欧共体商标先前权制度研究

对于在欧盟成员国已经注册的相同商标，欧共体商标的申请人、所有人以及指定欧盟的国际商标的申请人和所有人既不愿承担维持其注册的成本，又想保持其效力的话，可以要求先前权，从而置于欧共体商标下统一保护。要求先前权的，应当在规定的期限内提交声明和证明文件，并符合“三重一致原则”，即欧共体商标与在先商标的所有人、商标及其商品或者服务均一致。即使欧共体商标失效，先前权也可以通过转换而恢复成员国商标的效力状态，包括申请日或优先权日。要求先前权并放弃成员国商标的做法也存在风险，当事人应结合自身的情况慎重选择。

在我国现阶段,农民具有特定的身份含义.不平等的政治和经济地位使得农民犯罪无论在城乡都非常严重,并呈日益上升态势.要遏制这种犯罪趋势,必须彻底改革城乡分治政策.     

The politics of other citizens

In all kinds of political action, citizens are confronted with the performances of other citizens. An important guide to political behaviour is therefore likely to be the assumptions people make concerning how others can be expected to behave. This article explores common sense ideas about other citizens as potential political participants, drawing on a series of group interviews conducted with taxi-drivers in Britain, Germany and the Czech Republic. I argue the expectations voiced of other citizens tend to be pessimistic in nature, casting them as ill-informed, apathetic, passive and unduly self-interested, notwithstanding the appearance of a more optimistic view which holds they can be expected to follow the lead of those who ‘take a stand’. These empirical observations lead to a discussion of the theoretical issues they raise, notably where to locate the origins of such views, and how to appraise their implications for democracy.     

The contested nature of Afro-descendant quilombo land claims in Brazil

In Brazil, Afro-descendant quilombola communities were for the first time in history recognised as legal rights-holders to land in the 1988 constitution – 100 years after the abolition of slavery. Drawing on fieldwork in the quilombo Bombas in the state of São Paulo, and a review of relevant literature, this contribution explores the historical trajectory of the constitutional quilombo provision and how it has been translated into practice. Combining a discussion of the use of self-identification and the concepts of ‘regulation’, ‘force’, ‘market’ and ‘legitimation’ when analysing the dynamics of access and exclusion, we show how struggles over land are simultaneously enacted in controversies over the meanings of quilombola identity and its implications.     

混合主体实施身份犯罪的定性

非身份者与有身份者,即混合主体共同实施身份犯罪,在古今中外的刑法中皆有所规定。现阶段,我国关于混合主体身份犯罪有着各种不同的认识,主要集中在非身份者的身份犯罪主体资格符合问题上。刑法分则中,纯正身份犯以有特定身份者为犯罪主体,非身份者不能构成。但是分则的构成要件在非身份者与有身份者共同实施纯正身份犯罪时,应将非身份者与有身份者从总体考察,非身份者可以在此时成为纯正身份犯的主体,具体定罪时要本着"特殊优于一般为原则,重法优于轻法为补充"的理念来处理。     

论信用卡诈骗罪中的“冒用”的含义

冒用他人信用卡是我国刑法规定的信用卡诈骗罪中的行为之一。其中的冒用的含义与民事领域中的冒用含义有不同之处。民事领域的冒用含义更加广泛。刑事领域的冒用含义的实质是身份的盗用。我国刑法第196条第三款将盗窃信用卡并使用按盗窃罪定罪并不妥当,应定为信用卡诈骗罪。对于冒用的特殊情况：机器的被骗、特殊身份者使用以及经过授权者不当使用信用卡,其是否构成信用卡诈骗罪的＂冒用＂亦值得探讨。     

Dealing with Diversity in the Construction of Indigenous Autonomy in the Sierra Norte of Oaxaca

Building autonomy in the Sierra Norte of Oaxaca has not depended on the development of Zapotec ethnic identities, isolation or rejection of the integration of outsiders into the communities. The communities of Ixtlán and Guelatao have developed strong local identities and strategies related to the appropriation of external legal categories, and the combination of these with their own customary practices to integrate newcomers into their social, political and economic organisation. Dialogue has been one of the main tools for building autonomy and achieve the integration of outsiders, while continuing the dynamic reproduction of their internal organisation and way of life.     

混合身份视域中的间接正犯问题

在无身份者利用有身份者或者有身份者利用无身份者以及此身份者利用彼身份者去实现犯罪的场合，既涉及身份犯问题又涉及间接正犯的问题，应当兼顾共犯与身份以及间接正犯的基本原理，对其各种具体情形进行妥当的认定和处理。     

保障性住房建设与社会认同体系的建构——以长春市为视角

以政府为主导的保障性住房建设,在满足社会群体住房需求的过程中取得了巨大的成就,但同时也面临着社会认同的缺失。本文从社会认同的理论视角出发,以长春市的保障性住房建设与管理为研究对象,分析了影响保障性住房建设的社会认同因素,并在此基础上提出了社会认同体系建构的相关建议,以期进一步完善保障性住房建设与管理。     

社会认同视角下群体性事件探析——以贵州省为例

市场化改革的深入,一方面激发了社会的活力,实现了经济的快速发展;另一方面积累了社会矛盾,群体性事件频频发生。面对现实的挑战,如何预防群体性事件的发生是急需研究的重大现实课题。本文从社会认同的角度对群体性事件发生的原因进行了分析,进而探讨了化解群众认同危机,预防群体性事件的路径。
