China's “Green GDP” Experiment and the Struggle for Ecological Modernisation

The ongoing conflict between the goals of environmental conservation and economic growth in China is partly a conflict between state agencies charged with these contrasting missions. In recent years, state environmental agencies attempted to implement a green national accounting (green GDP) exercise to publicise the extent to which environment-related costs of economic activity reduce actual GDP, and to promote a more comprehensive and realistic accounting of economic development and of GDP growth. Despite the difficulties and controversies associated with this type of accounting elsewhere, particularly in Europe, Chinese agencies implemented this project in 2006 and 2007. But there was widespread resistance from regional and local governments, apparently allied to proponents of economic growth within the central government. Chinese scholars and many officials have embraced the concept of “ecological modernisation,” but the Party-State is also bound in many ways to the “treadmill of production.” We illustrate this ongoing dynamic conflict through a study of the attempts to implement a green GDP accounting in China.     

Ordenamento Territorial: Neo-developmentalism and the struggle for territory in the lower Brazilian Amazon

In this paper, I explore the tensions and conflicts arising from the territorial re-organization of western Pará state in the Brazilian Amazon associated with the paving of the Santarém–Cuiaba highway (BR-163). I argue that the set of forces, techniques and devices that constitute Ordenamento Territorial, or Territorial Ordering, re-territorialize the region with the spatialized logic of sustainable development, constituting a ‘green grab’, or a new strategy of governance over not only territory but also territoriality – the ways of life of Amazonia's inhabitants. Analyzing the formation of the Movement in Defense of Life and Culture of the Arapiuns River, I explore how social movements are shifting their strategies in relation to these new technologies of ordering.

The consideration of ecological safety in judicial practice — also on the ecological safety legislation

Ecological safety has been one of the hot issues of environmental law in recent years. The maintenance of ecological safety has become one of the legislative principles, as exemplified by the revision of the Law of Sand Prevention and Sand Management and the Law against Solid Waste Environmental Pollution, and the relevant rules that will be established. However actual cases will still happen, whether the legislators have made the statutory law or not. While scholars and legislators are debating, the judges have to handle cases and render judgments. Through the analysis of a case, this article will discuss the feasibility for judges to make ecological safety considerations in the judicial process by applying the principle of good faith and will also discuss the legislative issues related to ecological safety.
