竞技体育暴力行为之刑法介入

目前，竞技体育领域强调行业自治，排斥刑法介入，致使体育暴力行为日益猖獗。刑法应当介入竞技体育暴力行为，这符合刑法谦抑性的要求、社会公众的要求以及国外司法实践的作法。刑法介入竞技体育暴力行为，应当以严重脱逸社会相当性理论为依据，遵循有限介入的原则，严格确定刑法介入的范围和程度，疏通刑法介入的渠道，并依照一定的程序予以介入。     

八二宪法实施状况评析

评价八二宪法实施状况在理论上是一个非常复杂的系统工程,它涉及到评价方法、评价对象、评价标准等等因素的影响。从总体上来看,八二宪法的绝大多数条款在立法实施层面都得到了比较好的体现,全国人大及其常委会已经通过制定具体法律的形式将现行宪法中的主要条文加以细化,故考察现行宪法具体条文的实施状况应当从考察这些具体法律入手。应当对八二宪法实施状况建立一个兼具客观标准和主观评价相结合的科学评估机制,还应当引进诸如宪法时刻、宪法阻却等等可以明显判定宪法实施状况的基础性概念,才能更有效地来评价八二宪法实施的真实状况,从而为完善宪法实施制度、加强对宪法实施的监督提供准确和有效的分析数据。     

Security Identities and ‘No More,No Less’ Operations: On Making NATO's Involvement in Darfur Possible

This article explores NATO's support mission to the African Union's peacekeeping operation in Darfur, Sudan between 2005 and 2007. NATO policies are commonly presented as functional responses to events, but how did a conflict on the African continent become the Atlantic Alliance's business? In this essay, a poststructuralist practice-oriented approach is used to understand the way in which discursive practices progressively establish a policy option as ‘natural' in a given situation. It is argued that the normalization of NATO's support mission to the African Union in Darfur and the integration of this operation in NATO's security identity were the result of complex and conflict-ridden social interactions between different discursive practices supported by different actors.     

戒毒人员复吸的原因及综合干预模式探析

戒毒人员脱毒后复吸率很高,半年内复吸率一般为90%-99%。戒毒人员复吸与吸毒者自身的心理、生理因素,以及与社会、家庭环境等方面有关。寻找引发复吸的主要原因和规律,探索行之有效的预防治疗措施,是提高戒毒成功率,延长操守时间的根本途径。通过公安实践和文献调查的方法,研究我国戒毒人员复吸的相关问题,结合我国禁毒工作实际情况,适合我国国情并具有可操作性的戒毒模式应为复吸综合干预模式。     

An accuracy assessment of forensic computerized facial reconstruction employing cone-beam computed tomography from live subjects

The utilization of 3D computerized systems has allowed more effective procedures for forensic facial reconstruction. Three 3D computerized facial reconstructions were produced using skull models from live adult Korean subjects to assess facial morphology prediction accuracy. The 3D skeletal and facial data were recorded from the subjects in an upright position using a cone-beam CT scanner. Shell-to-shell deviation maps were created using 3D surface comparison software, and the deviation errors between the reconstructed and target faces were measured. Results showed that 54%, 65%, and 77% of the three facial reconstruction surfaces had <2.5 mm of error when compared to the relevant target face. The average error for each reconstruction was -0.46 mm (SD = 2.81) for A, -0.31 mm (SD = 2.40) for B, and -0.49 mm (SD = 2.16) for C. The facial features of the reconstructions demonstrated good levels of accuracy compared to the target faces.     

Getting Caught and Getting Hitched: An Assessment of the Relationship Between Police Intervention,Life Chances,and Romantic Unions

Little research has assessed the link between formal police intervention, financial hardship, and the formation and quality of romantic relationships. Using data from the Rochester Youth Development Study, we contribute to this literature by examining effects of police intervention at two time points on marriage stability and romantic relationship quality. We find that police intervention during adolescence is associated with increases in financial hardship during young adulthood, which, in turn, decreases the odds of entering into a stable marriage by age 31 and the extent to which those who have a romantic relationship feel their partner is supportive. Early police intervention also is indirectly associated with a reduction in partner satisfaction and an increase in partner violence via young adult arrest. We conclude that even minimally invasive contact with the criminal justice system during adolescence has long-lasting collateral consequences in the family arena.

在法医实践中,利用耻骨联合推断年龄的方法得到了广泛应用和不断发展。从实体形态观察到影像资料分析,国内外学者通过不懈努力取得了一系列的研究成果,并不断探寻着更为精确便捷的推断方法。螺旋CT三维重建技术在法医学上具有广阔的应用前景,为耻骨年龄推断开辟了新的方向。本文综述了国内外研究耻骨联合与年龄关系的常见方法,展望了耻骨年龄推断的发展方向。     

危险驾驶罪犯罪构成及相关问题研究——以风险社会管理为视角

德国社会学教授乌尔利希.贝克指出,风险社会已成为当今社会的中心议题。为了实现对风险社会的管理,我国在立法上,特别是刑事立法上不断与时俱进,进行了相应的修改,危险驾驶罪作为抽象危险犯,是刑罚处罚的早期化,它是风险社会中风险控制的体现,能实现刑法的提前保护,又能充分保障人权,防止刑罚权滥用。     

论国家权力干预与公民私领域的法律保护——以“艳照门”事件为例

在"艳照门"事件中,内地国家机关对公民私下浏览和朋友间赠阅相关照片的行为进行干预。这样既没有实质上的法律依据,又缺乏必要理由,权力涉入行为实际上是对公民私领域的过度干预。这种干预会侵害到公民的权利和自由,挤压社会自主空间,同时也是国家权力资源的浪费。从理论上分析,公民权利是首位的,只有在公民个人的行为的社会危害性达到一定的程度,权力才能介入公民的私领域。我们必须在制度上作出一系列的合理安排以实现公民私领域的充分保护。     

Beyond humanitarian intervention: the new politics of peacekeeping and intervention

This article reviews patterns of peacekeeping and military intervention in the post-9/11 world. It argues that while Western states have become increasingly reluctant to engage in the types of humanitarian interventions they undertook in the 1990s, a new model of peace operations is emerging that lies in the middle ground between traditional United Nations peacekeeping and classical humanitarian intervention and combines elements of both. The emergence of this new generation of peace operations indicates that, despite the post-9/11 reluctance of Western states to intervene militarily for humanitarian purposes, there is continued momentum behind the normative shift away from an absolutist conception of state sovereignty and towards the view that the international community has a right and a duty to intervene in internal conflicts and crises.
