近几年,随着中国经济的迅猛发展,中国企业逐渐发展为海外直接投资者,这将对世界经济的发展产生很大的影响。中国企业的全球化也将会进一步加速韩国国内产业结构的变化。中国企业与韩国企业不仅在世界市场上是竞争对手关系,在进入中国国内市场以及开拓海外资源等方面还可以成为战略伙伴关系。     

Getting Out the Vote With Voting Advice Applications

This article investigates the mobilization potential of online voter information tools known as “Voting Advice Applications” (VAAs). We argue that an observational approach utilizing survey data constitutes the best available method for causal inference where VAAs are popular—and we are thus most interested in VAA turnout effects—because randomized experiments are likely to run into double cross-over problems. We suggest that matching offers key improvements over existing methods to tackle self-selection into VAA use in observational studies. To improve confidence in selection on observables, we complement matching estimates with an extensive sensitivity analysis, including a placebo test. Empirically, we study the effect of smartvote, a popular VAA from Switzerland, on turnout in the 2007 Swiss federal election. We find that smartvote usage significantly increased the individual-level probability to vote. Our results suggest that smartvote was, on the aggregate, responsible for about 1.2 % points of the total tally with an estimated cost of nine Swiss Francs (7.5 U.S. dollars or 1.4 “Big Macs”) per additional vote. Promising as well, we find that the mobilization effect was more pronounced among younger voters. Our findings point to the value of VAAs compared to traditional get out the vote tactics.     

Lesbian and Gay Immigrants' Post-Migration Experiences: An Integrative Literature Review

This integrative literature review synthesizes recent empirical knowledge about lesbian and gay immigrants' post-migration experiences. Twenty-four studies with various designs are included. The literature shows that those immigrants encounter some opportunities but also many challenges on economical, social and identity levels, thus soliciting coping strategies. Results are synthesized under five topics: the delicate situation in which they find themselves for revealing their lesbian or gay sexual orientation; the racist and homophobic discrimination they can experience; their renegotiation of socioeconomic status; the identity and affiliation challenges they have to overcome; and the hardships that can impact their health.

Rib Variation at Multiple Locations and Implications for Histological Age Estimation*

Existing histological age estimation methods using the rib were developed mainly from the midshaft; however, in forensic practice, uncertainty of sampling location often arises due to fragmented or previously sampled ribs. The potential for error increases when sampling location is uncertain and utilizing a section beyond the midshaft (either anterior or posterior) may result in erroneous age estimates. Additionally, there is debate within the field regarding the minimum number of sections needed for accurate age estimation. The aim of this research is to determine the importance of the midshaft distinction for age-at-death assessment and the necessity of analyzing serial sections by evaluating histological variables at sampling locations along the length of the rib. Three seriated histological sections at three sampling locations (anterior, midshaft, and posterior) were obtained from sixth ribs of ten postmortem human subjects. Cortical area (Ct.Ar) and osteon population density (OPD) were collected from each section (n = 90). Significant differences were determined in Ct.Ar between sampling locations, demonstrating the variation present along the length of the rib. A comparison of OPD at sampling locations revealed significant differences, suggesting that sampling site is critical to accurate age estimates. When sampling location is uncertain, a more anterior section should be taken. Analysis of serial sections within locations revealed no significant differences in OPD or Ct.Ar, supporting the practice of collecting data from one section for age estimation. While an age estimate can be achieved through the analysis of one section, best practice suggests reading two sections to capture intraindividual variation.     

论我国成年监护制度的完善

笔者从论述我国人口老龄化现象的发展趋势入手,分析了现行民法中成年监护制度与解决人口老龄化问题的冲突,并引入国际社会应对此问题的经验。由此得出结论,我国成年监护制度需要作出的立法完善。     

口供的证明效力与补强

口供是指犯罪嫌疑人、被告人在刑事诉讼中就其被指控的犯罪事实以及其他案件事实向公安司法机关所作的陈述,具有真实性、自愿性.口供可划分为庭外供述和庭上供述,就审判阶段而言,庭外供述必须转化为庭上供述才能作为定案的根据.在共同犯罪中,同案被告人口供不能作为证人证言使用,即使同案被告人口供一致,仍需其他证据予以补强.     

A CASE FOR REFORM OF THE CHILD WELFARE SYSTEM

There are more than half a million children in our nation's foster care system. While foster care is intended to provide a temporary safe harbor for abused and neglected children, too many of these youth spend years in foster care limbo—experiencing a turbulent life in motion as they move from placement to placement, community to community, and school to school. Youth in foster care commonly fail to receive basic health and psychological care, and nearly 20,000 youth age out of foster care every year to an adult path of homelessness, unemployment, and despair. Our entire community must work together to more responsibly parent these youth. This article will address how lawyers and child advocates can advocate for new approaches and enhanced support on behalf of the voiceless and most vulnerable members of our community. It will address existing hurdles and systemic challenges that have helped to create the current disheartening status quo. The article will then discuss strategies that advocates can employ to turn the corner on behalf of these youth at risk.     

城市公用事业民营化法律路径的比较分析

传统观念认为城市公用事业应当由政府所有和经营以维护公共利益,但是20世纪80年代以来,世界各国纷纷进行城市公用事业民营化的改革。当前,在我国,城市公用事业旧的经营模式的弊端已经暴露,越来越多的人开始认识到政府在城市公用事业供应中应承担责任并不等于政府直接生产产品或服务,实际上,私人生产和政府安排的有机结合更有效率。公私合资经营、合同外包和特许权经营都是实现城市公用事业民营化的有效法律路径,但是应依据具体项目的特征慎重选择甚至混合使用。     

论倾诉类文章著作权的归属

倾诉类文章是近几年才兴起的一种文字作品形式。由于倾诉类文章的署名比较混乱,导致此类文章著作权归属不明。按照倾诉类文章的性质判断,署名采访人或者撰稿人的做法并不妥当。一般而言,倾诉类文章多是由记录整理人在倾诉人口头陈述的基础上整理而成,因此,倾诉类文章属于整理作品,倾诉人享有口头作品的著作权,记录整理人享有整理作品的著作权。考虑到倾诉人的实际情况,为了有利于倾诉类文章著作权的行使,记录整理人可以与倾诉人签订著作权转让或许可使用协议,将倾诉人享有的著作权转让或许可给记录整理人使用。
