Ethical treatment of youthful offenders: Issues for psychologists

The treatment of youthful offenders in correctional settings presents psychologists with a range of challenging ethical concerns. The inherent discord between psychologically based goals and correctional objectives yields a complicated ethical landscape for clinicians. These concerns can be partially addressed through the APA's revised Ethical Principles of Psychologists and Code of Conduct (2010) and field-specific practice guidelines but also require extensive further guidance to ensure competent and ethical practice. This article analyzes current information about youthful offenders, outlines disparities in stakeholder goals, provides an overview of ethical considerations of treating youthful offenders in correctional settings, and offers recommendations for education and practice.     

Animal ethics and the political

Some of the most important contributions to animal ethics over the past decade or so have come from political, as opposed to moral, philosophers. As such, some have argued that there been a ‘political turn’ in the field. If there has been such a turn, it needs to be shown that there is something which unites these contributions, and which sets them apart from previous work. We find that some of the features which have been claimed to be shared commitments of the turn are contested by key theorists working in the field. We also find that the originality of the turn can be exaggerated, with many of their ideas found in more traditional animal ethics. Nonetheless, we identify one unifying and distinctive feature of these contributions: the focus on justice; and specifically, the exploration of how political institutions, structures and processes might be transformed so as to secure justice for both human and nonhuman animals.

Men and manners: Kantian humanism,rhetoric and the history of ethics

Modern humanist ethics (more Kantian than is sometimes thought) is driven by a will-to-perfection in the form of ideals of self-transcendence. This perfectionism entails a (would-be) exclusion or marginalisation of certain elements of ‘pre-Enlightenment’ ethical cultures bearing on rhetoric, manners and self-empowerment. This essay provides a set of conceptual-historical arguments preliminary to reinserting these disparaged elements into the forefront of a progressive ethos which, it is claimed, cannot afford to be exclusively dependent on an amalgam of Enlightenment and Romantic ideals. Ethics is irreducible to the realm of ideal and values, and there are other sorts.

The Moral Imaginary of Discourse Ethics

Abstract

The central claim of this essay is that Habermas' pro gram of discourse ethics fails to establish the necessary immanent connection between the universality of discourse ethics and the quasi-transcendentalism, which is supposed to provide its ground. Habermas' attempt to avoid the spectre of subjectivism leads him to develop an understanding of universalism that hinges on a critical error, the confusion of subjectivity with ethical sub stance. Using Castoriadis' theory of the imagination to illuminate this failure, I demonstrate the way in which Habermas' moral theory of discourse inadvertently harbours a moral-imaginary horizon, a pre-political kernel which undercuts its capacity to serve as a universalist ethic.     

Discourse Ethics and the Normative Justification of Tolerance

Abstract

The following paper considers the extent to which discourse ethics can adequately respond to Habermas' own call for normative justification for the expectation of tolerance. It concludes that discourse ethics is able to lend its services to the flagging fortunes of the idea of toleration, not by seeking to underscore this idea with rationally compelling argumentation, but by offering insights into the possibilities opened up to a life which accepts this principle.
