煤矿安全生产的制度安排分析

我国煤矿频繁发生安全事故的根本原因是在煤矿安全生产方面缺少合理有效的制度安排。对“经济人”要进行严格的制度安排 ,既要保障“经济人”的利己权利 ,又要有效地规范和约束其行为 ,建立独立、公正、廉洁、高效的安全生产监管体系 ,建立科学、规范的产权制度     

论当代大学生网络人格培养

网络人格是指人们在网络交往过程中表现出来的心理特征的总和.网络交往既有利于大学生人格独立性、平等性、个性化和开放性的形成与发展,同时又容易诱发产生大学生人格的虚伪性、变异性、封闭性和迷失性.应采取积极有效措施,构建规范的网络伦理,加强大学生"网德"教育,建立健全法规制度,强化网络的监督与管理,加强大学生心理健康教育,建立大学生健康人格教育网络系统,努力培养大学生健康的网络人格.     

Product Liability in the European Union: Compensation and Deterrence Issues

In Europe a common standard of strict liability has been introduced with the European directive 85/374. The implementation of this Directive has not led to an expansion of product liability cases. Moreover neither the product nor the insurance market has been dislocated as in the United States. Both the fact that most liability cases continue to be discussed under national legislation—even when it is based on liability with fault—and the different price of insurance in Eurpean Countries show that the directive did not reach its harmonisation goals. We discuss the optional provisions that limit strict liability under the directive, but claim that the scarce impact of liability laws—in spite of increasing concerns for product safety—may be due to compensation provided by the Welfare State and to the cost of access to justice in Europe. Compensation by the Welfare State is inadequate with respect to the internalisation of the cost of accidents especially when public institutions do not file claims against liable producers. Product safety regulation should have performed the deterrence function. However we also point out that the threat of reputation losses is a powerful incentive for firms to carefully control product safety, when consumers increasingly care about product quality and accidents are heavily advertised by media.JEL Classification: K13, K41

网购灯箱在脱影照相中的应用研究

脱影照相的方法通常是使用专用灯箱,然而这种拍摄方法不仅对配光要求高,而且专用灯箱价格昂贵,不便携带。为了改进现有的拍摄方法,改善拍摄效果,脱影照相不妨使用网购灯箱。实验证实:改进后的网购灯箱,在拍摄效果、用光方法、抗外界光线干扰、色温平衡和价格方面,均优于专用灯箱。由此可见,利用互联网有助于我们寻找和发现更加适合刑事技术工作需要的产品,这对提升证据能力,提高办案效率和质量,有效打击刑事犯罪具有重要的现实意义。     

Brazilian Parliament and digital engagement

ABSTRACT

This paper examines how new technologies are employed by the Brazilian Chamber of Deputies to stimulate experiences of digital engagement. It also evaluates how new technologies are put in practice by the institution, considering its potentialities and limitations in mediating the relationship between the parliament and the citizens. This analysis is anchored in concepts put forth by Polsby about arena parliaments and transformative parliaments, in order to evaluate which of these models of engagement tools have greater potential. The study concludes that the use of digital technologies by the Brazilian Parliament is very diverse, with a variety of tools that allow for the interaction and engagement of citizens, although these tools have the greatest potential for the arena parliament model.     

泛消费、去技能与再组织：互联网时代的基础性零工经济何以可能

在互联网高速发展的背景下,零工经济的兴起已然成为时下就业领域最热门的现象之一。其中,以日常生活服务为导向的基础性零工经济得以盛行离不开以下因素：社会的泛消费化意识形态及互联网技术的进步促成了消费形式与内容的变迁,从而为基础性零工经济的产生提供了现实基础;基础性零工经济所秉持的去技能的劳动形式与劳动内容,则满足了其劳动密集型服务业的本质需求,使得扩张所需的大量劳动力涌入成为可能;零工经济所特有的算法加持下的劳动控制,则实现了平台从信息中介向零工经济再组织者的转变,推动了整个社会都投入到零工经济的维系之中。尽管零工经济的兴起是社会转型的一种必然,但是其带来的劳动不稳定性问题依旧值得全社会深思。     

我国食品安全法律监管问题研究

食品安全状况如何,直接关系人民的身体健康和生命安全,关系国民经济与社会的协调发展,但在经济利益驱动下,我国食品安全问题仍然十分严重,存在着极大的安全隐患。我国食品安全以及现行食品监管法律体系存在一定的问题,应采取措施构建我国食品安全法律体系,旨在保障食品安全和人们的生命健康。     

Popular post-separation parenting smartphone apps: An evaluation

In recent years a bewildering array of smartphone applications (“apps”) has emerged to support separated parents' communication. Post-separation parenting apps vary in cost and features; they typically comprise a messaging tool, shared calendar, expense tracker and a means to export records for legal purposes. A key challenge for separated parents and family law practitioners alike is knowing which apps or app feature(s) can work well for different family contexts, needs and budgets. The present study sought to evaluate nine popular post-separation parenting apps and their features using small-n Human–Computer Interaction methods. Mediators role-played high conflict ex-couples while completing a set of five common post-separation communication or organizational tasks. A cross-case analysis of ratings was conducted. We found that (a) many of the mediators changed their apparent enthusiasm for co-parenting apps once they had used the apps themselves; (b) all nine apps were rated somewhere between “Poor” to Fair’; and (c) features of some of the best-known apps were not rated as highly as some of the features of more recent, lesser-known apps.
