基层法官司法知识的开示

基于时中国基层司法的调查和研究,本文试图概括地总结中国基层司法中经常运用的一些在现有的法律知识体制中末于以足够重视的知识和技术,并予以初步的理论分析。本文认为,由于中国基层法院法官所处的特定制度空间（初审法院）和时空位置（中国基层社会）,他／她们所需要的知识和技巧不仅与理想型法官不同,而且与上诉审法官也不同。在这种余件下,中国基层法院法官实际上经常并非自党地创造和运用一些知识和技术。这种知识和技术有助于实用主义地解决一些实际问题,并且从现代的其他学科知识看来也具有一定的学理上的正当性,但是在有些情况下,也有可能被滥用。这种从司法实践来的知识,尽管来自基层,缺乏实践者的自我反思,但仍然具有实践意义和理论意义,需要当代中国关注现实的法学象的重视和研究。     

中国的现代化进程及其发展趋势探讨

在中国近代社会的现代化进程是被迫启动的,在这个过程中,逐步接受了西方社会单线发展的历史观念。社会主义制度的选择以及后来的改革开放,都是在进步、进化等历史观的指导下开展现代化建设的,但也出现了一些像贫富差距之类的问题,追求个人之间的公平、民主和自由全面发展等问题提上了日程,此种情况下便需要在注重传统和现实的基础上继续探索,建立一个具有个性的现代化国家。     

论网络教学中教师角色的体现

网络教学的发展并不意味着教师角色将淡出历史的舞台。教师作为公共知识的传播者、学习兴趣的激发者、学习态度的培养者、知识价值的赋予者,在教育中具有不可替代的作用。研究如何利用网络技术充分地发挥教师传统的传道授业解惑的角色作用,应该是未来网络教育发展的方向。     

The factors influencing knowledge entrepreneurship in Malaysian manufacturing companies

Established firms that continuously and systematically implement entrepreneurial initiatives exhibit behavior that corporate entrepreneurship researchers label as ＂sustained regeneration＂. A prime example of sustained regeneration is new product development activity in industries such as computers, electronics, and textiles where the introduction of new products is on-going and firm＇s creativities have important implications to its performance. On the other hand, knowledge entrepreneurship describes the organizational ability to respond to learn to capitalize on an opportunity, or to protect against a threat by adopting an innovation. Successful adoption of innovation requires an organizational ability to manage the process within the organization that deals with new or newly interpreted knowledge and under conditions of uncertainty and in the face of controversy, develop and initiate a plan of action to respond with goal-oriented organizational behavioral changes. Knowledge entrepreneurship connotes a ＂drive to implement change, to accomplish this goal, and to adopt an innovation＂. Knowledge entrepreneurship involves a motivated pursuit of competitive advantage, using knowledge as a means of developing sources of advantage similar to those described in the market orientation and absorptive capacity literatures. It describes a driven effort to utilize knowledge through innovation. This article is identifying knowledge entrepreneurship, and determining which factors may affect the nature of this concept. The selected criteria have been assessed according to their relative importance by utilizing analytical hierarchy process （AHP） approach and expert choice software program.     

论美国的正当程序理念及制度对我国环境行政听证的启示--中美环境行政听证制度比较

美国联邦宪法的"正当程序条款"赋予了公民听证的权利,并在此基础上发展形成了一整套听证制度,环境行政听证制度经20世纪后半叶的不断发展也趋于完善,从而给予了公民充分参与环境决策以维护自身环境权益的机会和权利.相比之下,我国的环境行政听证才刚刚起步,有许多地方需要尽快完善.美国完善的环境行政听证制度可以为我们提供这方面的参考.     

Democracy and local political participation in Sumedang,Indonesia

Indonesia is a country that implements a democratic political system. As such, the involvement of society in the political process becomes very important. The purpose of this article is to research the democracy and local political participation in Sumedang. The study uses qualitative methods with primary data obtained from field observations and direct interviews of several informants. Additionally, the researchers use secondary data as a complement to the analysis. The results of this study indicate that the community at the local level truly understands the importance of political participation. However, due to disappointment in government performance, a part of the community has become discouraged from participating in the political process conducted by local governments. Several factors hinder efforts to encourage political participation. These include limited access to political aspirations that are still rare and the process of political education that is still low.     

基于公众服务的网上行政审批系统模型研究

中国的电子政务建设刚刚起步,迫切需要各种理论和实践的支持。通过对电子政务重要组成部分———面向公众服务的行政审批系统的分析,从系统和工程的观点提出了可以应用到行政审批系统中的角色互动网络模型,并通过给出的模型建立行政审批系统的应用软件系统框架结构、网络体系结构、建设模式、运行管理模式。网上审批是信息时代对公共管理发展客观需要的现实选择。它的影响不仅在于手段的电子化,更重要的是还会引起管理价值、管理范式、管理权力、管理职能、管理组织、管理主客体等方面的变化。网上审批将通过信息技术与公共管理的有机融合促使公共管理由传统的管制管理向服务管理的转变。     

针对进程用户空间的电子数据取证方法研究

进程用户空间中的信息往往与特定用户的特定操作行为直接关联,对于证据链的建立意义重大.从数目繁多的用户空间数据结构中筛选出最重要的三种：进程环境块、线程环境块与虚拟地址描述符,说明其定位方法,并重点讨论其结构格式的电子数据取证特性,为内存空间电子数据取证提供了新的思路与方法.实例分析部分,则以目前广泛使用的Windows 7操作系统为应用背景,说明了所述方法的具体应用.     

Institutional Arrangements and State and Local Financial Forecasting

Abstract

The articles in this symposium present various consequences that effectively result in changes from adopted budgets during the implementation phase, which derive from institutional structure. The institutional structures referred to include such attributes as internal policy, procedural methodology, longevity in office, and reward and incentive systems related to performance outcomes

For local governments, structural influences studied include changes in leadership in the executive and legislative branches, longevity in office of budget administrators, and differences related to mayor-council vs. council-manager forms of government. Internal policies reported on cover methodology used to forecast revenues such as quantitative methods versus informed judgment, budgetary controls and spending policy related to mandated spending beyond local government control, and procedures for benchmarking within the agency as well as with peer groups and professional standards.

Consortia of governments are referenced regarding performance evaluation as is the process for gaining consensus between the executive and legislative branches, including expert outside opinion. Other influences on performance outcomes reported on are those tied to the risk-reward system built in to the institutional structure, which includes risk tolerance of the individuals who make pension fund investments.     

论“办案信息共享平台”建设及对公安讯问新挑战

跨公检法的“办案信息共享平台”建设从提出以来,不同模式先后在实际运行并各有利弊。从应然价值定位角度评析现有模式,并就平台建设主体、客体范围、运行规则方面展望其发展方向。在此背景下,刑事案件办理的关键节点均将嵌入平台,建议进行讯问同步录音像等制度“平台留痕化”相关改革,为侦查终结前讯问合法性核查等制度构建提供便利。侦查讯问行为将受到更严格的过程性监督与合法性考验,提出若干机制和具体措施应对公安侦查讯问新挑战。
