少数民族地区产业园区土地开发的企业化模式设计——以贵阳金石产业园为例

企业化经营是未来产业园区的发展趋势,园区土地的开发主体也逐渐由政府转为企业。在回顾现有国内现有产业园区土地开发模式研究的基础上,以贵州省贵阳市金石产业园为个案探讨,从而为西部产业园区土地开发模式的选择提供理论与实践支持,也为实现失地农民特别是少数民族聚居地的可持续发展提供新的思路。     

基于开放系统的教学情景设计

教学情景设计作为教学系统的组成部分是通过选择、创造、构建服务于学习的人为环境。好的教学情景总是有着丰富和生动的内容,不但有利于学生的全面发展,也有利于学生的个性的形成。理论和实践都证明,与真实情景相联系的教学情景不但可以激发学生的求知兴趣和探索欲望,而且能够促进学生对知识和方法的理解与掌握,在知识的获取过程中提高思维和认识能力。     

Survey Research in International Political Economy: Motivations,Designs, Methods

The use of surveys and survey experiments by international political economy scholars is increasing, adding to the ability to study a broad array of topics. In doing so, many scholars in international political economy draw on—and are contributing to—insights and arguments from American politics and comparative politics (Milner 1998), substantive fields with a history of using surveys and survey experiments. In this article, I review motivations for using surveys and survey experiments, the research designs, and analysis strategies in light of this issue’s contributions. I contrast these motivations and their accompanying designs and discuss the pros and cons of ways to approach the data generated by these research designs. The goal of this commentary is to situate surveys and survey experiments—especially those within the special issue—within a larger discussion about research motivations, design, and analysis techniques.     

民法视野下的人体法益构造——以人体物性的科技利用为背景

近现代民法体系所持的"人体为主体人格之一部"的立场系建立在传统人物两分理论基础之上,该理论虽有助于彰显人的主体价值和尊严,但在处理因人的活体、尸体、离体组织和基因的科技利用所生法律问题上,已显现出部分失灵和易加剧人体物性利用与人性尊严保障之间价值冲突的不足。人与物或人格与财产的区分并非绝对不容许因应时代变迁而作必要修正。通过逻辑的、价值的、实践的和法释义学的综合考量,理论上可以得出,有限地承认人体为物,并将"人体财产权"和人类作为物种享有的"类的人性尊严"纳入到人体法益构造体系之中,能较好地克服以上不足。在以公序良俗原则限制人体或其一部的利用和处分时,应建立和实践"人性尊严关联度原则"。

在新时期人道主义文学思潮风起云涌的大背景下,舒婷<神女峰>一诗蕴含着深刻的思想意义;对女性命运的关注和追问是该诗的主题.本文阐发了充溢其中的人道主义人文关怀精神,讨论了该诗的成功所在、时代意义、局限和不足,探究了女性反抗和独立不彻底的原因,最后结合舒婷其他爱情诗,揭示她对女性命运的拷问和确立大写的"人"是其一以贯之的诗学追求.     

Terrorism,Conflicts and the Responsibility to Protect Cultural Heritage

Abstract

Intentional destruction of cultural heritage is a well-known phenomenon which has been particularly exacerbated in recent times. Its common denominator is represented by the intent to persecute the communities for which that heritage represents an essential element of their cultural identity and distinctiveness. In legal terms, it produces different implications, to the point that – depending on the circumstances in which it is perpetrated – it may be qualified as a war crime, crime against humanity, violation of internationally recognised human rights, or evidence of the existence of the intent to commit genocide. Since the whole international community is seriously affected by the destruction of cultural heritage, it is indispensable that the doctrine of responsibility to protect (R2P) be put into practice seriously and effectively with the purpose of protecting humanity against the irreplaceable loss of its heritage.     

Therapeutic engagement in medium-secure care: an interpretative phenomenological analysis of service users’ experiences

Service users (SUs) detained in forensic hospitals are usually required to engage in psychological therapies aimed at reducing mental distress and/or for preventing further offending. Poor therapeutic engagement (TE) can lead to adverse clinical outcomes and reoffending, at a cost to the individual, staff, the service provider, and the public. To understand what factors influence TE from a SUs’ perspective, the experiences of 10 male residents of a medium-secure hospital were explored. Using a service-user informed design, interpretative phenomenological analysis of interview data was completed. Four superordinate themes emerged: different worlds; what the individual brings; what the therapy entails; and control. Consideration of how these factors may be of use to professionals working in secure care settings is discussed in relation to existing theory and research.

知识经济时代,人力资本受到前所未有的重视,因而以人力资本出资在企业中分享股权已是大势所趋,然而新修改的《公司法》却否定了人力资本的出资。文章通过讨论人力资本出资在当前企业经营中所起到的积极作用,揭示了人力资本出资的必要性和合理性,并根据人力资本独特的特征设计了人力资本出资的形式制度构架。
