home. The aim of this paper is to examine the implications of these particular conclusions drawn by the Law Commission for both the law of trusts and the resolution of family property disputes between cohabitants. In particular, the paper will consider the extent to which trusts law remains a workable and desirable option and whether any mileage may be gained by drawing on the human rights culture that is emerging in U.K. legal and political discourse. 2001年12月6日最高人民法院审判委员会第1201次会议通过了<最高人民法院关于民事诉讼证据的若干规定>(以下简称<规定>),在民事诉讼证据领域作出了多处重大的理论突破,在实践中也取得了积极的效果.但<规定>也存在有若干缺陷,本文主要针对这些缺陷进行了分析,并作出自己的评价.     

同一认定理论及其逻辑分析

长期以来,我国司法鉴定理论和实务界对同一认定的新技术方法进行了广泛的研究,但对同一认定理论缺乏足够的关注。应该说,我国的同一认定理论还不够完善,甚至因此影响到鉴定结论的正确性。因此,有必要对同一认定的基本理论问题,特别是同一认定的基础和条件、范围和对象、过程和标准以及同一认定结论的科学性、证据价值等进行深入的论证和分析。     

试论肯尼迪政府联合印尼对华遏制孤立政策

中美关系解冻前,印尼在美国对华冷战政策中一直居于突出地位。肯尼迪非常看重它的国力及其在不结盟世界的影响,他联合印尼遏制孤立中国的意图比艾森豪威尔明显加强。但围绕西伊里安问题、马来西亚问题,美国与盟国矛盾激化,这在某种程度上避免了他在拉苏加诺加入反华轨道时可能采取的极端决策,肯尼迪政府借助印尼强化对华遏制孤立的政策作法最后与初衷背道而驰。

International Cooperation to Manage High‐Skill Migration: The Case of India–U.S. Relations

Highly skilled people are among the most valuable factors of production in the contemporary world economy. Some have characterized the competition among nations for these people as a “brain drain” or “war for talent,” which imposes significant costs on the countries of emigration. However, the distribution of costs and benefits that results from high‐skill migration is not necessarily zero‐sum or fixed. It may be altered through international cooperation, producing a self‐reinforcing “win–win” scenario for sending and receiving countries. Bilateral cooperation, focused on specific sectors affected by migration, is the most promising approach for realizing such a scenario. This paper explores the prospects and potential for such cooperation between India and the United States, which comprise what is probably the world's largest high‐skill mobility relationship. After sketching the broad contours of the relationship, we explore the prospects for mutually beneficial cooperation in three specific fields of high‐skill migration: information technology services, medicine and nursing, and graduate education.     

The new U.S.-China rapprochement： A view from Africa

The U.S. and China recently held a ＂dialogue＂ at the behest of policy makers in Washington for the mutual benefit of their governments and people and ostensibly the rest of humanity as well. Coming at a time of increasing quest for natural resources by many countries including China and Chinese obviously bourgeoning influence in Africa, that Washington decided to engage Beijing certainly, not only betrays U.S. apprehension over the emergence of a strong competitor for Africa＇s resources but also an attempt to whittle down China＇s growing international stature especially on the African continent. While the Chinese will not likely succumb to the U.S., this new found rapprochement between the two will certainly intensify the resource scramble in Africa. Whether the ＂severe＂ interest for African resources will benefit the continent or not depends on how African countries are able to manage the ensuing resource race between the U.S. and China.
