比较法视野下的劳动者集体争议行动之法律规制

利益调整所引发的集体争议行动是市场经济背景下劳资争议的重要型态。基于劳资自治的保障需求,大多市场经济国家(地区)对劳动者集体争议行动这种侵权行为予以有限制的法律保护。我国因加薪所引发的集体停工频发,凸显了法律对集体争议行动失范及其法律秩序重构的必要。借鉴国外立法例,结合国情,我国宜采取消极立法模式,通过特殊的法律责任豁免制度和特殊的劳资利益争议处理程序,以规范劳动者集体争议行动。     

从项目嵌入到组织社会:村级集体经济发展的新趋势及其类型学研究

发展和壮大村级集体经济是乡村振兴战略的重要内容。既有研究在探讨村级集体经济问题时较多地聚焦于其功能和目的、历史与现实、发展原则和要求,而较少关注到村级集体经济的发展趋势及其在不同村庄所呈现出的异质性特征。基于"项目嵌入-公众参与"的二维分析框架和浙北J市S镇的田野调查发现:新时期村级集体经济发展出现了由依赖纵向国家项目嵌入向组织和激活横向社会网络转变的新趋势,其发展形式呈现出政社耦合型、社会嵌入型、政治嵌入型和双重脱嵌型四种理论类型。村级集体经济发展类型上的差异也导致了其在村庄治理实践中发挥的分配、互惠、悬浮、兜底保障等不同功能,以及国家治理机制上的分殊。此外,村级集体经济的发展在不同类型的村庄面临着不尽相同的内外限制性条件。     

中东欧国家与冷战后北约的新变化

冷战结束后,北约并未因对手的消失而瓦解,而是通过扩大组织、出台新战略和实施新行动找到生存依据并获得新的发展。在北约的新扩大、新战略和新行动中,中东欧国家不管是主动参与还是被动接受,都起到了不可低估的作用。中东欧国家的加入令北约成员国从16个增至30个,拓展了北约的疆域。东欧剧变带来的国际局势的变化,特别是前南斯拉夫地区发生的战争促使北约提出新的战略概念,波黑战争、科索沃战争和马其顿危机更是成为北约新战略的试验场。中东欧国家参与了北约在波黑、科索沃、阿富汗和伊拉克的行动以及乌克兰危机发生后针对俄罗斯的军事部署,做出独有的贡献。同时,中东欧国家的加入也给北约在决策效率、行动能力、责任分担和价值观方面带来新的挑战。不过,由于中东欧国家的军事力量和国家实力有限,在北约内部的影响力不大,这些挑战不足以危及北约的生存。     

会计信息与工资集体协商--理论与实务的几个问题

工资集体协商的实质是经济利益的协商,协商的效果和质量取决于协商手段的运用,特别是协商过程中财务信息的运用。研究工资集体协商过程中涉及的若干会计问题,目的是引导协商主体,充分利用财务信息,提高工资集体协商的质量,实现共赢。     

Transnational public goods provision: the increasing role of rising powers and the case of South Africa

The paper delineates three debates, which will be conflated. One line of discussion relates to public goods at a transnational level. Here, the referencing of debates regarding the characteristics of ‘a common good’ will be of significance. A second strand addresses the group of countries known as the ‘rising powers’ and the role these countries could play towards a globalised common good. A third discussion thread analyses South Africa as a case study for the main rising power on the African continent. By creating connections between the lines of discussion, this paper drives forward the debates on how the role of rising powers can be conceptually repositioned in the light of a changing global context, and explores how these countries can respond to global challenges.     

工会应急协同能力评价方法研究

工会是职工群体性事件应对的重要主体之一,而应急协同能力又是决定其应急事件处理效果的一个重要因素。因此,对应急能力的评估至关重要。研究分析了职工群体性事件的动态演化过程,找出其应急协同能力影响因素,并依据协同分析方法构建了工会应急协同能力评估指标体系。研究首次提出了工会应急协同能力及表征,即基础应急协同能力、应急处置协同能力和事后恢复协同能力,并通过实例验证了该模型的合理性。据此,在社会多主体治理框架下提出了提升工会应急协同能力的基本策略。     

预告期性质研究 —— 基于劳动者和用人单位双重视角下的分析

预告期作为劳动者辞职或用人单位预告解雇的期限,其性质的阐明关乎实践中诸多问题的厘清。在肯定预告解除权为形成权的同时,认可预告期"始期说"的内在性质,在"程序说"与"条件说"的外在性质辨析,在法律、集体合同、劳动合同关于预告期规定的选择中不囿于现有学说,在适当倾斜保护劳动者利益以及增强劳动力市场灵活性的同时,提出区分预告解除主体,根据具体情况分别适用。     

Managing the difficult past: Ukrainian collective memory and public debates on history

This article analyzes the status of difficult historic events in Ukrainian collective memory. Difficult elements of collective memory are defined as those which divide society on basic matters, such as identity and national cohesion, and events which are being actively forgotten because of the role of Ukrainians as perpetrators. Three such issues were analyzed: World War II and the role of the Ukrainian Insurgent Army (UPA), the Holocaust, and the ethnic purge of Poles in Volhynia and Eastern Galicia in 1943–1945. Utilizing data from quantitative and qualitative studies, the author showcases the significance of these issues for contemporary Ukrainian identity and Ukraine’s relations with its neighbors. In particular, the evaluation of World War II and the role of the UPA in Ukrainian history polarizes Ukrainian society to a great degree. At the same time, this element of national history is used to construct a common, anti-Russian identity. The difficulty of relating to the memory of the Holocaust and the ethnic purge in Volhynia is of a different character. These events are problematic for Ukrainian collective memory because they demand a painful settling of accounts with the past. At present, only Ukrainian elites are willing to work on these subjects, and only to a limited degree, while the common consciousness either denies or ignores them altogether.     

New Unionism at the Grassroots: The Amalgamated Clothing Workers of America in Rochester,New York, 1914–29

Labor movements have always found it difficult to reveal and transform the social relations that constitute markets. The growing transnational movements of goods, capital, and services in themselves have therefore not triggered closer trade union cooperation across borders. Transnational collective action also requires conscious choices and a mutual understanding that solidarity across borders is warranted. For this reason, this special issue of Labor History assesses the role that politicization processes play in triggering transnational union action.     

“We feel that our strength is on the factory floor”: Dualism,shop-floor power,and labor law reform in late apartheid South Africa

ABSTRACT

This article explores the transformation of South African labor relations during the 1980s. In 1979, prompted by new shop-floor militancy, the Wiehahn Commission recommended that black workers, previously excluded from state labor machinery, be permitted to join recognized trade unions. Most discussions of this shift in apartheid labor relations focus on the ensuing debate within the black unions, torn between preserving their independence or securing state legitimation. This article looks instead at the related debate about ‘levels of bargaining’: should emergent black unions demand to negotiate at the factory level, where they had secured shop-floor strength through organizing and democratic practice, or pursue the benefits of the corporatist bargaining structures that had long excluded them and had privileged white workers? The eventual drift towards corporatism, I argue, imprinted the character of the South African labor movement into the post-apartheid era. An understandable desire to wield influence at the level of the national political economy eroded the tradition of workers’ control, shop floor democracy, and struggle unionism that black unions had forged during the 1970s and 1980s.
