人力资源管理视野下的战略性警察教育培训

人力资源是重要的战略资源,是组织竞争力的保障。警察机关实施人力资源管理是十分重要和必要的。对警察的教育培训也应当纳入人力资源管理的视野下,站在战略的高度看待警察的教育培训问题,将教育培训同警察的组织目标紧密结合在一起,将长期开发同短期培训结合起来,使人才培养真正满足警察机关实施战略性计划的人才需要。     

教学中怎样认识和处理三段论系统的有关理论问题

传统形式逻辑的三段论理论系统总体来说严密、完整。但在教学实践中不能原原本本地讲授整个体系，而应该加以简化和改造。本文概略介绍了三段论理论系统中省略三段论、格以及式的理论，讨论了三段论基本理论与它们的关系，分析了它们在教学实践中的利弊得失，提出了自己的改进方法。     

Pioneers of peace research — Lewis Fry Richardson: Apostle of math

Most studies of economic sanctions have concluded that they are ineffective as instruments of foreign policy. In a previous effort, we applied the spatial model of bargaining to the question of sanctions effectiveness to identify the‐conditions under which sanctions can be expected to “work.” In this paper, we refine that analysis by examining the impact of domestic politics in the state that is the target of the sanctions. Sanction episodes may be examples of two‐level games in which the domestic game within both parties affects the international game and vice‐versa. Here, we take a first cut of applying this approach to the analysis of sanctions effectiveness. We extend the spatial model to focus on how sanctions affect the internal political bargaining within the target state. From this, we determine how state policy should change (or not) as a result of the sanctions. We use the basic model to identify general hypotheses regarding the nature of sanctions and their effectiveness and we evaluate some of these hypotheses using cases in which the United States imposed sanctions on Latin American countries for human rights violations.     

On the formal rationality of commercial law in common law system

Common law traditionally contains the formal rationality of commercial law. According to common law tradition, there is no possibility of preventing commercial law from being formalized. Formalization of commercial law in common law system is an institutional demand of market economy and is jointly promoted by the legal tradition of common law countries. The commercial law in the two legal systems indicates that the commercial law is made depending on the market economy and the form of commercial law is restricted by legal tradition. The formalization and assimilation of commercial law are an internal need as well as an inevitable trend in the course of economic development.     

论二十世纪中国乡土文学的现代悲怆意识

中国20世纪文学史是一部乡土文学在现代文化语境和民族救亡图存的历史背景下的流变史。乡土文学这个主题蕴涵着现代与传统、救亡与启蒙、幻想与现实、离去与回归等现代文学母题。乡土文学在对传统文化的留恋与批判,对现代文明的拒斥与认同等多重叙述中,折射着20世纪乡土作家们作为叙述主体巨大的精神困境和无法摆脱的现实和文化宿命,他们为中国20世纪文学书写了悲怆的一笔     

仿真分析取证模型的形式化研究

计算机犯罪的多样性使得现有的静态取证和动态取证模型均已不能很好的满足计算机取证的要求,亟需建立一种新型态的取证模型。仿真分析取证模型运用“自顶向下”的形式化建模方法,结合虚拟机技术的最新发展成果,通过虚拟犯罪现场重建构建了一种并行的取证平台,为侦查实践和司法实务提供了有力的技术支撑。

大陆法系各主要国家不同的立法说明了担保物权独立性与物权行为无因性并不存在必然的关联,并且两者各自所抽象的原因不同。在形式审查主义下,物权行为无因性为物权登记公信力提供了支撑,并与担保物权独立性协力为担保物权登记公信力提供了制度上的支持。     

法治行政:对依法行政缺失的补救

受到“法治国”思想和中国传统法制思想的影响,中国学界对依法行政的理解还停留在形式法治层面。依法行政不以法治所蕴含的基本价值为内核,结果造成依法行政失去了灵魂,在实践中依法行政被狭隘地理解为依法办事、依法治理,于是“合法”侵犯公民权利的事件屡见不鲜。法治行政不仅包含依法行政的诸多要素,更强调依良法治理、人权保障,能有效矫治依法行政的弊端。     

Buy Today,Pay Tomorrow: Formal Credit Supply and Domestic Electrical and Electronic Goods Consumption in São Paulo's Urban Periphery

Since the beginning of the twenty-first century, expansion of the formal credit supply in Brazil has promoted the ‘financial inclusion’ of the low-income population, especially through instalment plans offered by large retail chains. This article aims to analyse the impacts of formal credit availability on the consumption of electrical and electronic goods by residents of Jardim Helena, a neighbourhood in São Paulo's periphery. Through the collection and analysis of qualitative and quantitative data, this study reveals how the instalment plan can stimulate consumption among the low-income population, with a significant impact on household budgets, raising the risk of indebtedness.
