海上保险代位求偿诉讼时效起算之特例研究

保险代位求偿权的诉讼时效起算历来存在不同理论观点,司法实务中也不尽统一。最高人民法院《关于适用〈中华人民共和国保险法〉若干问题的解释（二）》对此问题虽作出了明确规定,但理论层面的争论依然存在,特别是该规定是否适用于海上保险,值得探讨。从保险代位求偿权的权利性质出发,对《关于适用〈中华人民共和国保险法〉若干问题的解释（二）》相关规定出台背景加以深入剖析,并结合海上保险的特点和海商法时效制度的特别规定,对海上保险代位求偿诉讼时效起算的法律适用提出建设性方案,以期在保险人与有责任第三人之间的利益保护方面取得平衡,并为有权机关进一步完善保险代位求偿时效的规定提供参考依据。     

论雇主责任保险

责任保险的标的并不只是侵权责任,合同责任也是责任保险标的的一种,而雇主责任保险是以合同责任为标的。我国目前的雇主责任保险发展缓慢,是由于其承保范围与工伤保险相竞合,以及其他相关法律对雇主所承担的责任不明确所导致。找到了原因就可以对我国的雇主责任保险出现的问题更好地完善。     

Mechanisms Influencing the Development of Business Insurance Market in the World and in Poland

The work discusses changes in the business insurance market in the world and in Poland, as well as the impact of financial crisis on the development of this market. Special attention was paid to the mechanisms influencing insurance market operations. It concludes that the symptoms of the crisis of trust toward financial institutions are the most important consequence of the economic slowdown. This paper is the effect of the research conducted by the author for the research project No. 614538/2013. The paper uses the data published in the years 1996-2011 by the Polish Financial Supervision Authority and the Polish Chamber of Insurance, and the data of 2008-2011 published by the European Insurance and Reinsurance Federation Insurance Europe. The main purpose of the studies conducted by the author was to answer the question ＂what the effects of financial crisis are on the development of the business insurance market in the world and in Poland＂.     

农民参加新型农村养老保险的影响因素分析——以大连市为例

本文通过调查大连3个县级市农民参加新型养老保险的情况,实证分析了农民参加新型农村养老保险的影响因素,并针对现有问题和调查结果提出了可行性建议。     

两轮摩托车道路交通事故驾驶员损伤特征分析

目的找出两轮摩托车交通事故中多发于驾驶员而乘员较少发生的损伤特征,为查明案件提供线索。方法统计分析了有驾乘人员死亡的136例及有驾乘人员受伤的32例,以体表擦挫伤、挫裂伤或骨折作为统计对象,分别统计驾乘人员各部位发生损伤数并计算其出现的比例。结果驾驶员出现膝部损伤的比例（34．9％）高于乘员比例（i0．3％）,而驾驶员膝部损伤大多数发生在膝部前侧。结论膝部前侧损伤的当事人应高度怀疑其为真实驾驶员。     

Reducing the risk of insurance fraud by appearances of online surveillance

The efforts to tackle the growing problem of insurance fraud have focused primarily on examining suspicious claims and claimants after the accident has happened, ignoring a risk-reduction opportunity that exists even before the policy is purchased. The current paper aims to address this gap. In Study 1, a group of 40 participants were asked to input their personal details on a simulated comparison site. It showed that the numbers of obtained online quotes (i.e., how many times participants obtained them) and time spent to produce them by completing all the relevant information were positively correlated with misrepresentation of personal details for financial gain. In Study 2, a separate group of 120 participants took part in navigating a different simulated comparison site. The results suggest that equipping the site with mere appearances of online surveillance reduced the time that they took to input their details and minimized their manipulation for financial gain. Elaborating on the important theoretical and practical implications, the paper identifies a relatively easy and effective method of discouraging prospective policyholders from misrepresenting their details online.     

交通事故轮胎鉴定概述

轮胎鉴定是指涉及事故车辆的轮胎相关的鉴定项目,是交通事故技术鉴定中的重要项目之一,一般可分为轮胎痕迹鉴定和轮胎损坏情况及其与事故关系鉴定两种.本文着重论述了交通事故技术鉴定中上述两种轮胎鉴定的定义、鉴定步骤、鉴定方法,并通过典型案例来全面解读轮胎鉴定的具体鉴定过程.     

论公民海洋环境安全权——由渤海湾漏油事故引发的思考

2011年6月发生在我国渤海湾石油钻井平台的满油事故,给公民海洋环境利益造成巨大损害.目前受害公民实现索赔却略显艰难,其根源就在于公民海洋环境安全权的缺失.公民海洋环境安全权作为一种新兴的集合性权利,其产生和发展有着深刻的认识论、经济学和法学基础.该权利与其他公民权利并行不悖,并与其他法律制度相融合.本次渤海湾石油泄漏事故也在一定程度上拷问着公民海洋环境安全权的实践现状.     

有限元法在分析制动盘损坏原因中的应用

目的介绍有限元法在一起制动盘损坏原因鉴定中的实际应用,为同类型鉴定提供一种方法。方法在有限元软件中,对事故车辆损坏的制动盘进行建模。并依照实际情况设定两种边界条件,分别仿真计算出应力分布图。将应力分布图与制动盘的破损部位进行对比分析,以便确定制动盘的损坏原因。结果仿真计算得到两种不同的应力分布情况,其中一种与制动盘在事故中损坏的状况基本一致。由此确定,制动盘是在车体侧向碰撞固定物时损坏的。结论有限元法对交通事故鉴定是一种行之有效的方法,并且具有良好的应用前景。     

FTIR法在微量物证检验中的应用

本文利用FTIR法对交通肇事案件相关微量物证进行定性比对检验分析。在实际案件应用中表明,其检验分析结果准确可靠,其鉴定结论可认定或排除交通肇事嫌疑车辆。FTIR法的检验分析结果,可以为反映案件真实情况提供证据,鉴定结论可作为审理此类案件的证据,同时也可为民事索赔提供依据。
