CURRENT TRENDS IN THE DEVELOPMENT OF THE CHINESE SOCIAL SECURITY SYSTEM FOR PEOPLE WITH DISABILITIES

The Law on the Protection of Disabled Persons is the first social security legislation in China, with more than 50 laws directly related to the legal protection of the rights of persons with disabilities and career development for people with disabilities. In terms of employment protections for people with disabilities, it is important to focus on effective legal implementation, utilizing legal rulings to limit employment discrimination against people with disabilities. Educational protections are an important precondition for enabling people with disabilities to live with dignity; it should be guaranteed that people with disabilities are provided “reasonable accommodation” in educational conditions. A barrier-free environment is a necessary condition for social integration of people with disabilities. At the same time, it also benefits other members of the society such as the elderly. Through rehabilitation and exercise, most people with disabilities can return to the society to a significant degree. China should gradually expand the legislative scope of rehabilitation service fee reductions and legal categories of auxiliary appliances, issuing guiding documents that provide specifications for the relevant “dormant” legal provisions.     

CRITICAL THINKING ABOUT THE PRECAUTIONARY PRINCIPLE IN CHINA’S FOOD SAFETY LAW

We are living in a risk society where people devised the Precautionary Principle in order to minimize the harm caused by risk ex ante. Compared to the previous Food Hygiene Law (FHL) and the 2009 Food Safety Law, the 2015 revised Chinese Food Safety Law (FSL) made a real breakthrough in the sense that it legitimates an important principle in food safety governance. Apart from laying down the fundamental importance of this principle in food safety regulations, the FSL 2015 also invented arrangements from different aspects in order to implement this principle. In other words, the FSL 2015’s incorporation of the Precautionary Principle in a very real sense marked a transition from a demonstrative preventive food safety management regime to a more effective precautionary regime. However, the Precautionary Principle needs to be adopted in a “precautionary” way since this principle has its own limitations and defects. Incautious application of the principle may create new risks. This article compares the European approach in implementing the Precautionary Principle, and examines China’s legal arrangements against negative impacts brought by the Precautionary Principle. Three perspectives are discussed: independence of scientific institutes; proportionality in risk management measures, and the shift of burden of proof for market authorization.

公安院校实验教学管理体制及教学内容研究

公安院校专业特殊,实验室建设起步较晚,传统的管理模式严重制约了公安高等教育的发展。公安院校实验室管理体制应是在主管校长的领导下,成立实验室专门管理机构,建立以校级中心实验室为龙头,系级综合实验室为主体,教研室研究应用型实验室为补充;以实验教学为主,融实验教学、科研、实际办案于一体的多功能综合性实验室管理体制。

试论校园安全立法的紧迫性与可行性

我国校园安全立法工作严重滞后、法律体系不健全、立法层次不高、实施机制弱化,校园安全权利和义务不对等。为了规范校园安全管理工作,完善教育法律法规体系,不断深化教育体制改革,保障师生生命财产安全,加强校园安全立法工作已迫在眉睫。改革开放以来我国校园安全结构发生重大变化,制定《校园安全法》已经具备相应的基础。
