共享用工是疫情冲击下企业的跨界自救之举,但因我国人力资源供求的不平衡、企业用工成本的增加、劳动人口数量减少及劳动态度转变、共享用工第三方平台的崛起等原因,其在后疫情时代依然存在常态化的可持续发展空间。共享用工实现了输出方企业劳动力闲置与输入方企业用工荒的对接,提高了人力资源配置的灵活性及使用效率,但也存在着界定及表现形式不确定、法律关系模糊化的问题,同时劳动者、劳动力输出方、输入方甚至第三方亦面临潜在法律风险。因此,要促进共享用工的规范化发展,必须从政策和法律层面双管齐下,完善其制度建设,并建立包括监管部门、行业协会、共享用工平台在内的一体化规制体系。 相似文献

We present results of our study on the stability of 4-chloromethcathinone (4-CMC) in authentic postmortem peripheral blood and vitreous humor samples. The stability of 4-CMC was determined in postmortem blood samples (for a period of 90 days) and vitreous humor (30 days) at three different temperatures: −15°C, +4°C, and + 23°C. The analyses were carried out using ultra-high-performance liquid chromatography coupled with triple-quadrupole tandem mass spectrometry (UHPLC-QqQ-MS/MS). In both materials, the lowest 4-CMC stability was demonstrated at room temperature. The blood samples stored in a freezer (−15°C) showed stability for the entire study period (90 days), while in the case of the vitreous humor sample stored at the same temperature the concentration of the substance decreased by 53% after 30 days. The study carried out in authentic postmortem blood and vitreous humor samples confirms the previous reports of 4-CMC instability in biological material. Authors suggest that the biological material should be stored frozen until analyses are carried out as soon as possible after collection of the material. 相似文献

Governments have historically offered their workforce a public service bargain founded on stable pay and conditions and job security. However, while the Westminster system aims for public service employment to be protected from the whims of government, public servants are nonetheless affected by the political environment in which they operate and changes to this bargain can occur with a new government. This paper focuses on a Queensland public service change process that resulted in large‐scale forced redundancies, non‐renewal of temporary contracts, and legislative changes that nullified the provisions in job security, organisational change, and redundancy policies. Using communication as a lens through which to understand leadership, it examines how the government communicated with the public service about this organisational change, immediately before and after the 2012 election. In particular, through analysis of public and media commentary, speeches and Hansard records, it examines Premier Newman's change leadership and communication by contrasting pre‐election messages to the public service with post‐election messages about the public service and the justifications for change during this period of downsizing. This analysis is used to reflect on political leadership, communication, fair treatment, and trust in public service change. 相似文献

This paper explains how authoritarian regimes employ flawed elections to obtain both short-term legitimacy and long-term stability. In conjunction with the use of co-optation and repression, it argues that ruling parties hold de jure competitive elections to claim what is termed autonomous legitimation. This denotes the feigning of conformity to the established rules of the constitution and the shared beliefs of citizens. Regardless of overall turnout and support, ruling parties exploit the normative and symbolic value of elections in order to establish moral grounds for compliance within a dominant-subordinate relationship. In support of this argument, the case of Singapore's People's Action Party (PAP) is analysed in historical and contemporary terms. Since 1959, the PAP has used precisely timed elections to extract one or more mandate types from citizens and, by extension, claim legitimacy. In particular, it has sort a mandate based on its response to an event, execution of a policy and/or collection of a reward. In the long run, autocratic stability has been achieved through a process of reciprocal reinforcement, which has combined autonomous legitimation with targeted co-optation and low intensity coercion. 现行法律对女性就业歧视司法救济的规定不足,难以解决女性劳动者力量弱小、举证难、现有诉讼制度不足等问题。为进一步保障我国女性平等就业,需要构建女性就业歧视公益诉讼制度,从正当性、必要性、可行性分析其的法理基础。并对该制度的构建进行初步探究:原告资格以工会、妇女联合会等社会组织为主,新增专门的平等就业管理机构;举证责任在当事人之间合理分配;抗辩事由应包括劳动保护措施、真实职业资格、小微企业豁免制度等;法律责任形式从民事责任和行政责任两方面进行规范。 相似文献
