伴随人类科技与文明的高速发展,人类共同继承财产理论中关于资源的所有权归属和实体财富的分配等要素已无法满足现代国际社会的发展需求。“一带一路”倡议在尊重《联合国宪章》的宗旨与和平共处五项原则的前提下,从国际关系的变迁、客体类型的扩大和法律规范的转型三个方面促动了人类共同继承财产理论的深化发展。在此基础上,加强“一带一路”倡议与现行国际法理论的互动研究,以期推动形成一项以人类命运共同体思想为核心的拟议国际法原则。 相似文献

民法总则关于民商主体界分的整体制度设计因自然人与法人的不同而分别遵循了不同的逻辑标准,但都直接体现或隐含了“营利性目的”的内涵。民法总则民商主体界分制度在概念使用和标准贯彻上存在逻辑缺陷,进而导致实践中可能面临诸多难题。可行的完善思路是对商自然人的主体制度建构采取由基本法确立营业权和由单行法规定具体规则的方式;用“组织”作为主体概念统领“法人”和“非法人组织”;将商组织的具体制度纳入民法典专编或者商事基本法加以规定,并且在民商主体界分时采取法律判定与事实判定相结合的模式。 相似文献

International development NGOs are in existential crisis. Their legitimacy and added value are increasingly challenged. While scholars have focused on legitimacy, work on “value-added” is scarce. In particular, no research addresses the value of domestic programmes to international NGOs. This article rectifies this, focusing on the case of Oxfam GB’s UK Poverty Programme (UKPP). Using empirical research from 35 interviews with Oxfam GB staff, partners and beneficiaries and over 150 archive documents, the article identifies seven assets through which the programme provides value added to Oxfam GB. It highlights the possibility that these could offer insights into the dimensions of future INGOs. 相似文献

In the recent past, governance reforms in India have resulted in the government and corporate sectors making serious efforts to enhance and showcase their accountability to their principals, namely citizens and shareholders. Access to reproductive health services and products in remote and rural communities is a critical area of concern for developing countries. This article considers a pilot intervention in three districts of Pakistan where “Business-in-a-Box” as a model of place-based social innovation is used to improve the socio-economic conditions of women in remote rural settings through socially responsible micro-franchising. It finds that such programmes help build a sense of community, ownership and grassroots capabilities and skills. The article also discusses the impacts of such actions on the individual and community life, and the need to upscale and sustain these initiatives. 相似文献

Land-use planning, although a mechanism for development, can also generate insecurity during its implementation. This article argues that tenure security and land-use planning should not be implemented in isolation from each other. It posits that land-use planning – rather than restricting the security of people's tenure – has the potential to serve as a means of securing tenure. The article explores tenure (in)security elements in land-use planning as a crucial challenge in the urban town of Gelan Sidama Awash, Ethiopia. Using data collected through stakeholders’ interviews, it uncovers their tenure security challenges, and outlines a set of measures for enhancing tenure security through land-use planning. 相似文献

In light of the growing public spending in many regions of the world, this study scrutinizes relevant determinants of core public administration expenditure at the cantonal level in Switzerland, focusing particularly on New Public Management (NPM) reforms. The empirical study comprises all 26 cantons in the period from 1993 through 2014 and uses both cross‐sectional and longitudinal analytical methods. In addition to NPM, we control for various variables related to political parties, institutions, socioeconomics and culture. The results show no clear relationship between NPM reforms and expenditure, although such reforms were often intended to cut costs. Our explanation for this finding is that NPM as a concept is rather inconsistent. Various control variables are either positively or negatively related with expenditure. All in all, our findings suggest that public expenditure is still mostly determined by politics and can only be influenced by administrative reforms within certain narrow limits. 相似文献

Choice, diversity and personalisation have been key to the New Labour project in public services. With the emergence of a reinvigorated Conservative party as a credible electoral threat, and the end of the Blair era, it seems appropriate to consider the continuing viability and longevity of the New Labour public service project. In this article, I approach the issue of choice in public services through an examination of the long-running controversy over choice in the English secondary school system. I argue that the opponents of choice have been reluctant to engage with the notion of choice in public services due to concerns over the supposed negative effect that consumer choice has on the equity and quality of service provision. This paper aims to challenge the claim that any element of choice in education necessarily has deleterious effects on social justice. I argue that the case against school choice has not been decisively made and that school choice can, in principle, form part of a socially progressive educational project by redistributing power to service users and helping to maintain popular support for public provision of education. 相似文献
