Sudden Unexpected Death Due to Left Subclavian Artery‐esophageal Fistula Caused by Fish Bone

A 53‐year‐old woman was admitted to the hospital due to unexpected dizziness and died the following morning. To investigate the cause of death, a forensic autopsy along with histological examination was performed 3 days after her death. The major findings of the autopsy were that a fish bone had pierced the left subclavian artery after perforating the esophagus with 680 mL of blood in the stomach and bloody and tarry contents were present in the intestines, and the cause of death was confirmed to be subsequent hemorrhagic shock. Unfortunately, none of her family realized that she had eaten a fish 4 days before the tragedy until the fish bone was found. The present case is rare and instructive. The histopathological findings of left subclavian artery‐esophageal fistula induced by a fish bone can be used as a reference in forensic practice.

国家工作人员也可以成为本罪主体;“近亲属”含义应以《刑事诉讼法》第82条第（六）项规定为准;利用影响力受贿罪中的“关系密切人”范围大于“特定关系人”范围,判断是否是关系密切人不应限于平时双方交往是否密切,而在于行为人所具有的影响力能否使国家工作人员利用职务之便为请托人牟取不正当利益;“离职的国家工作人员”指原系国家工作人员并具有国家工作人员身份、要求国家工作人员为请托人谋利时已不再行使国家工作人员职能的人。

“留守儿童”违法犯罪问题已经引起了理论界与实务界的高度关注。我国目前对“留守儿童犯”进行的心理调研仅局限于对“留守儿童犯”的普遍性考察,缺乏有针对性的犯罪心理调查。实证分析法是犯罪学调研的基本方法。通过对“留守儿童犯”的认知心理和社会化环境两部分展开深入调研,在需求、自信与自我认同、行为模式、自控能力、违法犯罪认识性以及父母家庭关系、学校关系、同辈关系和其他人际关系等方面进行了全面系统分析,可以透视“留守儿童‘’’犯”的犯罪心理现状,同时为提出有针对性的预防措施提供事实依据。     

Ideological Congruence among European Political Parties

Do European political parties represent the ideology of their voters well? This research aims to provide an empirical appreciation of the levels to which Members of Parliament (MPs) ideologically represent their electorate within political parties in 12 European countries. The variable used is left–right self-placement and representation is measured through congruence. Three main hypotheses are tested. First, MPs express greater ideological extremism than voters. Second, MPs have biased perceptions on the positioning of their electorate. Third, New Left parties exhibit higher levels of representation than the other parties. This article's findings reveal that only the second hypothesis can be supported without restrictions.

Abstract

It is not clear that "cultural recognition" should be a central goal of leftist politics. The idea that cultures have value simply by virtue of being cultures seems absurd, so it might be better to talk simply about eliminating prejudice and stigmatisation.     

Embracing death: the Western left and the Iranian revolution, 1978–83

The Iranian revolution of 1978–83 was a disaster for Iranian leftists, who, having worked for the overthrow of the Shah, soon found themselves being persecuted by the hard-line followers of the Ayatollah Khomeini. This paper looks at the response of Western leftists to the unfolding of the revolution, considering, first, to what extent Marxist and class-based analyses helped explain the revolution and, second, why so many Western leftist groups and individuals defended the Khomeini faction even as it moved against secular leftists and liberals. It concludes that an uncritical identification with Khomeini's declared ‘anti-imperialism’ distorted the views of those who would ordinarily have opposed his regime on class grounds, and that such a misreading was aided by an inadequate distinction between bourgeois democracy and dictatorship.     

The first initiatives

The Greek election of May 2012 failed to produce a government, resulting in repeat elections six weeks later. This shock outcome was a symptom of a broader delegitimation of the national political system. Over the past decade Eurobarometer data show a much more extensive loss of confidence in political institutions in Greece than in the European Union as a whole. In a first phase, rising political discontent was managed within the traditional political framework through alternation in power between the two major parties. In contrast, the second phase, following the outbreak of the Greek sovereign debt crisis, led to the dramatic fragmentation of the party system and changed the mode of government formation. This process is not reversible and entails serious democratic dangers.

论行政刑法规范的适用与罪刑法定原则

行政刑法规范是规定对违反行政上义务的行为予以相应刑罚处罚的法规,在我国仍然是基于刑法上明确规定的罪名而予以制裁的法规。它并不是独立于刑法的其他的特别部分,而是刑法固有的一部分。因而对于违反行政法规的行为,在刑法规定有可以不适用刑法总则的特别规定时,适用该特别规定,而在有关犯罪以及刑罚的基本原则方面仍应适用刑法典的规定。至于空白行政刑法规范,由于犯罪构成事实的基本轮廓以及刑种与刑度已经有明确规定,而只是将其一部分构成要件授权其他法律或行政命令补充,因而并不违反罪刑法定原则的基本要求。
