医疗纠纷法医学鉴定质量评价模型的建立

目的建立医疗纠纷法医学鉴定质量评价模型。方法收集同济医学院法医学系近10年410例涉及医疗纠纷的法医学鉴定的案例,对影响医疗纠纷法医学鉴定质量的10个关键指标,运用SAS软件进行了主成分分析。结果通过统计学分析,筛选出6个能反映所有原指标变量主要信息的主成分,并依此结果推算出评价法医学系医疗纠纷的鉴定质量评价模型。结论在建立“医疗纠纷鉴定质量管理体系”时,应按影响鉴定质量的主成分设计相应的对策。     

Polygraphs: Erosion of the privacy right

The polygraph is a machine which invades previously private regions in the human being. Its operation is often viewed simplistically and lacking in danger. Such naivete is the subject of this comment. The paper considers the mechanics of polygraph operation, and its theoretical basis; the legal admissibility of the polygraph in a variety of settings, and lastly the impact the polygraph has upon our private lives.Clearly, the polygraph intrudes on the private regions of each individual, and this frightening fact is cause enough to consider the human, social and constitutional implications of its use. The project considers the reliability factor of the polygraph and its questionable use in personnel and business settings; its use in disciplinary procedures and labor arbitration, as well as reviews its place in judicial process and criminal review.Most critically the paper attempts to arrive at a constitutional basis for restrictions on its use in the private sector. Ingenious arguments have been made by opponents of the polygraph, and this paper reviews the substance and content of these constitutional arguments.     

Perceptions of affirmative action among its beneficiaries

Using data obtained through a separate study, interviews with women of color associated with and involved in the development of an affirmative action (AA) program were analyzed in light of Tyler's theories of procedural justice. Interviews were examined for respondents' implicit or explicit judgments of AA as fair or unfair in principle and in practice, and whether respondents used Tyler's six elements of justice criteria (representation, consistency, impartiality, accuracy, correctibility, and ethicality) in their assessments. Tyler's criteria are used by the respondents in their assessments. Beneficiaries perceive AA to be fair in both contexts, although fairer in principle than in practice. The issue of commitment was raised in several contexts as a salient concern of many of the respondents, and several concrete examples of deficiencies and successes in the ways AA is implemented are reported.

诉权入宪:构建和谐社会的宪政之道

诉权是公民的基本权利,是公民人权的重要内容,是公民获得司法救济、实现权利的前提和基础。基于诉权启动的司法审判程序是保障人权实现的最有效的机制。从宪政的角度把握诉权的宪法权利属性,站在构建和谐社会的高度认识诉权入宪作为宪政实现策略的实践意义,必须首先在宪法中明确规定诉权,提升诉权的保障水平,并通过诉讼法和实体法对诉权加以具体化和规范化,完善诉权的宪政保障体系。     

放宽行政诉讼起诉条件的诉权视角

诉权是当事人为保护其实体权益或者确认实体权利义务关系,请求法院以国家审判权的名义进行审理并作出裁判的权利。我国《行政诉讼法》设置的行政诉讼的门槛包括起诉人是公民、法人或者其他组织;所诉行为主体是行政机关和行政机关工作人员;所诉行为是具体行政行为;起诉人认为所诉行为侵犯其自身的合法权益。现有的行政诉讼起诉条件不利于行政诉权的行使,因此,应当修改《行政诉讼法》,通过扩大行政诉讼的受案范围,建立行政公益诉讼制度等方式以实现行政诉讼法的立法宗旨。
