Love and the State: Gay Marriage in Spain

On 30 June 2005, the Spanish Parliament approved Law 13/2005, which amends the Civil Code to permit same-sex marriage. This formal equality measure put Spain in the spotlight of the international media. It is the culmination of a series of developments spanning from the last years of the Franco regime (which ended in 1975), through the enactment of anti-discrimination measures in 1995, to the recent fight for kinship recognition. It also follows a recent shift, from 1998 to 2005, towards the enactment of same-sex partnership laws at regional level, the approval of same-sex marriage and finally, the approval of a ‹gender identity law’ (2007). This legislative note assesses the context in which the new law on same-sex marriage has been enacted. I argue that although same-sex marriage has been represented by many activists and politicians in Spain as a gender neutral contract, it has the potential for differential impacts on lesbians and gay men, and further research and debates are needed in this area.

法律安定性不仅是法律自身的逻辑自恰性、连续性和体系化,更应该从法律与社会生活的适应关系中去理解。法律须被明确规定、实用而且保持相对不变,否则,法律平等、合目的性将无法实现。在转型社会法律安定性是在应对法律移植与本土资源、法律与方法和法外空间等紧张关系中实现的。     

20世纪40年代罗家伦对近代中国民族国家建构与民族发展问题的理论探讨

20世纪40年代,罗家伦顺应中国走向现代化的趋势,从民族与经济、政治、教育、人口、宗教、法律制度、语言文字、地理环境等方面关系的角度探讨了近代中国民族国家建构问题,形成了较为系统的民族发展理论。罗家伦将中国民族国家的建构与现代化联系起来,他所注重的工业化、科学化、民主化以及人的现代化,实质上都是现代化的基本内容。他的民族国家建构理论的主流,正是中华民族在落后的历史条件下,希望通过借鉴世界各国先进的技术和经验,通过自己的发展和创造,赶上先进国家、实现民族现代化的具体体现。

Pubertal Development, Choice of Friends, and Smoking Initiation among Adolescent Males

Prior research has indicated that pubertal development and peer associations are important determinants of adolescent smoking behavior. However, more remains to be learned about why these variables matter or how they may be related to one another in ways that lead to the initiation of smoking. Using contractual data from the National Longitudinal Study of Adolescent Health, we consider the relationship between early pubertal development and associations with close friends who smoke, and smoking initiation among male youths. The results of the study reveal a link between advanced pubertal development and the initiation of smoking among boys, but we discover that the effect is indirect, mediated by a greater propensity of sexually mature males to forge friendships with peers who smoke. We also find that this propensity is greatest among the youngest adolescents in the sample, suggesting that the age of the respondent conditions the effects of pubertal development on the formation of friendships with peers who smoke.(Ph.D., The University of Texas at Austin), is an Assistant Professor at Washington State University at Vancouver. 可持续发展伦理观辨正

可持续发展问题不单是人与自然关系应当如何的问题,归根结底是一个怎样确立人与社会和谐关系的问题.无疑地,应当对可持续发展伦理观作一番仔细辨正.对于发展中的中国来说,在平等与发展之间,孰轻孰重、孰先孰后,应有符合自己国情的选择,不能离开社会现实而抽象地谈论所谓"人与自然的平等"问题.     

略论债权平等原则

债权具有相容性和平等性,不仅在同一标的物上可以同时并存数个债权,而且数个债权人对同一债务人先后发生数个普通债权时,其效力一律平等,不因其成立先后而有效力上的优劣,是为债权平等原则.债权平等原则是体现民法上的平等原则和债之相对性原则的一项重要具体原则,为债权与物权区分说的基本构成要素之一.但在现代民法上,由于债权物权化趋势、优先权制度的设立以及协调公平与效益的法律价值冲突等因素,债权平等性原则正在被打破.即便如此,债权平等原则在债法领域的基础地位并未发生根本改变.     

对影响我国国家安全的若干经济问题的思考

经济安全作为国家安全的重要组成部分,是保障国家安全的必要条件,维护社会稳定的坚实基础。现阶段,金融安全问题,经济发展中的资源环境安全问题,小康社会建设中的公平公正问题,以及和平发展中的外部风险问题,是我国国家安全面临的主要经济问题。我们必须坚持以经济建设为中心,以科技创新提升综合国力,为保障国家安全构建良好的经济基础。

江泽民同志在十六大报告中指出,21世纪头20年是中国发展的战略机遇期,中国将进入全面建设小康社会的战略转折时期。面对机遇和挑战,中国共产党始终高举邓小平理论和“三个代表”的旗帜,坚持理论创新,以理论创新推动制度创新和各项事业的创新,在解放思想中统一思想,在应对挑战中倍加珍惜党的团结。     

《国家赔偿法》的缺陷及其完善

《国家赔偿法》在实施中存在一些缺陷,其主要表现为:赔偿的归责原则单一;赔偿范围过窄;赔偿标准过低;赔偿程序不合理;赔偿费用支付存在漏洞等。本文针对《国家赔偿法》的上述缺陷提出了相应的完善措施。
