警察职业环境中存在着比常人更多的负向刺激物,警察在工作实践中会面临多种多样的压力事件,压力事件及压力情境构成警察的心理压力源,工作压力源成为警察心理压力源的主要内容。     

间接一般预防是刑罚的根本目的

刑罚的目的是刑罚论的核心问题.在评析传统理论的基础上,提出新的刑罚目的论--"统一说",即"坚持一个中心兼顾两个基本点".刑罚的目的应坚持以间接一般预防为中心,兼顾报应与特殊预防的要求,在间接一般预防的基础上实现报应与特殊预防的有机统一."统一说"为我国刑事政策的调整提供了理论依据.进一步论证了我国刑事政策调整的战略步骤.     

现代法的本体价值及其对我国民事立法的启示

在法的价值体系中,至为根本并决定其他价值者为法的本体价值.受现代社会整体文化结构、经济结构之决定,现代法的本体价值为个人自由与社会正义的统一,并与传统和后现代法的价值相区别.对我国民事立法而言,现代法的本体价值有助于我们克服价值迷失和主体误置之弊,坚持个人自由这一核心价值,切实贯彻私法自治原则,并注重社会正义价值,实现个人自由和社会正义的统一与和谐.     

人的主体性发展与中学教育

人的主体性,是人在社会实践中不断生成和发展的。充分发展以培养人的主体性为最终目的为主体性教育是时代的呼唤,也是当今学生主体性迅速发展的客观要求。作为常常被主休恶性循环研究所忽视的中学教育,必须弃教育中那种难知难智型的认识传递与智能训练的框架,遵循主体性原则,在教育目的、教育内容、教育方法、教育管理等方面进行改革,以培养自由发展的、富有创造性的主体的人。     

Open Immigration Policies and Liberal Discomfort

Consequentialist cosmopolitanism, Peter Higgins argues, enables closed border liberals to evade charges of moral hypocrisy despite their commitment to moral equality of individuals, once we recognize that open border arguments rely on cosmopolitanism’s individualism requirement, which ignores social realities relevant to a realistic assessment of the social consequences of an open immigration policy. Higgins is mistaken, however, in contending that cosmopolitan individualism entails attention to people only in their capacity as the abstract atomic individuals populating Charles Mills’ idealized social ontologies. Conversely, if cosmopolitan individualism does compel us to think of people as abstract atomic individuals, we are not obliged to think of them as relatively privileged. Under liberal cosmopolitanism, however, which prohibits state discrimination between citizens and non-citizens, open border policies are subject to no such consequentialist objections.

推进工会体制创新是中国劳动关系集体化转型的根本路径 —— 与常凯教授和游正林教授商榷

劳动关系集体化转型是劳动关系结构和调整方式发展的必然趋势,但目前我国集体劳动关系尚未形成。我国劳动关系集体化转型不能依赖于工人自发的集体行动,劳动关系深层结构调整需要政府的合理干预。与市场经济国家先通过集体劳动关系立法、然后规范自发的工会组建与集体行动过程、逐步完善集体劳动关系调整机制的路径不同,我国劳动关系集体化转型只能在政府主导下通过"顶层设计",首先要完成体制内企业工会职能的变革,在此基础上构建集体劳动关系法律体系,从而推动形成集体劳动关系调整机制。     

Spatial and individual resistance(s) in depopulated and remote rural areas

The concept of resistance is multidimensional in political and rural geography. It is mainly used to classify communities’ strategies in response to the actions of extra-local public and private agents. In this approach, the community is usually studied homogeneously. However, some interpretations consider that resistance creates differentiation processes within the rural community. From this perspective, individual resistance strategies can be analysed, which join forces in times of community resistance. In depopulated regions, the purpose of resistance is to remain in a place. This paper studies several cases of resistance in small populations affected by depopulation in a region of Spain.     

New localism or fuzzy centralism: policymakers’ perceptions of public education and involvement in education

This research examines local authority involvement in education as a function of local policymakers’ perceptions of education as a public service – namely, whether public education is for the benefit of society as a whole, or for individual students and parents. Perceptions of education and involvement in education were assessed through 107 questionnaires returned by mayors and heads of local education departments in Israel. The results show that (1) local policymakers tend to perceive public education as a general public service, and (2) the relationship between this perception and involvement in education varies with the locality’s centre-periphery status. In peripheral localities, perceiving education as a general public service and an understanding of ‘society’ as the local community leads to greater involvement in education. In central localities, involvement rose with a more individualised perception. Implications of the findings are discussed in line with viewing education in the spirit of new localism.

和谐社会必然是一个以人为本的社会,社会和谐的基础是一个个自身和谐的生命体。离开对尘世飘泊灵魂的安顿和终极关怀．离开对现实个体生存价值的卫护和关爱,离开对个体生命精神的激发和张扬,构建和谐社会就失去了目标和动力。     

论出售、非法提供公民个人信息罪的构威及认定

构成出售、非法提供公民个人信息罪必须同时具备四大要件：一、犯罪客体是公民个人信息的隐秘权；二、客观方面表现为违反国家规定，将本单位在履行职责或者提供服务过程中获得的公民个人信息，出售或者非法提供给他人．情节严重的行为；三、犯罪主体是特殊主体，既可以是自然人，也可以是单位；四、主观方面是故意的，既可以是直接故意，也可以是间接故意。在司法实践中，还应严格把握罪与非罪以及与他罪的界限。
