论我国存款保险制度的构建

存款保险制度设立的目的在于保护存款人利益,维持存款人对金融机构的信心,保证金融体系的稳定,最终维护社会公共利益。目前,我国存款保险制度的构建尚存在以下障碍:“资金援助”供需的结构性矛盾,差别费率与银行不良资产,金融立法滞后,缺乏一套客观公正的银行信用评级体系。我们应从立法体例和目标、存款保险机构、投保金融机构、存款保险资金以及存款保险费率等五个方面来构建我国的存款保险制度。     

Public Sector Risk Financing: Exploring the Potential Use of Weather Derivatives by Fire and Rescue Services

The floods of 2007, experienced across much of England, resulted in local authority organisations, including Fire and Rescue Services, mounting large-scale responses and incurring additional and unexpected expenditure. Although central government activated funding schemes, some local authorities fell below the thresholds set and had to absorb the additional costs. This raised a question of what alternative methods were available to allow these local authority organisations to finance such unexpected costs. Weather derivatives are widely used in certain sectors to manage the financial risk that arises from undesirable weather conditions and the objective of this research is to explore the reactions of an FRS towards the use of these financial instruments in managing additional costs, such as those arising from the 2007 floods. Our findings suggest that a combination of risk-aversion, lack of specific financial knowledge and comfort with the status quo seem set to stifle development of weather derivatives as an innovation in public sector risk financing. However, this exploratory study suggests that the method has some merit and is at least worthy of further examination.

郝铁川与童之伟两位先生关于“良性违宪”的争论在法学界引起了强烈的反响,井延续至今。但时至今日,讨论仍未触及问题的核心．本文通过对规范与现实,良法与恶法,社会后果与形式违宪等争论的焦点进行总结和检讨,发现“良性违宪”反映的实际上是英雄主义与法律至上的对抗,问题的核心在于执政党仍抱有英雄主义情怀。因此,执政党改采法律至上立场,服从法律统治才是当代中国法治建设的关键。     

Diasporic citizenship and militarization: Punjabi soldiers in the world wars

This article delves into the uses of history and examines how the enlisting of Indian soldiers – particularly from Punjab – into the British Indian Army during the First and Second World Wars has been memorialized and remembered in contemporary Britain. This issue has become particularly salient in the light of the politics of the so-called ‘war on terror’ or ‘new imperialism’, which Paul Gilroy and Vron Ware argue has heightened tendencies towards militarism in British society. Using examples from the public sphere – remembrance day events, TV documentaries and army recruitment fairs – as well as interview material, I argue that Britain's Punjabi communities have been organizing in order to weave themselves into the national tapestry by memorializing role played by Punjabis in the First and Second World Wars – iconic to the national fantasy, using this forgotten history to demand recognition from the state and stake a claim for citizenship. In the ‘new imperialism’, however, it is not equally possible for Sikh and Muslim Punjabis to argue for their inclusion on the terms of militarized citizenship, and the various chords within the diaspora seem to be increasingly disharmonious, effacing their composite and shared colonial history.

Naturalization ceremonies and the role of immigrants in the American nation

Although immigration is an essential element in the American national story, it presents difficulties for constructing national membership and national identity in terms of shared intrinsic values. In this article, I analyze speeches made at naturalization ceremonies during two time periods (1950–1970 and 2003–present) to examine the evolving roles of immigrants, as articulated to immigrants themselves. Naturalization ceremonies are a unique research site because the usually implied nationalist content is made explicit to brand new members of the nation. I find a shift in the framing from immigrants as potential liabilities and weak links in the earlier period to immigrants as morally superior redeemers of the American nation in the later period. I discuss the significance of this shift and the relationship between the roles presented at naturalization ceremonies and the discourse found elsewhere in the public sphere.
