商业贿赂的滋生原因与对策探讨

当前,商业贿赂已经成为一大社会公害,其滋生蔓延的原因极其复杂,主要体现在社会文化、市场机制、立法、执法四个方面。为了有效地治理商业贿赂,我国应当借鉴国外的反商业贿赂经验,参照《联合国反腐败公约》的规定,完善惩治商业贿赂的对策。     

Case Comment: The Legality of ‘Kettling’ after Austin

This case comment considers the European Court of Human Rights decision of Austin v United Kingdom (2012) 55 EHRR 14. Austin claimed, unsuccessfully, that police kettling at a public protest in London amounted to a violation of her right to liberty under Article 5 of the European Convention of Human Rights. This case comment suggests that the court took an unexpected and unorthodox approach to the issue of ‘deprivation’ within Article 5. This decision may come to undermine the protections afforded by Article 5 and extend the current exceptions to Article 5 to an indefinite range of situations.     

有效管辖视角下中国南海海权的维护

针对当前中国南海众多岛礁被侵占、大量资源被掠夺的现实,为更好地维护中国海权从而为建设海洋强国打下良好基础,对《联合国海洋法公约》所提到有效管辖这一裁决争议领土的重要标准进行了分析,进而提出以下建议：中国应尽早确定u形线为岛屿归属线并加快制定海洋基本法等管辖依据;尽快建构起坚强有力的南沙群岛海域管辖主体;同时在管辖中实现管辖内容的丰富化、差异化、重点化。     

Linking Public Opinion and Foreign Policy in Russia

ABSTRACT

Empirical studies in democracies have revealed some degree of causal relationship between public opinion and foreign policy. A look at the relationship between the evolution of Russian foreign policy priorities, as evidenced in the Foreign Policy Concepts (2000, 2008, 2013 and 2016), and public opinion regarding foreign policy measured from 1997 to 2018 shows significant shifts in perceptions of the nation’s international image. The amity/enmity feelings towards others can be explained as responses to key international events, endorsing the thesis of a rational and reactive public. Overall, public opinion and the official policy line in Russia move in the same direction.
