Potential Impact of Research on Adolescent Development on Juvenile Judge Decision‐making

This paper discusses how biological and psychological literature on the developmental differences between juveniles and adults may affect juvenile judges in their “dual role” as retributive and rehabilitative decision‐makers in juvenile cases, specifically focusing on sentencing. Particularly, it discusses potential influences of this research on adolescent development regarding four factors known to be integral in juvenile judge decision‐making: legal factors, characteristics of juvenile offenders, and individual structural and social contexts in which judges’ decisions are made. To conclude, implications and recommendations stemming from this discussion are considered.     

公民健康权利与义务立法研究——兼评《基本医疗卫生与健康促进法(草案)》第2章

综观世界各国的立法实践,公民健康权利与义务大致呈现出单独式、专章或专节式、分散式三种立法模式。在立法内容上各国更为侧重确立和保护公民健康权利,对公民健康义务的规定则相对粗疏简略,除医疗服务获得权、知情同意权、隐私权与尊重医务人员及他人的义务、支付医疗费用的义务等部分权利、义务类型没有较大争议之外,各国均保有较大的差异性。我国应当系统整理现有医疗卫生立法及其他相关法律文件,将公民健康权利与义务协调规定在未来的民法典和"基本医疗卫生与健康促进法"之中,同时借鉴国外的先进经验,增设投诉权、病历查阅权和复制权以及爱惜健康、支付医疗费用、遵守医疗机构规章制度等权利与义务,并对儿童等特殊群体提供特别保护。     

工会参与群体劳动争议处理的法律保障

群体劳动争议因其争议主体的集体性和组织性、争议内容的多元性和争议手段的集体对抗性而内在地需要工会作为劳方代表参与争议解决。然而,在行政主导的争议处理机制下,忽视了规范化的制度建设,工会的角色定位不明晰,再加上工会自身存在较大缺陷,集体劳动关系协调机制与群体劳动争议解决机制不衔接,造成了工会难以参与群体劳动争议处理的困境。因此,需要完善相关制度,确立三方机制的处理方式,明确工会在群体劳动争议处理中的法律地位,制定工会参与的具体形式、条件和程序,克服工会自身缺陷,构建群体劳动争议解决机制与集体劳动关系协调机制对接制度。     

法官职业化建设背景下法官助理制度的重新审视与现实进路

法官助理无论在英美法系还是大陆法系国家已是一项比较成熟的司法制度。我国虽在1999年已将其摆上改革议程,但截至目前尚未真正建立。因此,我国应加快构建法官助理制度,并由此推动司法权运行机制和法官职业化的全方位改革。     

Political Marketing Research in the 2000 U.S. Election

Abstract

It is not news that polls and other forms of marketing research are regularly employed to craft political strategy. What is new is that the 2000 U.S. election represented a turning point where political marketing research seems to take center stage. The print and broadcast media employed polls and other forms of research at levels far beyond anything ever seen before. At times, it appeared as if almost as much attention was being given to polls as was being given to the political candidates and the issues. This was clearly a new and important posturing of the role of political marketing research. With this as a backdrop, the current article compares polls and other forms of political research-focusing on what went wrong and what was right in terms of the use of polls, focus groups and Internet research during the 2000 U.S. election. The article ends with the presentation of some exploratory research that examines insights about respondents' opinions regarding the impact of political polls.     

The “Bestie di Satana” Murders

In recent years, satanic groups have been responsible for various types and degrees of crimes. We report the case of a number of murders committed in Italy by a group of young people calling themselves the “Bestie di Satana”. Forensic psychiatric assessment of the members of a satanic sect charged with the crime revealed that all the young people had a fragile, immature personality, a very low level of education and were socially disadvantaged. The trial of the members of the “Bestie di Satana” sect was concluded with the verdict of deliberate murder, and all the members were given long jail sentences. This report should lead us to explore social and cultural responses to juvenile satanism, statistically shown to be a relatively rare phenomenon but with a high criminal potential.     

群体性事件发生原因研究的再审视——层次分析方法的引入与应用

层次分析方法就是将导致某一事件发生的原因进行分层。将层次分析方法应用到群体性事件发生的原因研究中,群体性事件发生的原因可分为结构、体制机制和个人三个层次。通过比较三个不同层次上变量的重要性,结构层次上的变量最为根本和重要,体制机制层次上的变量次之,个人层次上的变量可视为常数。加强对结构和体制机制层次上的变量的研究,有助于深入探究群体性事件发生的深层次原因。     

Pedagogy of the Logic Model: Teaching Undergraduates to Work Together to Change Their Communities

Undergraduate community psychology courses can empower students to address challenging problems in their local communities. Creating a logic model is an experiential way to learn course concepts by “doing.” Throughout the semester, students work with peers to define a problem, develop an intervention, and plan an evaluation focused on an issue of concern to them. This report provides an overview of how to organize a community psychology course around the creation of a logic model in order for students to develop this applied skill. Two undergraduate student authors report on their experience with the logic model assignment, describing the community problem they chose to address, what they learned from the assignment, what they found challenging, and what they are doing now in their communities based on what they learned.     

安徽监狱企业集团组织结构变革初探

全国监狱体制改革后,安徽省监狱建立了全额保障、监企分开、收支分开、规范运行的新型监狱管理体制,但在实践中,监企分开运行机制并不能完全解决监狱管理运行中的问题。因此,在新型监狱管理体制下,需要进一步深化监狱体制改革。研究表明,通过优化监企分开运行模式。可以纯化监狱企业刑罚执行职能,释放监狱企业发展的活力,从而更好地发挥监狱企业服务监狱刑罚执行工作的职能作用。
