论中国共产党社会管理思想的演变逻辑

中国共产党在新中国60多年的实践中,不断丰富发展了社会管理思想。毛泽东在探寻社会主义建设中蕴含着社会管理的理念雏形,邓小平围绕经济建设对社会管理提出了一系列重要思想,江泽民从加强党的领导、基层民主、改革发展稳定的关系等方面推进了社会管理建设,胡锦涛进一步创新和完善了社会管理体制,使我国社会管理在理论和实践上得到了进一步完善和发展。     

“三型”马克思主义执政党的内在逻辑与实现路径

党的十八大报告提出“建设学习型、服务型、创新型的马克思主义政党”,具有重要的理论价值和现实意义.学习型、服务型、创新型和“马克思主义执政党”是“三型政党”的四个结构要素,要素之间具有紧密的逻辑关系,彼此有机统一、相互依存、相互促进.实现“三型政党”建设目标,必须按照十八大提出的“主题—主线—方针—布局”四个要求进行整体推进,力求实现重大突破.     

Civil Society and Violence in India's Northeast

The dominant view of India's Northeast highlights violence as a predominant feature and presents civil society as non-existent. Nevertheless, between a militarily-willed state and violent insurgencies lie very many formal associations and informal networks that organize the space for a civil society. The paper attempts to highlight the existence of such relatively lesser-known institutions of civil society in the region. However, there seem to be differences in the very nature of associations of civil society. Homogenous, intra-ethnic networks of civil society in the rural Northeast seem to be more vulnerable to violence and nationalistic fervour. In contrast, formal associations or inter-ethnic informal networks in the urban Northeast seem to handle conflicts and violence better. While the contents herein are expected to inform public discourses on a fragile region, they might also help challenge popular notions about the potential of an existent civil society in similar regions.     

国有企业参与公共危机治理的四重逻辑

将基于利益相关者理论的企业社会责任理论拓展为基于国有企业属性的“属性责任”分析框架,以国网浙江电力参与新冠肺炎疫情防控为例,考察国有企业参与公共危机治理的实践面向与内在逻辑。研究发现,国有企业在新冠肺炎疫情防控中呈现出系统内防控、自愿性公益、执行式参与、主体性治理四类行为,体现了市场属性驱动其履行市场责任的市场逻辑、社会属性驱动其履行社会责任的社会逻辑、政治属性驱动其履行政治责任的政治逻辑、公共属性驱动其履行公共责任的公共逻辑。文章创新了国有企业社会责任理论分析框架,回应了否定国有企业需要履行多重责任的理论质疑,阐明了国有企业需要参与公共危机治理、履行多重责任的内在逻辑,提出了优化国有企业参与公共危机治理制度环境的政策建议。     

权利的合约性质

在权利所指示的事物以及权利话语本身在一个不断产生、变化和发展的意义上,对权利的解释就需要某种理论,而不是一个抽象界定的概念。对于权利这个事物的解释,现行学者分别从不同的路径出发对权利展开了分析,由此形成了抽象权利、具体权利以及真正权利三种权利形态。然而,诸种对于权利的界定之所以出现种种困难和问题,原因在于它们不自觉地以事实性的语言侵蚀甚至替换了权利所表征的正当性内涵,同时他们对于权利实践中问题的认识也存在偏差。合约这个概念的属性以及权利这个事物不完全界定的特征,使得合约可以成为分析权利问题的一个合适理论框架。合约是权利内在生成的机制。当然,用合约分析权利问题也并非完美无缺。     

On the Dual Form of Acoustic Beauty

To analyze and value of the acoustic beauty, we must acknowledge the difference between the beauty of form and the beauty of implication. The so-called “acoustic beauty” refers to the beauty of the sound that directly evokes pleasure in the sense of hearing. It is actually represented as the beauty in the form evoking acoustic pleasure and the beauty in the implication enriched by human imagination, association, and understanding. This article explores into the physical foundation and the physiological mechanism of the acoustic beauty from the musical perspectives of frequency, pitch, volume, tone and quality. It then discusses the beauty of form from the musical perspectives of melody, harmony and rhythm and the beauty of implication on the basis of understanding, imagination and association. Finally the author puts forward his aesthetic view of the dual form that integrates both the acoustic beauty and the implication beauty free from unbalanced biases.     

司法社会工作概念的缺位及其补足

近年来,我国的司法社会工作相当活跃,不仅在青少年、禁毒和社区矫正这三个主要分支领域取得了令人瞩目的实践成果,而且也厘清了各分支学科的概念和边界。但是,作为总和概念的司法社会工作称谓,却仍然是混沌不清的。这种分支概念清晰与总和概念混沌并存的状态,反映了司法社会工作在不同实践领域的分立状态。理论上的滞后尤其是概念的缺失是需要尽快弥补的。为此,在梳理和对比国内外司法社会工作的实践逻辑、价值取向和工作理念基础上,提出了一个归纳性定义:司法社会工作是一个由特定价值理念与实践逻辑所决定的复合系统,社会工作机构及其从业人员与司法机构在其中相互依托,面向罪错者、受害人以及相关利益人中的受助者,通过充分发展其全部潜能而推动社会变革、改善人际关系和促进问题解决。     

完善我国保险人明确说明义务的法律思考

明确说明义务是保险人的一项法定义务,但保险法并未明确规定说明的范围、方式及其程度标准,导致理论上争议较大。实践中对保险人是否已尽该义务的认定也莫衷一是。破解上述疑难问题的前提是对该义务的立法原旨进行理性定位,避免片面强调倾斜性保护;以此为指引,对该义务履行之对象范围与程度标准的界定也需要在平衡各方利益的基础之上进行。     

The remote securitisation of Islam in the US post-9/11: euphemisation,metaphors and the “logic of expected consequences” in counter-radicalisation discourse

This article critically analyses the securitisation of Islam post-9/11 in the US and argues that this securitisation is a remote securitisation whereby the securitisers – the security practitioners – are placed at a distance from the securitisees – the Muslim community. This is achieved through two processes of security practice: linguistically by euphemising language and using metaphors, and analytically by understanding radicalisation through a rationalist perspective, which follows the “logic of expected consequences”. This article further problematises the rationalist view of radicalisation in the counterterrorism sector in the US and concludes by introducing a Bourdieusan concept of relationality to critical counter-radicalisation studies.     

Developing Strategies for Asking Questions in Negotiation

Although negotiation writers often advise negotiators to have a strategy for asking their counterparts questions, the negotiation literature does not currently provide a detailed discussion of how to develop a strategy for asking questions in negotiation. This essay begins that discussion. In doing so, it draws from such disciplines as logic, linguistics, and cognitive psychology, in which the act of questioning has been examined with the goal of developing theory. This article also draws from such applied disciplines as law, education, and journalism, in which questioning as a matter of strategy has also been examined. A common theme across these different domains has been potential resistance to answering questions on the part of the person being interviewed and explorations of the sources of that resistance. Therefore, in this discussion of questioning strategy, I have focused particularly on how resistance can be avoided or overcome.
