行政规范性文件的法律地位研究

行政规范性文件是由行政机关制定的规章以外的行政管理行为规则。我国在入世议定书已经承诺行政规范性文件将予以公开,因此,加入WTO以后其将成为行政法治中的一个重要问题。然而,行政规范性文件的法律地位(如性质、调整方式、规范效力等)在行政法学体系中却无系统理论,学界关于规范性文件的诸认识不统一,其在实然方面的规制方式应规范并应具有法律地位。     

Exit, Loyalty, and Collective Action Among Workers in a Simulated Business Environment: Interactive Effects of Group Identification and Boundary Permeability

Past research on the effects of boundary permeability and tokenism (open boundaries with restricted access) suggests that when options for individual mobility exist, members of low status groups tend to exit their group and attempt to enter higher status groups. We hypothesized that the effects of boundary permeability on preferences for individual vs. collective action would depend upon prior levels of in-group identification, such that people who are more identified with their group would remain loyal and choose collective action, even under conditions of high boundary permeability. To test this hypothesis, a 2 (High vs. Low Group Identification) × 2 (High vs. Low Permeability) experimental design was employed to assess preferences for exit and loyalty in the context of a simulated business environment. For both rating measures and behavioral choices, the interaction hypothesis was supported. Implications for group loyalty and strategies of tokenism are discussed.

为有效解决现行农村土地问题,通过对现行农村土地法律制度的历史反思,主张在土地立法模式上打破地方公有制,选择农村土地国有化模式并对农村土地国有化之必要性、可能性等方面进行论证,借此寻求土地立法新路径,俾使新的农村地权模型既不与现行主流意识形态相悖,且适于中国具体国情,使土地利益分享机制既不违背公平正义,又足以提高土地效率、增进土地价值.     

'Manifest Madness': Towards a New Understanding of the Insanity Defence

This article introduces a new concept which can serve as a theoretical frame for understanding the way in which insanity is proved for the purposes of the criminal law. With reference to George Fletcher's concept of 'manifest criminality', it introduces the concept of 'manifest madness'. This concept constructs madness (a shorthand for the types of mental abnormality known to the criminal law as insanity) in criminal law as evident to lay observers, and its meanings, which are derived from collective knowledge of it, as encoded in the defendant's acts. Through an historical analysis of the way in which insanity has been proved in criminal law, the article argues that 'manifest madness' is useful for understanding how knowledge about insanity is structured in the criminal courtroom. The concept of 'manifest madness' provides a frame that incorporates evidentiary and procedural features of the insanity defence that have resisted systematic theoretical analysis.

Venezuela after the Caracazo: Forms of Protest in a Deinstitutionalized context

Protest has become in recent years one of the most visible features of everyday life in urban Venezuela. Since the middle eighties, but in particular after the Caracazo of 1989, the Caraqueños as well as residents of other cities of the country have had to adjust themselves to the hundreds of demonstrations that are held every year. In this article I shall present the most common forms of collective action over the last ten years, relating them to the process of deinstitutionalization that has developed during the decade. I shall discuss why extra-institutional forms of collective action of a confrontational and violent nature have spread from marginal actors to organizations that in the past had at their disposal alternative channels for presenting their complaints and demands.     

鸡球虫三价弱毒疫苗对鸡的免疫效果研究

将100只3日龄罗曼雏鸡随机分成空白对照组、攻虫对照组、Ⅰ组(1个免疫剂量)、Ⅱ组(2个免疫剂量)和Ⅲ组(0.5个免疫剂量)共5个试验组,每组20只鸡,对研制的鸡球虫三价弱毒疫苗的安全性和免疫效果进行初步评价。结果,各组的相对增重率依次为100.0%、86.8%、81.8%、89.2%和89.7%;攻虫后第10 d剖检所有鸡,各组肠道病变记分依次为0、2.7、2.2、2.3和2.6;免疫期间,Ⅰ、Ⅱ、Ⅲ组的OPG值依次为5.7×106、6.7×106和7.3×106;攻虫期间,攻虫对照组的OPG值为12.3×106,Ⅰ、Ⅱ、Ⅲ组的OPG值依次为7.2×106、8.5×106和9.0×106。攻虫后各组的死亡率依次为0、5%、0、10%和0;各组的抗球虫指数依次为200.0、115.8、135.8、140.2和143.7。结果表明,该三价弱毒疫苗抗柔嫩艾美球虫的效果并不理想,还需要进一步改进和完善。
