This article explores issues associated with mutual claims of domestic violence in the context of research on gender and violence, and in the context of litigation tactics commonly employed by perpetrators in child custody and access cases. Quotations from parents involved in such cases illustrate why accurate assessment of mutual cliams requires complete information about social context and the analysis of patterns of domination, power and control in the relationship over time. Recent developments in Canadian law ought to enhance the ability of judges to take such evidence into account. The article aims to provide a lens through which to understand and assess such cases.  相似文献

A rationale for including analyses of outcome in evaluation of the impact and equity of changes in health care policy for the poor is presented. We first discuss problems in defining equity in and access to health care. Equity in access to health care requires equality of access only to those services that are believed to be efficacious. Three cost-containment strategies (restrictions in eligibility, coinsurance, and capitation) are then examined, and their limitations are discussed. Finally, directions for future research focusing on outcomes are suggested. Rather than using access to care to assess outcome, outcome is viewed as the framework for assessing access and equity.  相似文献

Cybercrime is considered an issue of both local and global concern. Therefore, this study focuses on the local experience in cybercrime control of different countries, including the Republic of Turkey. The article discusses issues in cybersecurity policy and analyzes the legislative framework of the Republic of Turkey on cybercrime issues. The findings underlie the continuing education policy for cybersecurity employees. The study concludes that Turkey handles the current cybercrime situation with efficiency.  相似文献

Why should research institutions engage in technology transfer? Some say it is about the money. Others say it is about public service and benefit. In the end, we measure what we value. If we only measure money, we confound the non-profit mission of the research institution. If we measure economic impact, the non-profit technology transfer office is often expected to become the economic developer, confusing real estate and business development with technology transfer, often without additional funding. These mission strains lead to overwhelm, fatigue, service shortcomings, and unhappy customers across all classes of stakeholders. This article suggests a return to center for academic technology transfer offices (TTOs) by focusing on a most important question for drivers of our present global knowledge economy––how well does a TTO facilitate access to knowledge protected by intellectual property of its faculty and institution? This article proposes that academic technology transfer performance should be evaluated by how well a TTO avails access to knowledge. Given that performance measures are also referred to as “metrics,” we call this preferred outcomes orientation an access metric.  相似文献

随着技术保护措施成为网络时代著作权法不可或缺的组成部分,“接触权”从公众接触政府信息的人权变成为了著作权人控制利用人接触作品的“私权”。当对作品的主要利用方式从占有载体转为直接体验内容后,著作权人是否享有控制他人接触作品内容的能力就显得相当重要,“接触权”突破了建构于18、19世纪的传统著作财产权体系,其正当性源自对网络环境下作品利用模式的适应,是应对科技发展所做出的合理设计。  相似文献

随着法院信息化建设的推进,裁判文书的公开方式呈现出从纸质到网络的发展趋势。加大了隐私扩散风险。针对法院是否应在网上公开裁判文书及公开的程度等问题,存在着三种观点:禁止说、区别说及同等说。为平衡公众知情权与个人隐私之间的冲突,对裁判文书中记载的敏感的个人信息或有损声誉的事实,需依据裁判文书公开的目的,决定是否将之公开在网上。同时,法院也应采取积极措施应对公众对隐私问题的关注,同等对待纸质公开和网上公开。  相似文献

Practical implementation has attracted significant scholarly attention in the European Union in the last decade, and the EU compliance literature started to focus more on the players in the domestic arena to help understand the application of EU law. However, a systematic analysis on interest group activities at the application stage is yet to be conducted. Relying on enforcement and management approaches, this article argues that interest groups act as providers of legal and technical information that are needed for correct application of EU law. Also, interest groups actively demand information from political actors to build internal capacity during this period. The results show that interest groups act as providers of information, but only in the national political arena. Moreover, motivation to learn is another factor that explains the level of access seeking during application, and this type of interaction takes place in both European and national venues.  相似文献
