略论中西法律价值的融合

中国法制建设陷入了价值或曰“精神”迥异的中西法律文化冲突之中,基于文化的承续性、行为模式的特定性以及普适性知识存在的有限可能性,应以中国传统法律文化中的基本价值为基础,用西方文化的一些普适性价值对其进行修正,并将社会形态变迁的因素考虑进去,重塑一个剔除了封建因素的中国法律文化,作为现代法治社会建设的根本。承载价值和制度理论的实施制度应当符合“趋利避害”的人性原则,体现法律经济学的“利益最大化”原则,用微观制度的合理可行性来实现宏观价值。     

我国道德失范现象产生的原因与对策思考

遵守道德规范是保持社会稳定和促进社会发展的重要条件。当前 ,由于受市场经济利益的驱使 ,社会上出现了一些道德失范现象 ,严重破坏了社会风气 ,影响了社会的健康发展 ,本文分析了当前我国道德失范现象产生的原因 ,探讨了我国尽快消除道德失范现象的基本途径 ,以利于社会主义现代化建设事业的健康发展     

新时期青少年思想道德建设应坚持的价值哲学

价值哲学在青少年思想道德建设理论与实践发展的过程中具有基础和前提意义,它规定着思想道德建设的基本逻辑立场,从而影响思想道德建设发展的脉象。新时期我国社会文化渐呈多元趋势,各种价值观、生活方式或并行不悖或相互冲突,在此背景下,我国青少年思想道德建设坚持什么样的价值哲学,不仅影响到思想道德建设工作的展开方式方法的选择,更关系到该项工作引导社会道德生活的方向。

基于对立法价值重要性的认识,提出在循环经济的立法进程中,立法的价值问题应当成为立法者考虑的首要问题;进一步探讨了我国循环经济立法的基本价值追求,认为应以人与自然同存的整体利益,实现可持续发展和确保生态安全为价值目标。     

Fair trade: global problems and individual responsibilities

The topic of global trade has become central to debates on global justice and on duties to the global poor, two important concerns of contemporary political theory. However, the leading approaches fail to directly address the participants in trade and provide them with normative guidance for making choices in non-ideal circumstances. This paper contributes an account of individuals’ responsibilities for global problems in general, an account of individuals’ responsibilities as market actors, and an explanation of how these responsibilities coexist. The argument is developed through an extended case study of a consumer’s choice between conventional and fair trade coffee. My argument is that the coffee consumer’s choice requires consideration of two distinct responsibilities. First, she has responsibilities to help meet foreigners’ claims for assistance. Second, she has moral responsibilities to ensure that trades, such as between herself and a coffee farmer, are fair rather than exploitative.     

论司法培育和弘扬社会主义核心价值观的机理与技术路径

司法与政治密不可分。法院必须根据其功能定位执行党的政策,为中国特色社会主义事业服务。最高人民法院将国家培育和弘扬社会主义核心价值观的政策转化成司法规范性文件,各级法院审理案件时依据或参考这些文件确定当事人之间的权利义务,从而培育和弘扬核心价值观的要求。司法活动中,法官主要通过法律规范的选择、法律含义的确定、法律漏洞的填补等途径来培育和弘扬核心价值观。     

Mind the Values Gap

Minds the Values Gap, a report published by The UK in a Changing Europe, highlights the poor alignment of the values expressed within the major parties by their MPs and their activists, with those voters who support them. Voters as a whole tend to the left on economic values, and to the authoritarian on social values. Although the data imply that it is the social authoritarianism that defines both Leave voters and Labour–Conservative switchers, this response argues that issues of national identity, democracy and sovereignty are neglected in that analysis.     

Do public sector organizations ensure labor ethics? Perspectives from ethics and workplace spirituality in Bangladesh's garment sector

The suppression of labor rights is a matter of serious concern in developing countries. Yet little is known about the role of public agencies in protecting the rights of underprivileged employees. Hence, this study aims to examine the reasons behind the persisting labor exploitation in private enterprises despite the presence of public governance and labor codes. Data was collected through in-depth interviews as well as archives from different external and internal agencies of privately owned garment enterprises in Bangladesh including public administrators and multinational retailers. Kantian ethics and Islamic moral principles were used as theoretical lens to evaluate the labor practices of enterprises. This study contributes to the existing literature by introducing a process model of labor exploitation that depicts multinational power and poor governance to be the main drivers for the abuse of labor ethics. Specifically, political influence and institutional corruption drive poor governance. Public power is exercised to suppress marginalized labor institutions rather than enact labor codes. We found that ethical and spiritual values are not reflected in labor practices and practical suggestions on enacting labor ethics through which the fair enforcement of public power is offered.
