缺席的不同情形与缺席审判程序的完善

在诉讼实践中,当事人缺席有三种不同的情形,而现行《民事诉讼法》只对其中的一种情形做了规定,凸显出立法的先天不足。作者认为,应当根据缺席的不同情形采取不同的方式处理,而不应一律做出缺席判决。在修订《民事诉讼法》时应增设预防和救济机制和专门的缺席审判程序来处理不同诉讼主体在不同的诉讼阶段缺席的情况,以完善我国缺席审判制度。     

规范司法鉴定程序，完善司法鉴定制度——浅析《司法鉴定程序通则》制定及其相关内容

为了深入贯彻全国人大常委会《关于司法鉴定管理问题的决定》(以下简称《决定》),为了进一步规范司法鉴定活动,新制定的《司法鉴定程序通则》(以下简称《通则》)自2007年10月1日起施行。这是继2005年9月30日公布的《司法鉴定机构登记管理办法》和《司法鉴定人登记管理办法》颁布实施后,司法部出台的有关司法鉴定管理的又一个与人大《决定》相配套的重要规章。结合工作实践和思考,就新版《通则》及其相关内容作一简要分析。     

农村人居环境改善与妇女发展的关系思考--基于对河北农村妇女参与文明生态村建设的考察

本文认为,落后的农村人居环境是制约农民生活质量的改善和和持续发展的重要因素,而文明生态村建设为发挥农村妇女潜能,参与改善农村人居环境提供了很好的平台,她们既是积极的建设者,也是主要的受益者。但基层农村社会男性领导者对女性作用的忽视,在很大程度上限制了妇女潜能的发挥。因此,在改善妇女居住的生态环境的同时,更重要的是改善性别平等的人文社会环境。

Investing in Not‐for‐Profit Sector Capacity: The Australian Capital Territory's Community Sector Development Program (CSDP)

In 2013 the Australian Capital Territory (ACT) government's Community Services Directorate (CSD) initiated a suite of projects designed to address the not‐for‐profit (NFP) community services sector's capacity to adapt to a rapidly changing policy and operational environment. In common with other Australian governments, the ACT relies upon NFP organisations to deliver a wide range of community‐based human/social services. The procurement of services rendered to, or on behalf of, government by a third party provider under contract accounts for about 94% of the CSD's investment in the NFP community services sector. The ACT government, therefore, has a vested interest in ensuring that NFP providers are operationally capable, financially viable, and economically sustainable. Accordingly, the government launched a Community Sector Reform Program (CSRP) focussing on red tape reduction, sector development, and the establishment of a community sector outcomes framework. What lessons might the CSRP offer for other jurisdictions?     

Functioning Achievements in Urban Bangladesh: A Comparison with Rural Areas

In view of the differences in the nature and concept of poverty across rural and urban regions, this article argues that a nationwide standardised poverty reduction strategy package may not be equally effective in these two regions. This article examines the limitations of existing poverty assessment approaches used in Bangladesh and identifies various indicators that are responsible for the achievement of higher level functioning in urban regions in contrast to rural areas. The methodology of the study is based on 917 samples of poor persons with microcredit collected from nine districts of Bangladesh. Significant differences have been observed in the indicators of poverty for rural and urban areas. The results from our participatory study reveal that the urban poor are more inclined towards social functioning achievements such as voting, decision-making at both household and work levels, having a voice at local meetings and co-operatives, whereas the rural poor are still demanding the most basic requirements.
