对韦伯科层制的一种三维解构及其结论

本文通过对韦伯官僚制受到的批判与发展之争的省思,先对韦伯官僚制用制度维和理念维解构了其思想,在此基础上提出了伦理维向度。然後通过分析认为後工业社会的电子政务模式所承担的是提升效率的技术角色,认为目前的电子政务组织模式尚无法担当起超越官僚制的使命,最後做出了伦理要素将成为信息时代韦伯官僚制度存在和演变取向的判断。

劳动者作为社会发展的重要力量,具有生命存在的终极意义及追寻生命价值的本能渴望.但是他们生命的存在以及价值的实现不断面临现实的挑战,敬畏与关爱是对劳动者生命的基本的道德态度,工会在其中可以发挥重要作用.     

Is cross-border cooperation underpinned by an ethical code of values? A theoretical analysis

Is there an ‘ethical code’ of values that underpins cross-border cooperation activities? By focusing on people as ‘agents’, the article argues that citizens and individuals in their integral development have been neglected so far when the development of cross-border spaces is scrutinized. This study aims to provide an alternative theoretical framework through which cross-border activities can be analysed and operationalized. This is done by synergically reading Benedict XVI’s ‘Caritas in Veritate’ and Sen’s ‘Development as Freedom’. It is suggested that the ethical dimension of cross-border cooperation activities needs to be scrutinized on the ground that cross-border spaces are neither ethically neutral, nor inherently inhuman and opposed to society. They are instead part and parcel of human activities and must be structured and governed in an ethical manner. It follows that ethical values are the means of cohesion in cross-border zones. Without including them in the analysis, real cohesion cannot be achieved.

Using a theoretical framework of posthuman and feminist theory, not least the work done by Jacques Derrida and Donna Haraway, this vade mecum asks what it might mean to engage ethically with that which is not supposed to exist, but which haunts us nonetheless. In other words: what does it mean to move, live and engage with spectres in digital times?     

实然与应然——法律伦理之可能

法律伦理及法律伦理学是否可能取决于从法律伦理行为事实能否推导出法律伦理行为应该。然而,单纯从行为事实是推不出行为应该的,只有通过法律目的判断以及法律伦理行为事实和法律目的之关系判断才能从法律伦理行为事实如何推导出法律伦理行为应该如何。法律伦理行为之应该经由人们的实践活动可以变为现实,其具体保障在于法律伦理良心、法律伦理名誉及底线法律伦理的法律化。

反思与批判:日本神道教伦理思想审视

神道是在日本固有的民族信仰基础上发展起来的精神行为,是日本固有的民族宗教,神道生活中求诸神意并使之成为自己生活规范的虔敬态度,即日本人所谓的"真心",是神道具有了伦理特性;神道伦理反映了日本民族意识的重要侧面,是日本伦理思想的核心和基础,代表了日本人基本的价值取向和精神追求。神道伦理的基本理念以及在此基础上融合儒佛等外来思想文化形成的神道伦理规范,成为日本传统的伦理规范,构成日本民族文化价值的中核,对日本的历史、政治、经济、文化、国民生活产生了重要影响。     

先秦礼俗与古希腊礼俗之比较

无论是中国的先秦时期,还是西方的古希腊时期,礼俗在中西道德伦理生活中皆占有重要地位。然而,不同的文化传统、社会背景酝酿出不一样的礼俗:中国人的文化传统是内敛的、谦虚的,从而更注重渗透在礼俗中的文化内涵;而古希腊则无拘无束,纵情喧嚣,其礼俗多为一些具体的外在形式;与古希腊礼俗更加注重人文关怀不同,中国先秦时期的礼俗则有更多的政治意蕴。中西礼俗的不同,在一定程度上造成了中西方生活方式及文明走向的差异。因此,比较先秦和古希腊礼俗文化,对于我们探索中西礼俗的渊源、发展和价值有着重要的作用。     

The Ethical Irrationality of the World: Weber and Hindu Ethics

Abstract

This paper argues that Weber ought to be read as a comparative ethicist who brings his German intellectual inheritance, especially Schopenauer and Nietzsche, to a dialogue with ethical traditions in India and China. It shows that Weber not only had a supple understanding of the tensions within Hindu ethics, his own account of value often closely corresponds to Hindu axiology and was enriched by an encounter with it.
